AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING ZONE RECLASSIFICATION REQUEST
ZC 82 -03 CAL STATE ASSOCIATES, LTD.
LOCATED NORTHWEST OF THE INTERSECTION OF POMERADO ROAD AND NINTH STREET
APN: 317 - 031 -33 AND 34
WHEREAS, on the fourteenth day of September, 1982, the City
Council considered the above referenced application; and
WHEREAS, the City Council has held duly advertised Public
Hearings pursuant to Section 65854 of the California Government Code.
NOW, THEREFORE, BE IT ORDAINED that the City Council of the City
of Poway, does hereby find:
Section 1: Findings
1. That the subject property is suitable for the uses
permitted in the proposed zone in terms of access, size,
and compatibility with existing land use in the
surrounding area because surrounding properties are also
residential and commercial in nature.
2. That the proposed zone reclassification would not have a
significant impact on the environment because the site
is already developed with an approved multi - family
residential project and is categorically exempt from
provisions of the California Environmental Quality Act.

3. That the proposed zone reclassification is in conformance
with the Poway General Plan because multi - family
residential developments are permitted on this property by
the General Plan.
Section 2
Pursuant to Section 65850 through 65855 of the California
Government Code the City Council of the City of Poway, hereby
approves Zone Reclassification R 82 -03 (Cal State Associates,
Ltd.) .
Section 3
The City Council finds that this project is categorically
exempt from the provisions of the California Environmental
Quality Act because the multi - family residential project
already exists.

The zoning classification described below is hereby changed
as follows:
OLD ZONE: Use Regulations C -36, Neighborhood Designator Q,
Density -, Lot Size -, Building Type T, Maximum Floor Area -,
Floor Area Ratio -, Height G, Lot Coverage -, Setbacks O,
Open Space A, Special Area Regulations -.
NEW ZONE: Use Regulations R -C, Neighborhood Designator A,
Density 40 DU per acre, Lot Size 6,000 square feet, Building
Type L, Maximum Floor Area -, Floor Area Ratio -, Height G,
Lot Coverage -, Setbacks L, Open Space A, Special Area
Regulations -.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 14th day of September, 1982.
