RESOLUTION NO. 05- 018
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE ANNUAL
CONTRACT EXTENSIONS WITH KISSINGER EQUIPMENT RENTAL, INC.
THROUGH 2010 AND RESCINDING RESOLUTION NO. 01-013
WHEREAS. the City Council supplements the Streets Maintenance Division by
renting a rental of dump trucks and drivers to complete the annual Surface Patch Program;
and
WHEREAS, the proposed contract for the rental of dump trucks and drivers contains
provisions to extend the contract on a year-to-year basis for a total of four additional one-
year periods; and
WHEREAS, Kissinger Equipment Rental submitted the lowest responsible bid that
meets the City's specifications.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: Five, one-year contract periods, extending the contract with Kissinger
Equipment Rental until March 27, 2010, are hereby approved.
Section 2: The Director of Public Works is hereby authorized to extend the contract
each year consistent with Section 19 of the rental of dump trucks and drivers contract.
Section 3: Based on Section 28 of the contract, the option to renew the contract
shall be adjusted based on 75% of the annual change in the previous calendar year's
Consumer Price Index for the San Diego area or 5% whichever is less
PASSED, ADOPTED AND APPROVED by the City Council ofthe City of Poway at a
regular meeting this 22nd day of March 2005.
