RESOLUTION NO. 05- 019
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE ANNUAL
CONTRACT EXTENSIONS WITH PAVEMENT RECYCLING SYSTEMS, INC.
THROUGH 2010 AND RESCINDING RESOLUTION NO. 01-008
WHEREAS, the City Council supplements the Streets Maintenance Division by
renting an asphalt cold milling grinder and operator to complete the annual Street
Maintenance Program; and
WHEREAS, the proposed contract to rent an asphalt cold milling grinder and
operator contains provisions to extend the contract on a year-to-year basis for a total of
four additional years; and
WHEREAS, Pavement Recycling Systems submitted the only bid that meets the
City's specifications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: Five, one-year contract periods, extending the contract with Pavement
Recycling Systems until March 1, 2010, are hereby approved.
Section 2: The Director of Public Works is hereby authorized to extend the contract
each year consistent with Section 19 of the Asphalt Cold Milling Grinder and Operator
Service Contract.
Section 3: Based on Section 28 of the contract, the option to renew the contract
shall be adjusted based on 75% of the annual change in the previous calendar year's
Consumer Price Index for the San Diego area or 5% whichever is less
PASSED, ADOPTED AND APPROVED by the City Council ofthe City of Poway at a
regular meeting this 22nd day of March 2005.
