A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 04-99R
FOR AN EXTENSION OF THE
TEMPORARY USE OF THREE PRACTICE BALL FIELDS
WHEREAS, Temporary Use Permit 04-99, Poway Girls Softball League,
Applicant, was approved by the City Council on December 21, 2004, and involved the
establishment and use of three practice ball fields and off-street parking on a vacant,
pre-graded, approximately one-acre site located at the northwest comer of the Espola
Road and Old Coach Road intersection, in the Planned Community zone, until the
sports fields at Aubrey Park are completed; and
WHEREAS, the City Council conditionally approved the above-referenced item
for a temporary term, stipulating that the approval was granted until the end of March
2005; and
WHEREAS, the recent rainy weather has delayed construction of the permanent
sports fields at Aubrey Park and additional time is needed by PGSL for use of the
temporary sports fields; and
WHEREAS, on March 29, 2005, the City Council considered TUP 04-99R for an
extension of the use.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, as follows:
Section 1: The City Council finds that Temporary Use Permit 04-99R is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the use is temporary in nature and will
have no adverse effects on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Chapter 17.26 of the Poway Municipal Code.
Section 3: The City Council hereby approves Temporary Use Permit 04-99R, subject
to the following conditions:
A. The use shall be conducted as shown on the site plan and application on file in
the Development Services Department.
B. This permit is valid from April 1, 2005, to May 31, 2005, or until such time the
sports fields at Aubrey Park are completed, whichever is sooner. The permit is

valid between the hours of 4:00 p.m. to 5:30 p.m. Monday through Friday and
8:00 a.m. to 5:30 p.m. on Saturdays. Additional time for set-up and to clean-up
immediately before and after these specified times are additionally permitted.
C. No lighting shall be used to illuminate the site and no amplified sound shall be
permitted.
D. The site shall be kept clean of litter and debris.
E. Approval of this activity shall not excuse compliance with all other Sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
F. Parking for the use shall occur on-site, or on the street adjacent to the site where
street parking is permitted.
G. Best Management Practices to minimize erosion and impacts to storm water
quality shall be employed at the discretion of the Director of Development
Services.
H. Portable toilets shall be placed on the site in the least visible locations from Old
Coach Road, to the satisfaction of the Director of Development Services.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 29th day of March 2005.
