CC 2005 03-01 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING March 1, 2005 The March 1, 2005, Regular Meeting of the City Council of the City of Poway, was called to order at 7:04 p.m. by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. No one wished to speak. 8321 Page 2 - CITY OF POW A Y - March 1, 2005 PUBLIC HEARINGS ITEM 1 (0210-50) MINOR CONDITIONAL USE PERMIT 04-17 MR & MRS WILLIAM POLLAKOV, APPLICANTS 14170 BRYCE POINT APN 277-220-34 INSTALLATION OF TENNIS COURT LIGHTS LOT 34 City Manager Bowersox gave the staff report. A Minor Conditional Use Permit is requested to permit the installation of lights at an approved tennis court on Lot 34, a 6.32-acre site at 14170 Bryce Point, located within the Heritage II development in the Rural Residential A (RR-A) zone. The project complies, or has been conditioned to comply, with all City development standards. The residence and tennis court are currently under construction. There was no one present wishing to speak on this public hearing. Motion by Council member Higginson, seconded by Council member Rexford, to close the public hearing, and adopt Planning Resolution No. P-05- 08 entitled "A Resolution of the City Council of the City of Poway, California, Approving Minor Conditional Use Permit 04- 17, a Request to Install Tennis Court Lights on Lot 34, a Residential Lot Located at 14170 Bryce Point, within the Heritage II Development, in the Rural Residential A Zone Assessor's Parcel Number 277-220-34". Motion carried unanimously. ITEM 2 (0700-10) REIMBURSEMENT AGREEMENT OLD COACH GOLF ESTATES TTM 89-13R AND HERITAGE RANCH ESTATES TTM 98-02 NORTHPOINT DEVELOPMENT, INC., APPLICANT City Manager Bowersox gave the staff report. Northpoint Development, Inc. has requested the City process a Reimbursement Agreement for certain public improvements in conjunction with Old Coach Golf Estates TTM 89-13R and Heritage Ranch Estates TTM 98-02. The Agreement has been prepared and is ready for execution after adoption of the Resolution approving the Agreement. The Mayor opened the public hearing. Ed Malone, 17150 Old Coach Road, Poway, objects to assessment amounts to property owners and has not reached concurrence with Northpoint on the Reimbursement Agreement. 8322 Page 3 - CITY OF POW A Y - March 1, 2005 Motion by Council member Higginson, seconded by Deputy Mayor Emery, to close the public hearing, and adopt Resolution No. 05-014 entitled "A Resolution of the City Council of the City of Poway, California, Approving a Reimbursement Agreement for Certain Public Improvements in Conjunction with Old Coach Golf Estates TTM 89-13R and Heritage Ranch Estates TTM 98-02." Motion passed unanimously. STAFF REPORTS ITEM 3 (0200-20) DEVELOPMENT REVIEW 97-16R 12180 KIRKHAM ROAD APPLICANT: SYSCO FOOD SERVICE APN: 317-270-56 Councilmember Rexford advised that she had previously disqualified herself on this issue due to a potential conflict of interest relating to the location of this property in relation to her own, but has confirmed that her property is over 500 feet away from this property and that she is permitted to participate in consideration of this item. City Manager Bowersox provided the staff report. This item was continued from the February 8, 2005, City Council meeting to allow staff time to research effects of high- pressure sodium lighting on operations of the Palomar Observatory. This is a request to modify a Development Review Permit and a Lighting Exemption Permit to replace existing low-pressure sodium light fixtures at the SYSCO business located at 12180 Kirkham Road with high-pressure sodium light fixtures. The request is to promote pedestrian and vehicle safety in the truck loading/staging area during nighttime operations. Scott Kardell, Palomar Observatory, 35899 Canfield Road, presented a PowerPoint presentation on light pollution in San Diego area and the effects of high-pressure sodium lights. He was supportive of use of low-pressure sodium lights. The following members of the public spoke in support of staff's recommendation to deny the request according to findings in the proposed Resolution of Denial: Kelly Hutchinson, 1125 Beeler Canyon Road, Poway Dave Davis, 11019 Beeler Canyon Road The following person spoke in opposition of the staff recommendation to deny: Rich Friedlen, President and CEO of SYSCO, 12180 Kirkham Road, requested a field test trial for the high-pressure sodium lights. Mr. Friedlen stated that the current lighting is a safety hazard for the employees that work nights in the truck loading/staging area. 8323 Page 4 - CITY OF POW A Y - March 1, 2005 Council discussed the proposed lighting and the impacts it may have on the Palomar Observatory. Motion by Deputy Mayor Emery, seconded by Council member Rexford, to deny the Development Review 97-16R for a lighting Exemption, and adopted Resolution P-05-09 entitled "A Resolution of the City Council of the City of Poway, California Denying Development Review (DR) 97 -16R Assessor's Parcel Number 317-270-56, with conditions. Motion passed unanimously. The City Council did encourage the applicant to test the high-pressure sodium lights at a location other than SYSCO, possibly a Public Works location, and bring back study results to the City for consideration. Deputy Mayor Emery said the door is not closed, but applicant needs to prove that high-pressure sodium lights do not have a negative impact. ITEM 4 (0210-30) MODIFICATION TO CONDITIONAL USE PERMIT 00-17(M} RESURRECTION COMMUNITY CHURCH, APPLICANT 12730 ELMPARK LANE / APN 317-640-52 City Manager Bowersox gave the staff report. This is a one-year status update on the approved preschool and expanded church hours of operation at the Resurrection Community Church located at 12730 Elmpark Lane, within the Residential Single-Family 7 (RS-7) zone, as required by the conditions of approval of CUP 00-17(M). The intent of the update was to determine whether the approved Elmpark Lane drop-off/pick-up location and extended hours of operations have caused noise impacts within the neighborhood, and whether the church has complied with conditions of approval. The preschool has not yet started but is scheduled to begin operation in a few months. The City Council concurred with the City Manager's recommendation to submit a status report six months from the date that the preschool's operations begin. ITEM 5 (0200-25) HILLSIDE/RIDGELlNE MINOR DEVELOPMENT REVIEW APPLICATION 04-105 7.69-ACRE PARCEL NORTH SIDE EASTVALE (RR-B2 ZONE) MARK CATRAMBONE, APPLICANT APN 278-240-20 The applicant is requesting the approval of a Minor Development Review Application to permit the construction of a 4,700 square-foot, single-story, single-family residence, measuring a maximum of 26 feet in height and a 660 square-foot garage. 8324 Page 5 - CITY OF POW A Y - March 1, 2005 The site is a vacant 7.69-acre parcel located along the north side of Eastvale Road, east of Canyon Pass and adjacent to the south side of Skyridge Road. The parcel is located within the Rural Residential B2 zone and within the Hillside/Ridgeline Review Area. Access to the site is along a private easement through the adjacent parcel to the south. Pursuant to Section 17.52.050, City Council approval is required for grading and development within the identified Hillside/Ridgeline Review Area. Dick Lyles, 15606 Quail Mountain Road, Poway, opposes the project and objects to the applicant trespassing on his property to gain access to his own property. Don Ales, RBF Engineering, spoke on behalf of the owner, Mr. Catrambone. The Mayor admonished Mr. Catrambone that all construction traffic shall take access from the private road easement off of Eastvale Road. Access from Skyridge shall not be allowed unless the applicant obtains legal access rights. Motion by Deputy Mayor Emery, seconded by Councilmember Rexford, to adopt Planning Resolution P-05-10 entitled "A Resolution of the City Council of the City of Poway, California, Approving Minor Development Review Application (MDRA) 04-105 Assessor's Parcel umber 278-240-20" approving with conditions. Motion passed unanimously. CONSENT CALENDAR Motion by Deputy Mayor Emery and seconded by Councilmember Rexford to approve the Consent Calendar Items 6 through 13.1. Motion carried unanimously. 6. City Manager Bowersox announced the Adjourned City Council Meeting Workshop to be held on Thursday, March 3, 2005 at 6:00 p.m. in Council Chambers and reviewed items for discussion. MAYOR AND CITY COUNCIL-INITIATED ITEMS 17. Council member Rexford asked an item be placed on the next agenda to discuss City/Redevelopment Agency reviewing opportunities to make minor improvements at Valley School pending their 2007 school district's improvements. 19. Deputy Mayor Emery provided a review of the Council received the review on House on the Hill restaurant saying it was very good. 8326 Page 7 - CITY OF POW A Y - March 1, 2005 Deputy Mayor Emery discussed the attempts to privatize public pension plans by the Legislature and/or the Governor and asked staff to review and report back to Council on public pension plan revisions and privatization currently being discussed. Deputy Mayor Emery asked staff to meet with Palomar College about their plans for a campus in Poway as referenced in Tuesday's State of the Community breakfast. 20. Mayor Cafagna reported on SANDAG's discussion of affordable housing allocations over the next five years.
