BACKGROUND
A. Project Description

Mr.. and Mrs. Liguori are requesting that Council approve Minor
Development Review Application 86-37 for'the construction of a
7,377 square foot, two-story barn.` Accessory living quarters
within the' structure include a`one-bathroom caretaker apartment,
located on the ground floor. The property is located in the "Old
Coach" area and because of its remote location the caretaker unit
is requested for security reasons.
The proposed project complies with the setbacks, the height limit,
and the lot covers e _ tions o£ the property development scan -

dards of the RR -A zone. The surrounding properties are under the
same zoning designation as the subject lot.
B. Development Facilities
Approval of the project will require improving the private, dri-
veway, the extension of public utilities, the payment of'park land
dedication fees, drainage fees, traffic fees, and school impact
fees,

C. Environmental Review
The project is categorically exempt from the provisions of the
California Environmental Quality Act, and an exemption will be
filed with the County Clerk.
D Correspondence
Notice of the public hearing has been sent to property owners adja-
cent to the project prior to the hearing.
FINDINGB
The proposed development is consistent with the General Plan and
the Zoning Ordinance. No.adverse impacts of an aesthetic, safety,
or -architectural nature upon private properties will occur because
rooflines construction methods, materials, building locations, and
elevations will be compatible with surrounding properties. The
project meets the zoning Ordinance criteria and encourages the
orderly development of the City because it is similar to and
complements adjacent development,

A RESOLUTION OF THE CITY COUNCIL
- OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW 86-37
ASSESSOR'S PARCEL NUMBER 277-021-02, 04 and 277-011-04
WHEREAS, Minor Development, Review 86-37, submitted by Tom and
Susan Liguori, applicants, requests approval to construct a 7,377
square foot barn with accessory living quarters for the property
located at 15555 Old, Coach Way in the Rural Residential A Zone.
WHEREAS, on June 3, 1986, ,the City Council held a hearing on
the above= -referenced item.
NOW, THEREFORE, the City Council does hereby resolve as
follows:
Section 1: Findings
1. That the proposed development is in conformance with the -
Poway General Plan.

2. That the proposed development will not have an adverse
aesthetic, health`, safety, or architecturally related
f!
impact upon adjoining properties.
3.1 That the proposed development is in compliance with the
Zoning Ordinance.
4.• That the proposed development encourages the orderly and

harmonious appearance of structures and property within
the City.
5.' That the necessary findings for waiving of the

undergrounding of existing overhead utilities have been
identified.
Section,2_.- Environmental Findings:
This project is categorically exempt (Class 3) from the provi-
sions of the California Environmental Quality Act.

Section 3: City-Council Decision;
The
City Council hereby approves Minor Development Review 86-37
subject to the following conditions:
1.
Within 30 days of approval, the applicant shall submit in
writing that all conditions of approval have been read and i
understood.
2.
This project-must meet any applicable requirements related
to Ordinance No. 103 (street improvements, drainage fees,
parkfees, traffic mitigation fees) to the satisfaction of
•
the Director of Public Services.
3.
The appropriate Building Department approvals shall be
-received prior to initiation of construction.
4.
School impact fees shall be paid at the time. of issuance
of building permits in accordance with Ordinance No. 184,
Poway Planning Services should be contacted regarding this
requirement.
5.
All applicable construction standards pertaining to the
existing and the proposed extension of the private drive-
way shall be in compliance with Municipal Code Section
17.08.190P to the satisfaction of the Directors of Public
='
and Planning Services. _ -
6.
All created slopes over 5 feet in height shall be planted.
with ground cover, shrubs, and trees in 'compliance with
Ordinance No. 77.
7.
New utility lines from the existing pole to the proposed
-barn shall be undergrounded and only one electric meter
shall be allowed.

The applicants shall submit a letter to Planning Services
stating that,the detached living area will not be renter
as a'separate unit. A declaration of land. use restriciton
prohibiting the rental of the accessary living quarters;
shall be recorded prior to final inspections.
9.
Prior to the issuance of building permits for combustible
construction,, evidence shall be submitted to the Director
of Safety Services that water supply and facilities for
fire protection is available. Where additional fire` pro-
tection is required by the Director of Safety"Services, it
shall be serviceable prior to the time of construction.
