SUBJECT: November 4, 1986 Election
ABSTRACT
*
It is necessary for the City Council to take certain actions in relation to the
upcomingelection. Resolutions must be adopted: a) calling the election; b)
requesting the County to consolidate; and c) setting word limits and cost for
candidates. It is recommended that the City Council adopt the attached
resolutions.
13PCKGROUND
State law gives the option of 200 or 400 words for the candidate's statement.
The City's past Practice has been to set a limit of 200 words.
State law also gives the Counciathe option of charging the candidates for all
or part of the cost of printing the candidate's statement.- Past practice has
been to charge a $50.00 flat fee and the City absorbs the difference. In 1984,
the difference was approximately $30.00 per candidate..

It is reccnded that the City Council adopt the attached resolutions entitled:
1 } "A Resolution of the City Council of the City of Poway, California,
Calling and Giving Notice of the Holding of a General municipal
Election to be held on Tuesday, November 4, 1986, for the Election of
Certain officers as Required by the Provisions ' of the Lacus of the State
of California. Relating to General haw Cities";

CALLING AND GIVING NONCE. OF THE HOLDING
OF A GENERAL M ]NICIPAL RE ",TION TO BE
HELD ON TUESDAY, NUMMER 4, 1986,
FOR THE ELECTION OF CERTAIN OFFICERS AS

REQUIRED BY THE PROVISIONS OF THELAWS OF 1
THE STATE OF CALIFORNIA RELATING TO
GENERAL LAW CITIES �
WHEREAS,, under the provisions of the laws relating to general law cities in
the State of California, a general municipal election shall be held on November
4, 1986, for the election of municipal officers;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DOES
RESOLVE, DECLARE, DETERMINE AND ORDER .AS FOLLOWS
Section l.. That pursuant to the requireents of the laws of the State of
California relating to General .Law cities, there is called and ordered to be
held in the City of Poway, California, on Tuesday,. November 4, 1986, a general
municipal election for the purpose of electing three members of the City Council
for the full term of four- years.
Section 2. That the ballots to be used at the election shall be in form
and content as required by law.
Section 3. That the City Clerk is authorized to procure. and furnish any
and all official ballots, notices, printed matter and all supplies, equip-
ment .and paraphernalia that may be necessary in order to properly and
lawfully conduct the election.
Section 4. That the polls for the electionshall be _poen at seven
o'clock.a.m. of the day of the election and shall remain open Continuously
frau that time until eight o`clock p.m. of the same day when the polls shall
be closed, except asprovided in Section 14301 of the Elections Code of the
State of California.
Section 5. That in. all particulars not, recited in this resolution, the
election shall be held and conducted as provided by law for holding munici-
pal elections.
Section 6. That notice of the time and place of holding the election is

given and the City Clerkis authorized, to give further or additional notice
of the election, in time, form and manner as required by law.

PURSEJANT TO. SECTION 23302. OF TIS ELECTIONS CODE
mmvAs, the City Council of the City of' Poway called a general municipal
election to be held on November 4, 1986, for the purpose of the election of mem—
bers of the City Counc? ; and
w . , it is desirable that the general municipal election be consolidated
with the statewide general election to beheld on the same date and that within
the City the precincts, polling places and election officers of the two elec
tions be the same, and that the Registrar of Voters of the County of San Diego
canvass the returns of the general municipal election- and that the election_: be
held in all respects as if there were only one election.
NOW, TIMUFOREF THE CITY COUNCIL OF THE CITY OF POWAY DOES RESOLVE, DECLARE,
DETERMINE AND ORDER AS FOLLOWS:
Section 1 That pursuant to the requirements -of Section 23302 of the
Elections Code, the Board ,of Supervisors of the County of San Diego is
hereby requested to consent and agree to the consolidation of a general
municipal election with the statewide general election on Tuesday, November
4, 1986, for the purpose of the election of three members of the City
Council
Section 2.; That the Registrar of Voters- is authorized to canvass the
returns of the general municipal election. The election shall be held in ;
all respects as if there were only one election, and only one form of ballot
shall be used.
Section 3. That the Board of Supervisors is requested to issue instruc—
tions. to the Registrar of Venters to take any and all steps necessary for the
holding of the consolidated election.
Section 4. That the City of Poway recognizes that additional costs will
be incurred. by the County by reason of this consolidation and agrees to
reimburse the County for any costs.
,Section 5. khat the City Clerk is hereby directed to file a certified
copy of this resolution with the: Board of Supervisors and the Registrar of
Voters of the County of San Diego.

vides that the governing body of any local agency adopt regulations pertaining
to materials prepared by any candidate for a municipal election, including costs
of the candidates statement,
NO'W, SORE, THE CITY COUNCIL OF THE CITY OF POWAY'? CALIFORNIA, DOES
HEREBY RESOLVE, DECLARE', DETERMINE ASID ORDER AS FOLLOWS
Section 1. GENERAL PROVISIONS. That pursuant tol Section 10012, of the
Elections Code of the State of California, each candidate f6r7 elective
office to be voted for at an election to be held in the City of Poway may
prepare a.condidate's statement on anappropriate form provided. by the City
Clerk.. The statement may include the name, age and occupation of the can_
dilate and a brief` description of no more than words of the candidate's edu-
cation and qualifications expressed by the candidate himself or herself
The statement shall not includeparty affilliation of the candidate, nor
membership. or activity in partisan political organizations. The statement
shall be filed in the office of the City Clerk at the time the candidate's;
nomination papers are filed. The statement may be withdrawn, but not
changed, during the period for filing nomination papers and until 5:00 p.m.
of the next working day after the close of the: nan nation period.:
Section 2. SPANISH LANGUAGE. The City Clerk shall have translated and
printed in the voters pamphlet only the candidates statements of those can--
didates who request translation and printing. Costs of translation shall.be
paid for by the candidate in advance.
Section. 3. ADDITIONAL, MATMUMS. No candidate will be permitted to
include additional materials in the sample ballot package.
Section 4. PAYMENT. Each candidate shall pay in advance fifty dollars
($50.00) For the printing and distribution of the candidate's statement in

the voter's pamphlet.
Section 5. The City Clerk shall provide each candidate or the can s
didate's representative a copy of this Resolution at the time nominating
petitions are issued.
Section 6 All previous resolutions establishing Council policy on
payment for candidates statements are repealed.
