BACKGROUND
A. Project Description
on April 23, 1985, the Council directed Staff to bring to Council
for 'review each application for a building permit for detached
accessory living quarters or guest houses
Although this project is called a pool cabana, because of its size
and the interior amenities which it contains, it must be reviewed
under the criteria for accessory living quarters. The proposed
structure has approximately 600 square feet and contains a bath,
wet bar, and fireplace.,
The proposed.project meets the setback requirements for accessory
structures and combined with the square footage of the new:home
satisfies the lot coverage. restrictions of the property development
standards of the RR -C Zone.
B. Environmental Review
The project is. categorically exempt from the provisions of the
California Environmental Quality Act, and an exemption will be
filed with the County Clerk.
FINDINGS
The proposed development is consistent with the General Plan and
the Zoning Ordinance-. No adverse impacts of an aesthetic, safety,
or architectural nature upon private properties will occur because
rooflines, construction methods, materials, building locations, and
elevations will be compatible with surrounding properties. The
project meets the Zoning Ordinance criteria and encourages the
orderly development of the City because it is similar to and
complements adjacent development,
RECOMMENDATION
It is recommended that the City Council approve Minor Development
Review 86-43 subject to conditions contained.in the attached reso—
lution.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MINOR DEVELOPMENT REVIEW86-43
ASSESSOR'S PARCEL NUMBER 273-911-21 a--
WHEREAS, Minor Development Review 86-43, submitted by Alun
Royster, applicant, requests approval to construct:a 600 square
foot pool cabana for the property located at 1.2930 Paso de las
Piedras in the Rural Residential -C Zone.
WHEREAS, on June 12, 1986, the City Council held a hearing on
the above --referenced item.

NOW, THEREFORE, the City Council does hereby resolve as
follows:

Section 1: Findings:
1. That the proposed development is in conformance with the
Poway General Plan.
2. That the proposed development will not have an adverse
aesthetic, health, safety, or architecturally related
impact upon adjoining properties.
3. That the proposed development is in compliance with the
Zoning ordinance.
4. That the proposed development encourages the orderly and
harmonious appearance of structures and property within
he City.
Section 2: Environmental Findings:
This project is categorically exempt (Class 3) from the provi-
sions of the California EnvironmentalQualityAct,
Section 3: City Council Decision;
The City Council hereby approves Minor Development Review 86-43
subject to the following conditions:
1. Within 30 days of approval, the applicant shall submit in
writing that all conditions of approval have been read and..

2. This 'project must meet any applicable requirements related
to Ordinance No. 103 (street improvements, drainage fees,
park fees, traffic mitigation fees) to the satisfaction of

the Director of Public Services.

The appropriate Building Department approvals and permits
shall be received prior to initiation of construction.

A1.1 created slopes over 5 feet in height shall be planted
with ground cover, shrubs, and trees in compliance with

ordinance No.. 77.
5.
The applicants shall submit a letter to Planning Services
stating kitchen facilities will not be installed in the
detached living area and said area will not be rented as a
separate unit. A declaration of land use restriction 'pro-
hibiting the rental of the accessory living quarters and
installationofkitchen facilities shall be'recorded prior
to final inspections.
APPROVED and ADOPTED by the City Council of the City of Poway,
State of California, this 12th day of June, 1986
