Bowersox, City Mana fi Adminis INITIATED BY: Kay D. jimno, Director of trative Service DATE: April 15, 1986 SUBJECT: Bair Labor Standards Act 7(K) Exemption for Safety Employees ABSTRACT Due to the Fair Labor Standards: Act, whish became effective today, April ,15, 19861 it is necessary for the: City of Poway to formally; declare a 7(K) exemption for fire service personnel.` BACKGROUND The Fair Labor Standards Act specifies that overtime pay at time and K one-half must be paid to all employees who work in excess of a 40 -hour workweek. For fire service personnel, the 7(K) exemption provides that such overtime is due far, work performed in excess of a 53 -hour' wo-rkweek.., The: average workweek for Poway fire personnel is. 56 hours. Every 24 days firepersonnel work eight regular twenty-four hour- shifts for a total of 19.2, hours.. The 7W exemption provides: that overtime at time and one-half is due after a total of 182 hours- in 24 days. Therefore, 1.0 hours of overtime at time and one-half will normally m be due at the end of a. 24 -day cycle a RECOMMENDATION It is recommended that. RESOLUTION OY THE CITY COUNCIL OF'THE :CITY OF POWAY, CALIFORNIA DECLARING THE 7(K) EXEMPTION OY THE FAIR LABOR STANDARDS ACT` AS APPLICABLE TO CERTAIN SAFETY SERVICE'S_ PERSONNEL WHEREAS the 7(K) exemption of the:FLSA.provides that fire service personnel may have an alternative Workweek than 40 hours if a City so -declares; and WHEREAS, the 7(K) exemption_provides that overtime at time and one-halfshall be paid. for all hours: worked in excess of a 53 -hour workweek. NOW,. THEREFORE, the City Council of the City of Poway does hereby; resolve- and order as follows: Section 1. The City of Poway elects to declare the 7(K) exemption as it pertains to Safety Service personnel who work twenty- four hour shifts., Section, 2. The work period for twenty-four hours shift public safety employees shall. be a, regularly- recurring twenty-four day period,, commencing at 12:00 midnight on April 14, 1986.
