Ord 07 ORDINANCE NO. 7 ~'~ ~ ~ ' AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA SETTING COUNCIL SALARIES BE IT ORDAINED that salaries for members of the City Council of Poway are hereby established pursuant to the provisions of The California Govern- ment Code in the sum of One Hundred and Fifty Dollars ($150) per month. BE IT FURTHER ORDAINED that the members of the City Council shall be reimbursed for their reasonable and necessary expenses incurred in the discharge of their duties as members of the City Council of Poway. The City of Poway was incorporated on December 1, 1980, comprising territory formerly unincorporated. The City Council has just organized, and since there was no predecessor City Council, no law has been adopted pursuant to the California Government Code setting salaries for Council members. Since the California Constitution prohibits the payment, retro- actively, of compensation for work already performed on behalf of a govern- mental agency, this Ordinance must go into effect immediately in order to provide Council salaries coterminus with the Council members' terms of office. It is necessary to provide for the government of the City, including the services of City Council members, to protect and preserve the public peace, health and safety, and therefore this Ordinance shall take effect immediately.
