COVENANT REGARDING REAL PROPERTY
Raindance Family Trust 09-17-98 ("OWNER" hereinafter), is the owner of real property
commonly known as 15829 Lime Grove Road ("PROPERTY" hereinafter).
Pursuant to Poway Municipal Code Section (PMC) 17.08.170(B)(6) and in consideration of the
approval of Building Permit B14-1825, a request to construct an addition to the main home that would
connect the main home to a permitted detached non -habitable, accessory structure at the above -
referenced property by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that future
additions to the home would not be subject to setback exceptions contained in PMC Section
17.08.170(B)(4). Therefore, any future additions to the home would have to comply with the setbacks
applicable to the main residence, not detached non -habitable structures.
This Covenant shall run with the land and be binding upon and inure to the benefit of future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing
party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party.
