Res P-05-34 RESOLUTION NO. P-05-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 05-08 TO HOLD THE COMMUNITY BAND FESTIVAL 2005 AND THE POWAY GIRLS SOFTBALL LEAGUE SPRING 2005 CLOSING CEREMONIES WHEREAS, Temporary Use Permit (TUP) 05-08, City of Poway Community Services, Applicant, requests approval to hold the Community Band Festival 2005 at Old Poway Park, 14134 Midland Road, on Saturday, May 21,2005, from 12:00 p.m. to 7:00 p.m., and on Sunday, May 22,2005, from 12:00 p.m. to 7:30 p.m.; and WHEREAS, Poway Girls Softball League has requested that TUP 05-08 be amended to hold their Spring 2005 Closing Ceremonies at Aubrey Park, 13544 Aubrey Street, on Saturday, May 21, 2005, from 1 :00 p.m. to 6:00 p.m.; and WHEREAS, on May 17, 2005, the City Council considered the above-referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 05-08 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304( e) of the CEQA Guidelines, as the event is temporary in nature and will have no effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 05-08, the Community Band Festival 2005 at Old Poway Park, 14134 Midland Road, on Saturday, May 21,2005, from 12:00 p.m. to 7:00 p.m. and on Sunday, May 22,2005, from 12:00 p.m. to 7:30 p.m., and the Poway Girls Softball League Spring 2005 Closing Ceremonies on Saturday, May 21, 2005 from 1 :00 p.m. to 6:00 p.m., subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. The Poway Girls Softball League shall coordinate with the City of Poway Community Services Department to provide off-site parking and a shuttle service, as needed. B. This permit is valid during the hours of 12:00 p.m. to 7:00 p.m. on Saturday, May 21, 2005, and from 12:00 p.m. to 7:30 p.m. on Sunday, May 22, 2005, after which time the site shall be restored to its original condition. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein. E. Prior to the event, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Community Services, Customer Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriff's Department. 2. Obtain a permit from the Fire Department for any canopy that exceeds 400 square feet. 3. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the Poway Municipal Code. F. During the event, the applicant shall comply with the following: 1. Do not block emergency vehicle access to any building, fire hydrant, or fire sprinkler system connection. 2. Provide at least one fire extinguisher with a minimum rating of 2A 1 OBC at any booth where food is prepared. 3. Secure any compressed gas cylinders from falling over. 4. The use of amplified sound by the Poway Girls Softball League is permitted and the sound shall not be heard beyond to the boundaries of Aubrey Park. G. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event, shall be cleared of debris, litter, temporary signs and all other evidence of the event. Section 4: 9:00 p.m., condition. This approval shall become null and void on Sunday, May 22, 2005, at at which time the site utilized shall have been restored to its original Resolution No. P-05-34 Page 3 PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway, State of California, at a regular meeting this 17th day of May 2005.
