The January 23, 1990, regular meeting of the City Council of the City of
Poway was called to order at 7:04 p.m. by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

Birthday Celebration Week" and presented a proclamation to George Rosie and Don
Janiuk, from the Poway Kiwanis Club.

Mayor Higginson congratulated City Attorney Stephen M. Eckis for being named E1
Cajon's Citizen of the Year and presented a Resolution commending his achieve-
ment.

Mayor Hlgglnson explained the procedure for Public Oral Communications.
Harry S. George, 14110 Palisades Drive, spoke regarding speeding traffic on
Pequot Drive and Palisades Drive.
City Manager Bowersox noted that this item is being considered by the Traffic
Safety Committee and a report to Council will be scheduled in the next few
weeks.
CONSENT CALENDAR
Motion by Councilmember Kruse, seconded by Councilmember Emery to approve the
Consent Calendar as follows:

Adoption of Resolution No. go-o07 entitled, "A Resolution of the City
Council of the City of Poway, California, Authorizing the City Department
Head to Destroy City Records After the Same are no Longer Required."
14.
Approval of minor revision to Development Review 89-12; substituting Plan
2080 for Plan 2092 in the last Phase of the Sycamore Creek project, located
east of the intersection of Garden Road and Sycamore Canyon Road.

Adoption of Resolution No. 90-008 entitled, "A Resolution of the City
Council of the City of Poway, California, Restricting Use of the Poway
Center for the Performing Arts During Times at Which Alcoholic Beverages
are Being Consumed."

California Library Construction and Renovation Bond Act of 1988

and reimbursement agreement for drainage improvements from contributions to
the Drainage Basin Fund pursuant to Municipal Code Section 16.72.140 for
T'NT Oak Knoll, Turk applicant.

TENTATIVE PARCEL MAP 89-18
APPLICANT: STANDARD PACIFIC OF SAN DIEGO
Mayor Higginson opened the public hearing. Staff report by City Manager
Bowersox. This is a request to resubdivide Lot 275 of Tract Map 4191-R and a
residual parcel of former state land located on the east side of Palisades
Drive, approximately one-half mile southeast of Silverset Street in the Rancho
Arbolitos development. This map would add two lots to the total 975 approved
under the Rancho Arbolitos Planned Co, m.unity. To alleviate the excess of lots,
the applicant will transfer one lot from the approved and non-recorded 13 lot
map of 4191-9R and Lot 324 of Tract 4191-4R. Staff recommends approval.
Mayor Higginson read a statement from Ethel Truitt, Rancho Arbolitos resident,
in favor of staff recommendation.
Speaking in favor of staff recommendation:
David Phares, Standard Pacific of San Diego, 7290 Clairemont Mesa Boulevard,
San Diego, requested revisions to conditions of approval requiring
development review or minor development review prior to issuance of
building permit, and transfer of ownership prior to approval of final
map.
City Manager Bowersox stated that since the transfer of ownership has already
occurred, this condition could be deleted; and since a development review was
previously approved for the Palisades, a condition that development shall occur
in conformance with Development Review 86-10 would be appropriate.
Motion by Councilmember Kruse, seconded by Councilmember Brannon, to close the
public hearing, and adopt Planning Resolution No. P-90-07 entitled, "A
Resolution of the City Council of the City of Poway, California, Approving
Tentative Parcel Map 89-18, Assessor's Parcel Number 317-050-27, 28," as
amended. Motion carried 4-1, with Councilmember Emery voting "no."
ITEM 5
TRAFFIC CONTROL AT THE INTERSECTION OF
CARRIAGE ROAD AND ROBISON BOULEVARD
City Manager Bowersox stated that at the October 17, 1989 City Council meeting,
Council directed staff to refer consideration of an all-way stop at the inter-
section of Carriage Road and Robison Boulevard to the Traffic Safety Committee.
Based on analysis by Engineering and review by the Traffic Safety Committee,
staff recommends no controls be established at this time and that staff re-
evaluate the intersection upon completion of the condominium project to the east
of Carriage Road.
Motion by Councilmember Emery, seconded by Councilmember Goldsmith, to approve
staff recommendation. Motion carried unanimously.

BALLOT MEASURE FOR DIRECT ELECTION OF MAYOR
Introduction by City Manager Bowersox. At the April 6, 1989 workshop meeting to
identify goals and objectives for the coming year, the Council discussed the
possibility of a ballot measure which would provide for the direct election of
the Mayor. Since incorporation, the Mayor has been selected from the
Councilmembers.
City Attorney Eckis reported on the powers granted to a general law city by the
Constitution and statutes of the State of California. As an alternative to a
Council appointed Mayor, the electors of the City may approve a measure which
would provide for the direct election of the Mayor, for either a two or four-
year term. The ballot measure could not increase or alter the powers of a
Mayor. The City Council would have to consent to granting additional powers to
the Mayor and could revoke its consent at any time. If the directly elected
Mayor measure was adopted by the voters in June, the Mayor would be first
elected on the November 1990 ballot.
If the City Council determines to place a measure on the June ballot for the
direct election of the Mayor, staff reco. m.ends the Council direct the City
Attorney to prepare ballot documents for review by the Council on February 20,
1990.
Council discussion included a perceived desire by the public for a directly
elected Mayor; continuity and leadership role with regional organizations; the
fact that one incumbent, Councilmember Kruse, has already announced he will not
be running for reelection in November; and a short time frame for nonincumbent
candidates to gather support and organize campaign committees.
Motion by Councilmember Kruse, seconded by Councilmember Emery, to direct the
City Attorney to prepare ballot documents for a directly elected Mayor with a
four-year term for review by the Council during February, 1990. Motion carried
4-1, with Mayor Higginson voting "no."

CITY MANAGER ITEMS
City Manager Bowersox announced that the first baby born to a Poway resident at
Pomerado Hospital for 1990 and recipient of a $100 Savings Bond was Brianna Lynn
Flud, born January 2, 1990 at 12:47 p.m., to parents Christopher and Denise
Flud.

CITY ATTORNEY ITEMS
City Attorney Eckis requested a closed session pursuant to discuss performance
of employee, and that Council find that a closed session should be held under
Government Code §54954.2, in that the need has arisen within the past 72 hours.
Motion by Councilmember Brannon, seconded by Councilmember Emery, to find that a
closed session should be held as recommended by the City Attorney. Motion
carried unanimously.
CITY COUNCIL-INITIATED ITEMS
20. Councilmember Emery requested a status report on low sodium lights for
shopping center parking lots.
21. Councllmember Goldsmith requested the Council consider a process for appeal
of staff determination that an application for sewer capacity does not
qualify under the Redevelopment Category.
City Manager Bowersox stated that City Attorney Eckis will prepare an appeal
process for Council consideration by which any type of staff decision could
be appealed to the City Council.
CLOSED SESSION
Mayor Higginson called for a closed session at 7:55 p.m., as requested by the
City Attorney.
CALL TO ORDER AND ADJOURNMENT
Mayor Hlgginson called the meeting back to order at 7:59 p.m. with all
Councilmembers present and stated that no action was taken in closed session.
Upon motion by Councilmember Emery, seconded by Councilmember Kruse, Mayor
Higginson ordered the meeting adjourned. The time of adjournment was 8:00 p.m.
