A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY
ORDERING THE SUMMARY VACATION OF STREET RESERVATION DESIGNATED
"LOT A RESERVED FOR FUTURE STREET" IN GREEN VALLEY ESTATES,
UNIT NO. 12, MAP NO. 4934, TOGETHER WITH THE
ABUTTERS' RIGHTS OF ACCESS APPURTENANT TO
LOT A IN AND TO SAGEWOOD DRIVE
(Vacation 93-01)
WHEREAS, the City Council of the City of Poway desires to summarily
vacate a street in accordance with the procedures provided in Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of California,
commencing at Section 8330; and
WHEREAS, the street reservation designated "Lot A Reserved for Future
Street" together with the abutters' rights of access appurtenant to Lot A in
and to Sagewood Drive were offered for dedication to the County of San Diego,
on behalf of the public, in the final map of Green Valley Estates, Unit 12,
Map No. 4934, recorded in the office of the San Diego County Recorder on March
21, 1962; and
WHEREAS, on said Map No. 4934, the offer of dedication for the street
reservation was rejected and the abutters' rights of access was accepted; and
WHEREAS, the City of Poway became the successor in interest to the
County of San Diego for said street reservation and the abutters' rights of
access upon the City's incorporation on December 1, 1980; and
WHEREAS, the street reservation which is supposed to be accepted for
public street for access to the adjoining property to the east was not
utilized in the design and development of the now developed residential
subdivision, identified as City of Poway Tract 4092-R, Map No. 11320, recorded
September 10, 1985; and
WHEREAS, in said Map No. 11320, all streets within the subdivision are
public streets with connections to Espola Road and Poway Road; and
WHEREAS, said street reservation in Map No. 4934 is determined an excess
street right-of-way and that the abutters' rights connected therewith are no
longer necessary.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as foll ows:
1. This summary vacation is made under the provisions of Chapter 4,
Part 3, Division 9 of the Streets and Highways Code of the State of
California.
2. The City Council hereby finds that the street reservation
des i gnated "Lot A Reserved for Future Street" in Green Valley
Estates, Unit No. 12, Map No. 4934 together with the abutters'
rights of access appurtenant to Lot A in and to Sagewood Drive are
excess rights-of-way and are not required for street purposes
(Section 8334a).

The City Clerk of the City of Poway is hereby directed to cause a
certified copy of this resolution to be recorded in the office of
the County Recorder of San Diego in accordance with the provisions
of Chapter 4, Part 3, Division 9 of the Streets and Highways Code
commencing at Section B330.
PASSES, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 2nd day of February, 1993.
