GRANT OF EASEMENT
PEDESTRIAN TRAIL
Recording Fee: Exempt
STEPHEN W. BASSETT III (hereinafter "GRANTOR") hereby grants to CITY
OF POWAY (hereinafter "GRANTEE") its successors, or assigns, the following
described two-foot wide easement for use by the public as a pedestrian
trail.
Said easement of right-of-way lands is particularly described on
Exhibit "A" attached hereto and by this reference made a part hereof. Said
easement is depicted on Exhibit "B" attached hereto.
Said easement shall not be used by motorized vehicles. GRANTEE shall
exercise its best efforts to prohibit such use.
Said grant of easement shall in no way interfere with the GRANTOR's
rights to the enjoyment of the use of said land for any purpose and in any
manner not interfering with, or otherwise inconsistent with, the pedestrian
trail use granted hereby.
Providing that GRANTEE does not modify or interfere with the trail
use, it shall be a condition of said easement that GRANTEE shall defend,
indemnify, and hold harmless GRANTOR from any and all liability arising
from the use of said easement by the public.
Said easement shall run with the land and shall be binding upon the
heirs, executors, successors, and assigns of the respective parties hereto.

LEGAL DESCRIPTION
PEDESTRIAN TRAIL EASEMENT DEDICATION
That portion of Lot 234 of City of Poway Tract No. 4191-3BR, Map No.
12082 filed in the office of the County Recorder of San Diego County on May
27, 1988, in the City of Poway, County of San Diego, State of California, more
particularly described as follows:
Commencing at the most Southwesterly corner of said Lot 234 of said City
of Poway Tract No. 4191-3BR, also being a point on the Easterly right-of-way
line of Arbolitos Drive and also being on the boundary of said Tract No. 4191-
3BR; thence Northeasterly along said Easterly right-of-way line North
21033'38" East 5.00 feet to the True Point of Beginning; thence continuing
along said right-of-way line North 21033'38" East, 15.00 feet; thence leaving
said right-of-way line South 68026'22" East, 95.00 feet to a point on the
sideline of that 5.00 foot wide pedestrian trail easement granted to the City
of Poway per Doc. No. 91-0281691, recorded June 12, 1991, Official Records;
thence along said sideline South 21033'38" West, 15.00 feet; thence continuing
along said sideline North 68026'22" West, 95.00 feet to the True Point of
Beginning.
