RELEASE OF IMPROVEMENT REQUIREMENTS
1. Pursuant to the Subdivision Map Act of the State of California and Division I of Title
8 of the San Diego County code, James W. Clark and Margaret G. Clark, did enter
into a Covenant of Improvement Requirements recorded September 28, 1981 as
Document No. 81-307633, and a Declaration of Covenants for street improvements
recorded September 14, 1981 as document No. 81-292847, all as required by
Section 66411.1 of the Government Code.
2. Said covenants consist of the following improvements:
A. Road Improvements
Glen Circle Road from Wild Holly Lane to the westerly boundary of the land
division shall be improved on the alignment of the irrevocable offer of
dedication (minimum radius 200 ft.) as shown on the Parcel Map 10449
with 20 ft. of 2 inch A.C. pavement over applied base and A.C. berm on
both sides and a 4 ft. graded walkway on both sides. All fill must be
compacted to 90%. Maximum grade 25%.
Dip sections and culverts shall be designed by a registered civil engineer to
handle a 15-year storm. Dip sections shall be designed for a maximum
water depth of 10 inches based on a 15-year storm and the formula "Depth
in feet X velocity in feet per second is equal to 6 or less." A sketch of the
dip section showing the above dimensions and the calculations shall be
submitted with the deposit noted below.
The entire dip area must have a concrete slab with a minimum width of 2 ft.
wider than the required grade but no wider than the required easement, 6
inches thick, 5-1/2 sacks of cement per cubic yard and 10 x 10 x #9 wire
mesh. Cutoff walls, 6 inches wide and 2 ft. deep, on both upstream and
downstream sides of the dip and along the entire length of the dip are
required. Cold mix may be used if the flow is less than 5 cfs and the
velocity is less than 2 fps, A.C. hot mix may be used if the flow is less than
20 cfs and the velocity is less than 5 fps.

A registered civil engineer shall prepare and submit a sketch of the private
easement road improvements to the Department of Public Works. The
sketch shall show the graded width required, all drainage improvements with
their approximate locations, signed calculations and a copy of a 200 scale
topo map with the drainage areas outlined.
A registered civil engineer or a licensed land surveyor shall provide a signed
statement that: "The private easement road from Parcel 1, 2, and 3 to the
nearest publicly maintained road is constructed within the easement."
A grading permit will be required prior to commencement of the grading.
A permit shall be obtained from the Department of Public Works for the
improvements to be made within the public right-of-way. A copy of the
permit and evidence from the issuing agency, that all the requirements of the
permit have been met, shall be submitted to the Department of Public Works
with the Engineer's or Surveyor's statement.
B. Fire Protection
A fire hydrant together with an adequate water supply shall be provided in
accordance with the specifications of the City of Poway Department of
Public Works and City Standards in the vicinity of the south side of Glen
Circle Road between Parcels 2 and 3.
Plans, when required, shall be prepared by a registered civil engineer for the
developer and approved by the Director, Department of Transportation. The above
improvements shall be made in accordance with all pertinent ordinances. Prior to
the issuing of a permit or other grant of approval, a grading permit, a construction
permit and lor a permit to install utilities within the private easement to be improved
may be issued before the completion of the above improvements.
C. Waiver of Protest
No protest shall be made by the owners to any proceedings for the
installation or acquisition of street improvements under any special
assessment proceedings, whether conducted pursuant to the Improvement
Act of 1911 or the Municipal Improvement Act of 1913, or any other
applicable state or local law, and whether processed by the City of Poway or
any other governmental entity having jurisdiction in the matter and for the
purposes of determining property owners support for same.
3. Improvements were constructed in accordance with the City of Poway Grading Plan
No.G426-88 and Improvement Plan 801-04-181 satisfying the "Road Improvement"
and "Waiver of Protest" requirements stated above. Adequate drainage facilities
and fire protection have been installed.
4. The City of Poway hereby releases the aforementioned covenants for Parcel 4 of
Parcel Map No.1 0449.
