RELEASE OF IMPROVEMENT REQUIREMENTS
1. Pursuant to the Subdivision Map Act of the State of California and Division I of Title
8 of the San Diego County code, Winton Investments, Inc. and Antonio Ulloa and
Eulalia Ulloa, did enter into a Covenant of Improvement Requirements recorded
August 21, 1980 as Document No. 80-254723 as required by Section 66411.1 of
the Government Code.
2. Said covenant consist of the following improvements:
A. Road Improvements
(1) The private easement road from Parcel 4 Westerly and Northerly and
from the land division to the nearest publicly maintained road shall be
constructed within the easement. It shall be a graded and well-
drained road with surfacing equal to or better than three inches of
decomposed qranite having a minimum S.E. of 25 and having a
minimum surfaced width equal to or greater than that determined by
cross-slope as set forth in the Grading Standards under Section
81.706(c) of the County Code. The surface shall be stabilized with a
bituminous treatment or approved equal on any roadway grades of
12% or greater and on any dip section. There shall be no roadway
grades exceeding 25%.
A registered civil engineer or a licensed land surveyor shall provide a
signed statement that: "The private easement road from Parcel 4
westerly and northerly and from the land division to the nearest
publicly maintained road is constructed within the easement."
(2) A registered civil engineer shall prepare and submit a sketch of the
private easement road improvements to the Department of
Transportation. The sketch shall show the graded width required and
all drainage improvements with their approximate locations and
calculations.

(3) A grading permit will be required prior to commencement of the
grading.
(4) A permit shall be obtained from the Department of Transportation for
the improvements to be made within the public right-of-way. A copy
of the permit and evidence from the issuing agency, that all the
requirements of the permit have been met, shall be submitted to the
Department of Transportation with the Engineer's or Surveyor's
statement.
Plans, when required, shall be prepared by a registered civil engineer for the
developer and approved by the Director, Department of Transportation. The
above improvements shall be made in accordance with all pertinent
ordinances. Prior to the issuing of a permit or other grant of approval, a
grading permit, a construction permit and lor a permit to install utilities
within the private easement to be improved may be issued before the
completion of the above improvements.
2. Improvements were constructed in accordance with City of Poway Grading
Plan No. G426-88 and Improvement Plan 801-04-181 satisfying the" Road
Improvements. requirements stated above. Adequate drainage facilities
have been installed.
3. The City of Poway hereby releases the aforementioned covenant for that
portion of Parcel 59 as shown on Record of Survey Map No. 3842, County
of San Diego, State of California, described in deed to Winton Investments,
Inc. recorded December 18, 1979 as File/Page No. 79-526664 and to
Antonio Ulloa and Eulalia Ulloa recorded December 4,1979 as File/Page No.
79-509313 of Official Records.
