GRANT OF EASEMENT
SLOPE
Virginia Lee Ludden (hereinafter "Grantor") hereby grants to CITY OF
POWAY (hereinafter "Grantee") its successors, or assigns, an easement for
slopes and drainage structures, over and across that certain real property in
the City of Poway, County of San Diego, State of California, described as
foll ows:
(See attached legal description and exhibit plat)
The Grantor hereby reserves for herself and her successors or assigns,
the right to eliminate such slopes and/or drainage structures or portions
thereof, when in the written opinion of the City Engineer of Grantee, the
necessity therefor is removed by substituting other protection, support and/or
drainage facility, provided such substitution is first approved in writing by
said Engineer.
The Grantor hereby further grants to Grantee all trees, growth (growing
or that may hereafter grow), and road building materials within said easement,
including the right to take water, together with the right to use the same in
such manner and at such locations as said Grantee may deem proper, needful or
necessary, in the construction, reconstruction, improvement, or maintenance of
said slope.
The Grantor, for herself, her successors and assigns, hereby waives any
claim for any and all damages to Grantor's remaining property contiguous to
the easement hereby conveyed by reason of the location, construction,
landscaping or maintenance of said slope.

LEGAL DESCRIPTION
That portion of the Southeast Quarter of the Northwest Quarter of Section 13,. Township
14 South, Range 2 West, San Bernardino Meridian, in the City of Po way, County of San
Diego, State of California according to U.S. Gov. Survey, conveyed to Kenneth A. Ludden
and Virginia Lee Ludden by deed recorded as Document No. 85-424020 of Official
Records in the Office of the County Recorder of said San Diego County and described as
the North 371 feet of the East 345 feet 6 inches of said Southeast Quarter, Excepting
therefrom the North 16 rods of the East 10 rods thereof, lying Northerly of the following
described line:
Beginning at a point on the Westerly line of said Ludden land, said point being the
intersection of said Westerly line with a line parallel with and 20.00 feet Southerly, as
measured at right angles, from the Northerly line of said Ludden land;
Thence South 88049'47"East along said parallel line a distance of 150.21 feet;
Thence South 51028'07" East a distance of 37.77 feet to the a point on the Easterly line
of said Ludden land, said point distant thereon 43.01 feet Southerly from the Northeast
corner of said Ludden land.
Attached hereto and made a part of this legal description is a plat designated Exhibit B.
