DECLARATION OF COVENANTS FOR IMPROVEMENTS

WHEREAS, Steven Morizono, a single man is the owner of real property described in Exhibit" A"
which is attached hereto and made a part hereof and which is commonly known as Assessor's
Parcel Number 321-111-17.
WHEREAS, in lieu of the immediate installation of improvements on the property described above,
it is the desire and intention of the owner to impose upon the property described above these
covenants for said future improvements for the benefit of the City of Poway, California.
NOW THEREFORE, the owner hereby declares that all the property described above is held and
shall be held, conveyed, hypothecated and encumbered, leased, rented, used, occupied, and
improved subject to the following covenants, which shall run with the land and shall be binding on
all parties having or acquiring any right, title or interest in the described land or any part thereof:
1 . The following improvements, as required by the notice of approval, must be
completed on a parcel-by-parcel basis prior to the issuance of a building permit for
the parcel or parcels created by this map:
A, FIRE PROTECTION:
(1 ) An approved water storage facility and fire department connection
shall be installed in accordance with the specifications of the City of
Poway Engineering and Safety Services Departments.
B. LANDSCAPING:
(1 ) A Master Plan of the existing onsite trees and natural rock
outcroppings shall be provided to the Planning Services Department
prior to building permit issuance.
2. The owner and all parties having or acquiring any right, title or interest in the above
described real property agree to refer to and incorporate by reference this Covenant
of Improvement Requirements in all instruments of conveyance of all or any portion
of said real property until a release of all covenants contained herein has been
properly executed and recorded.

A partial release shall be given by the City of Poway upon satisfactory completion of the
improvements required in Paragraph 1 hereof.
