BOX 789 POWAY, CA 92064 APN 321-111-17 RELEASE OF IMPROVEMENT REQUIREMENTS 1. Pursuant to the Subdivision Map Act of the State of California and Division I of Title 8 of the San Diego County Code, Theodore Fritzges, Linda Fritzges, James W. Fitzgerald, Slyvia Fitzgerald and James L. Twohig did enter into a Covenant of Improvement Requirements recorded January 6, 1982 as Document No. 82-003174 as required by Section 66411.1 of the Government Code. 2. Said covenant consist of the following improvements: A. ROAD IMPROVEMENTS (private) (1) The private easement road from Parcell to poway Road shall be constructed within the easement. It shall be graded and a well-drained road with surfacing equal to or better than three inches (3") of decomposed granite having a minimum S.E. of 25 and having a minimum surfaced width equal to or greater than that determined by cross-slope as set forth in the Grading Standards under Section 81.706 (c) of the County Code. All grades of 12% or greater (grades over 25% are not allowed) must have bituminous treatment. The surfacing shall consist of 3" of acceptable D.G. treated with a road oil mix, 2" of cold mix or 2" of hot mix bituminous material. All fill must be compacted to 90%. (2) Dip sections and culverts shall be designed by a registered civil engineer to handle a 15-year storm. Dip sections shall be designed for a maximum water depth of 10" based on a 15-year storm and the formula "Depth in feet X velocity in feet per second is equal to 6 or less." A sketch of the dip section showing the above dimensions and the calculations shall be submitted with the deposit noted below. (3) The entire dip area must have a concrete slab with a minimum width of 2 feet wider than the required graded o I 1028 width but no wider than the required easement, 6" thick, 5-1/2 sacks of cement per cubic yard and 10 X 10 X #9 wire mesh. Cutoff walls, 6" wide and 2' deep, on both upstream and downstream sides of the dip and along the entire length of the dip are required. Cold mix may be used if the flow is less than 5 cfs. and the velocity is less than 2 fps., A.C. hot mix may be used if the flow is less than 20 cfs. and the velocity is less than 5 fps. (4) A registered civil engineer shall prepare and submit a sketch of the private easement road improvements to the Department of Public Works. The sketch shall show the graded width required, all drainage improvement with their approximate locations, signed calculations and a copy of a 200 scale topo map with the drainage areas outlined. (5) A deposit of $300.00, two prints of the Tentative Parcel Map and a copy of the Final Notice of Approval will be forwarded to the county Department of Public Works along with above sketch and any drainage calculations. The deposit is to cover the cost of a County inspection of the required private easement road improvements. The applicant shall reimburse the county Department for any costs in excess of the deposit prior to recording of the Parcel Map or prior to the recording of the Notice of Completion. Any unused portion of the deposit will be refunded. (6) A registered civil engineer or a licensed land surveyor shall provided a signed statement that: "The private easement road from Parcel 1 to poway Road is constructed within the easement" (7) A grading permit will be required prior to commencement of the grading if the grading meets the criteria of Section 87.201 of the County Code. The above sketch and $300.00 deposit will not be required if a grading permit is obtained. (8) A permit shall be obtained from the Department of Public Works for the improvements to be made within the public right-of-way. The connection of the private easement road to the County road will have to match the construction of the County road. A copy of the permit and evidence from the issuing agency, that all the requirements of the permit have been met, shall be submitted to the Department of Public Works with the Engineer's or Surveyor's statement. The following improvements, as required by the notice of approval, must be completed on a parcel-by-parcel basis prior to the issuance of a building permit for the parcel or 1029 parcels created by this map: FIRE PROTECTION An approved water storage facility and fire department connection shall be installed in accordance with the specifications of the poway Department of Public Works and County standards on each parcel. Plans, when required, shall be prepared by a registered civil engineer for the developer and approved by the Director, Department of Public Works. The above improvements shall be made in accordance with all pertinent ordinances. Prior to the issuing of a permit or the grant of approval, a grading permit, a construction permit, and/or a permit to install utilities within the private easement to be improved may be issued before the completion of the above improvements. 3. The road improvements have been accomplished with the completion of City of poway grading plan no. G615-89. 4. The property owner will be required to enter a covenant of improvement requirements to cover the fire protection requirements. 5. The City of poway hereby release the Covenant for Parcell through 4 of Parcel Map No. 13385, in the City of poway, County of San Diego, State of California filed in the office of the County Recorder of San Diego County, July 24, 1984 as File No. 84-278955 of Official Records.
