BOX 789 POWAY, CA 92064 RELEASE OF IMPROVEMENT REQUIREMENTS ~J ~ 1. Pursuant to the sUbdivision Map Act of the state of California and Division I of Title 8 of the San Diego County Code, Kiyoto saisho, did enter into a Covenant of Improvement Requirements recorded May 16, 1984 as Document No. 84-181928 as required by section 66411.1 of the Government Code. 2. Said covenant consist of the following improvements: A. (1) Natural rock outcropping, eucalyptus trees and significant vegetation shall be preserved. (2) Solid board fencing is permitted around the perimeter of the building envelope and usable side areas. Open rail fencing or equivalent which provides for the unrestricted crossing of wildlife shall be installed in all other locations. B. Streets and Sidewalks (1) The proposed private road easement adjoining the parcels and the easement connecting to poway Road shall be improved to City Rural Street Standards, with AC pavement and graded shoulders. The exact width and alignment of the improvement shall be as approved by the City Engineer. (2) The intersection of the private road easement with poway Road shall be improved by grading, paving, and other improvements as required by the city Engineer, in order to improve sight distance and ingress and egress to and from poway Road. 1022 (3) The terminus of the 40 ft. private road easement between the adjoining properties shall be a 30 ft. curbline radius cul-de-sac, to the satisfaction of the Directors of planning, Public, an Safety Services. (4) street improvement plans prepared on standard size sheets by a Registered Civil Engineer shall be submitted for approval by the Director of Public Services. Standard plan check and inspection fees shall be paid by the developer. (5) All street structural sections shall be submitted to and approved by the Director of Public Services. (6) Street striping and signing shall be installed to the satisfaction of the Director of Public Services. C. Landscaping (1) A Master Plan of the existing onsite trees shall be provided to the Planning Services Department prior to the issuance of building permits and prior to grading to determine which trees shall be retained. D. General Requirements (1) Grading of the subject property shall be in accordance with the city Grading Codes, and accepted grading practices. (2) Water, fire protection and sewer facilities shall be designed and constructed to meet requirements of the city of poway and the Health Department of the County of San diego, prior to issuance of a building permit on any parcel. (3) Prior to the issuance of building permit, the developer shall pay the Bridge and Major Thoroughfare Construction fee and any Traffic Signal fee at the established rate in effect at the time building permits are issued. E. Drainage and Flood Control (1) The applicant will be responsible for construction of all onsite drainage facilities required by the Director of Public services. 1023 (2) The Master Plan of Drainage Fee shall be paid at the established rate in accordance with the Drainage Ordinance. 3. Mina De Oro Road and Eucalyptus Hts. Road, the access roads serving the subject parcel, have been improved to city of Poway rural road standards. Improvements were constructed in accordance with City of poway Grading Plan No. G615-89 satisfying the "streets and Sidewalks" improvement requirements stated above. Adequate drainage facilities have been installed. 4. The property owner will be required to enter into a Covenant of Improvement Requirements to cover the Planning services requirements. This requirement is to provide a Master Plan of the existing onsite trees and natural rock outcroppings. 5. The remaining requirements are general or informative in nature. They are categorically enforced by the current City of poway development review administrative process. 6.
