Resolution No. 92-094
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ACCEPTING THE DEDICATION FOR
STREET PURPOSES OF CERTAIN ONE-FOOT WIDE STRIPS
OF LAND IN PORTIONS OF LOT 86, COUNTY OF SAN DIEGO
TRACT 3842-3, MAP NO. 9771 AND LOT 2, CITY OF POWAY
TRACT 81-01, UNIT NO.2, MAP NO. 11844
WHEREAS, on the final maps of County of San Diego Tract 3842-3, Map No.
9771 and City of Poway Tract 81-01, Unit No.2, Map No. 11844, therein were
offered for dedication for public street purposes certain one-foot wide strips
of land at Vista Lomas Drive (formerly Via Puerto del Norte), being portions
of Lot 86, Map No. 9771 and Lot 2, Map No. 11844; and
WHEREAS, on said Map No. 9771 and Map No. 11844, the Board of
Supervisors of the County of San Diego and the City Council of the City of
Poway, respectively, rejected the offer of dedication of said one-foot wide
strips of land as hereinafter more particularly described; and
WHEREAS, the State of California Government Code (Subdivision Map Act)
Section 66477.2(a) provides that a rejected offer of dedication shall remain
open and may be accepted by resolution by the legislative body at any later
date; and
WHEREAS, upon the City's incorporation on December 1, 1980, the City of
Poway became the successor in interest to the County of San Diego for the
offer of dedication on said Map No. 9771; and
WHEREAS, on July 14, 1988, the final map of City of Poway Tract 88-01,
Map No. 12123, the subdivision located immediately adjacent to the north of
said Map No. 9771 and Map No. 11844, was recorded; and
WHEREAS, immediately thereafter the recordation of Map No. 12123, Vista
Lomas Drive street improvements were extended northerly into said subdivision;
and
WHEREAS, to provide through vehicular access in and to said subdivision,
it is in the best public interest of the City of Poway that said one-foot wide
strips of land be now accepted for public street purposes.
NOW, THEREFORE, 8E IT RESOLVED by the City Council of the City of Poway
as follows:
1. The City of Poway hereby rescinds the rejection of said one-foot
wide strips of land, and does hereby accept for public street
purposes those portions of Lot 86, County of San Diego Tract 3842-
3, Map No. 9771 and Lot 2, City of Poway Tract 81-01, Map No. 11844
designated respectively on the final maps as "Portion of Lot 86
Reserved for Future Street" and "Portion of Lot 2 Reserved for
Future Street."

2. The City Clerk of the City of Poway is authorized and directed to
cause a certified copy of this resolution to be recorded in the
Office of the Recorder of San Diego County.
PASSES, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 16th day of une, 1992.
