Ordinance No, 356
AN ORDINANCE OF THE CITY OF POWAY VACATING
THE OPEN SPACE EASEMENT IN LOTS 5, 6, AND 7 OF
CITY OF POWAY TRACT NO. 4278, MAP NO. 11326
(Vacation 92-01)
WHEREAS, the City Council of the City of Poway desires to vacate an open
space easement; and
WHEREAS, said easement is a portion of the open space easement dedicated
to the City of Poway through the filing and recordation of said Map No. 11326
on September 13, 1985 as File No. 85-336840 of Official Records of San Diego
County; and
WHEREAS, in 1990, the open space easement was graded so that the purpose
to maintain its natural condition was violated; and
WHEREAS, to mitigate the destruction of said open space easements, a
replacement-like easement of equal area and quality in an adjacent property
will be dedicated to the City of Poway; and
WHEREAS, the vacation, exchange, or transfer of the open space easements
complies with Section 16.16.110(A)(2).
NOW, THEREFORE, the City Council of the City of Poway does hereby ordain
as follows:
Section 1, Vacation of Easement, The open space easement in Lots 5, 6,
and 7 of City of Poway Tract No, 4278, Map No. 11326 is hereby vacated.
EFFECTIVE DATE: This ordinance shall take effect and be in force thirty
(30) days after the date of its passage; and before the expiration of fifteen
(15) days after its passage, it shall be published once with the names and
members voting for and against the same in the Powav News Chieftain, a
newspaper of general circulation published in the City of Poway,
Introduced and first read at a regular meeting of the City Council of
the City of Poway held the 24th day of March, 1992, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 19th day of May,
1992, by the following roll call vote:
AYES: EMERY, HIGGINSON, MCINTYRE, SNESKO, GOLDSMITH
