PUBLIC ORAL CQMNUHICATIOH$ Deputy Mayor Goldsmith explained the procedure for Public Oral Communications. David Rinaldo, 13035 Corona Way, requested the City Council write in opposition to AB 3763 which would deny cities the right to use eminent domain to acquire mobilehome parks. 3727 Page 2 - CITY OF POWAY - April 10, 1990 CONSENT CALENDAR Deputy Mayor Goldsmith stated that Items 13 and 14 have been pulled by the public, and staff is requesting that Item 16 be removed from the calendar. Motion by Councilmember Kruse, seconded by Councilmember Emery, to adopt the Consent Calendar as follows: e Approval of Minutes - City Council: March 8, 1990, Adjourned Regular Meeting March 13, 1990, Regular Meeting March 20, 1990, Regular Meeting March 24, 1990, Adjourned Regular Meeting 9. Ratification of Warrant Register - March 22, 1990 10. Denial of claim for damages: Jeffrey Carle 11. Acceptance of the Performing Arts Center parking lot landscaping from Douglas E. Barnhart. (1513} 12. Receive and file report regarding the effectiveness of advisory signs installed on McFeron Road east and west of Tobiasson Road {referred from March 14, 1989, Item 7). 15. Receive and file report for pending legislation: 1) oppose SB 2565 which would establish a pilot program restricting the Transient Occupancy Tax to the Marina del Rey area of Los Angeles County; 2} support AB 264 which authorizes the Department of Motor Vehicles to issue to a firefighter, including a volunteer, a license restricted to the operation of firefighting equipment; and 3} support AB 2666 and SB 1830, authorizing a fire district to adopt building standards relating to fire or panic safety that are more stringent than those standards adopted by the State Fire Marshal. 17. Acceptance of the 1988-89 Street Maintenance/Rehabilitation Program from Asphalt, Inc. Motion carried 4-0 with Mayor Higginson absent. ITEM 4 ORDINANCE NO. 316 - FIRST READING SPEED LIMIT ON LAKE POWAY ROAD Deputy Mayor Goldsmith opened the public hearing. Staff report by Assistant City Manager Fitch. Staff conducted a traffic survey on Lake Poway Road west of Espola to establish a speed limit. The Traffic Safety Committee has reviewed the data and recommends a speed limit of 35 mph. Because of existing vertical grades and horizontal curves, a limit lower than the 85th percentile of 45 mph is justified. Staff recommends the City Council hold first reading on this Ordinance. 3728 Page 3 - CITY OF POWAY - April 10, 1990 Speaking in opposition to staff recommendation: Jim Keeley, 15815 Riparian Road Peter Wittenberg, 13874 Lake Poway Road Robert Yates, 13927 Lake Poway Road Michael Rubin, 13914 Lake Poway Road Thomas Zech, 13847 Lake Poway Road Speakers expressed concern for children crossing Lake Poway Road to get to bus stops because of excessive speed of traffic; lack of sidewalks; lack of trail crossing signs; need for additional bike lanes; and requested the speed be set at 25 mph. Following Council discussion, motion by Councilmember Emery, seconded by Councilmember Kruse to holding first reading of Ordinance No. 316, entitled, "An Ordinance of the City of Poway Adding Section 10.32.230{C) to the Poway Municipal Code Estblishing a Speed Limit for Lake Poway Road from Prairie Vista Road to the cul-de-sac at the Western Terminus of Lake Poway Road," as amended to add findings and set the limit for 25 mph, and set second reading for April 24, 199D. Motion carried 4-0 with Mayor Higginson absent. ITEM 5 RECREATIONAL FACILITIES FOR DEVELOPMENTALLY DISABLED Staff report by Assistant City Manager Fitch. Council heard a request from the public on March 13, 1990 for space for Starmakers, a theatrical group for the developmentally disabled, to practice in Poway, in addition to a request for funding. Staff has responded with a listing of spaces available, and will assist them in pursuing state or federal funding. Speaking in favor of staff recommendation: Claudia Leonesio-Mons, 2504-C Wanek Road, Escondido, representing the Association for Retarded Citizens Diana Augustine, 14210 Midland Road The speakers cited what other North County cities are doing to provide recreational opportunities for the developmentally disabled population and suggested Poway should be more active in this area. Following discussion, Council requested staff prepare a report on what the North County cities are doing in terms of funding, programming, etc. and suggested the Poway Unified School District should be approached to help provide facilities. ITEM § REIMBURSEMENT TO CF POWAY Assistant City Manager Fitch stated this requested it be removed from the calendar. item is not ready to be heard and Council concurred. 3729 Page 4 - CITY OF POWAY - April 10, 1990 ITEMS 13 AND 14 APPROVAL OF FINAL MAP TTM 87-07 APPROVAL OF FINAL MAP TTM 87-08 Deputy Mayor Goldsmith stated these items had been pulled by the public. Staff report by Assistant City Manager Fitch. These items are final maps. TTM 87-07 is an eight-lot subdivision on the south side of Garden Road, one block east of Claire Drive. Staff recommends approval and adoption of a Resolution annexing to Landscape Maintenance District 86-2. TTM 87-D8 is a nine-lot subdivision east of Tierra Bonita Road and north of Twin Peaks Road. Staff recommends approval and adoption of a Resolution annexing to Landscape Maintenance District 86-1. Speaking in opposition to staff recommendation: Jim Keeley, 15815 Riparian Road, requested the staff report show the fiscal impact on the LMD assessments. Motion by Councilmember Emery, seconded by Councilmember Kruse to approve the final map for Tentative Tract Map No. 87-07 and direct its recordation; accept on behalf of the public, subject to improvement, Garden Lane and that portion of Garden Road as shown and dedicated on the map; accept on behalf of the public, the access rights from Lots 1 and 8 in and to Garden Road as shown and designated on the map; adopt Resolution No. 90-080, entitled "A Resolution of the City Council of the City of Poway, State of California, ordering the Expansion of Poway Landscape Maintenance Assessment District No. 86-2 with Written Consent of all Property Owners." Motion carried 4-D with Mayor Higginson absent. Motion by Councilmember Emery, seconded by Councilmember Kruse, to approve the final map for Tentative Tract Map No. 87-08 and direct its recordation; accept on behalf of the public, subject to improvement, Tierra Bonita Court, as shown and designated on the map; accept on behalf of the public, the abutters rights of access appurtenant to Lot i in and to Tierra Bonita Road as shown and designated on the map; adopt Resolution No. 90-081, entitled, "A Resolution of the City Council of the City of Poway, State of California, Ordering the Expansion of Poway Landscape Maintenance Assessment District No. 86-01 with Written Consent of all Property Owners." Motion carried 4-0 with Mayor Higginson absent. ITEM 18 CITY MANAGER ITEMS A. Assistant City Manager Fitch announced that City Manager Bowersox had his reconstructive surgery yesterday and is recovering at home. B. Assistant City Manager Fitch announced that Mark Sanchez has been named Director of Safety Services. 373O Page 5 - CITY OF POWAY - April 10, 1990 ITEM 19 CITY ATTORNEY ITEM City Attorney Eckis gave a status report on the negotiations for Poway Royal Mobilehome Park and stated the owner refuses to talk about a voluntary acquisi- tion. He has received the updated appraisal and is ready to talk to the City Council in closed session regarding commencing eminent domain proceedings. In light of the public interest in this issue, Council concurred to hold a closed session at the beginning of the April 17, 1990 City Council meeting. Speaking in favor of the acquisition of Poway Royal: Allen Kozakiewicz, 13118 Alpine Drive David Rinaldo, 13035 Corona Way Andrew Nowicki, 13227 Dana Vista CITY COUNCIL INITIATED ITEMS 20. Councilmember Brannon stated that a result of her attendance at the League's Transportation Policy Committee meeting was her perception that the League does not represent cities well in dealing with legislation regarding regional issues. More layers of government are not needed, rather ways for the state, cities and counties to work together. She suggested, and Council concurred, that we work with the San Diego Division of the League on this issue. 22. Deputy Mayor Goldsmith presented a policy proposed by him and Councilmember Brannon regarding making the SANDAG representation more effective. It requires staff input on the agenda and better coordination between the representative and alternate. Motion by Councilmember Emery, seconded by Councilmember Kruse to adopt the policy as presented. Motion carried 4-0 with Mayor Higginson absent.
