FOR CITY STREET
DAVID J. CARPOlfICII AND RITA CARPOWl:C11 (hereinatter -Grantor-) hereby grants
to CITY OF POWAY (hereinafter -Grantee-) its succe..ors, or assigns, the
right-of-way and incidents thereto tor a public strset upon, over and
across that certain real property in the City ot Pavay, County ot San
Diego, State ot ca1itornia, described as to1lavs:

The Grantor hereby grants to the city ot pavay the privilege and right to
extend drainage structures and excavation and eabank>>ent slopes beyond the
limits ot the herein described right-of-way where required tor the
construction and maintenance ot said City street. Reserving unto Grantor
ot ths abovs described parcel ot land, his successors or assigns, the right
to eliminate such slopes and/or drainage structures or portions thereot,
when in the written opinion ot the city Engineer ot Grantee, the necessity
theretor is removed by substituting other protection, support and/or
drainage tacility, provided such substitution is tirst approved in writing
by said Engineer.
The Grantor hereby turther grants to Grantee all trees, growth (growing or
that may hereatter grow), and road building materials within said right-ot-
way, inclUding the right to take water, together with the right to use the
same in such aanner and at such locations as said Grantee may deem proper,
needful or necessary, in the construction, reconstruction, improvement or
maintenance of said highway.
The Grantor, tor him/herselt, his/her successors and assigns, hereby
any clai. tor any and all damages to Grantor's remaining property
contiguous to the right-ot-way conveyed by reason ot the location,
construction, landscaping or maintenance ot said highway.
