The Grantor hereby qrant. to the City of poway the privilege and right to
extend drainage 8tructure. and excavation and embankment 810pe8 beyond the
liait8 of the herein de.cribed right-of-way where required for the
con8truction and maintenance of 8aid city 8treet. Re8erving unto Grantor
of the above de8cribed parcel of land, hi8 8ucceS80r8 or a88iqn8, the right
to eli.tnate such slopes and/or drainage structures or portions thereof,
when in the written opinion of the City Engineer o~ Grantee, the necessity
therefor is reaoved by .ubstituting other protection. 8upport and/or
drainage facility, provided 8uch sub8titution is fir8t approved in writing
by 8aid Engineer.
The Grantor hereby further grants to Grantee all trees, growth (growing or
that may hereafter grow), and road building aateria18 within 8aid right-of-
way, including the right to take water, together with the right to U8e the
same in such .anner and at such locations as said Grantee may deea proper,
needful or necessary, in the construction, reconstruction, improve.ant or
maintenance o~ said highway.
The Grantor, for hia/her8elf, hi8/her 8uccessor8 and a8signs, hereby waive8
any claia for any and all d...ge8 to Grantor's remaining property
contiguous to the ri9ht-o~-way conveyed by reason of the location,
construction, landscaping or ~intenance of said highway.
