extend drainage structures and excavation and e.bankaent slopes beyond the
limite ot the herein deecribed right-ot-way where required tor the
conetruction and maintenance ot eaid City etreet. Reserving unto Grantor
ot the above described parcel ot land, his succeseors or aseigns, the right
to eliminate such slopes and/or drainage structures or portions thereot,
when in the written opinion ot the City Engineer ot Grantee. the neceseity
theretor is reaoved by substituting other protection, support and/or
drainage tacility. provided such substitution i. tiret approved in writing
by said Engineer.
The Grantor hereby turther grants to Grantee all trees, growth (growing or
that may hereatter grow), and road building ..terials within eaid right-ot-
way, including the right to take water. together with the right to use the
same in such ~nner and at such locations as said Grantee may deem proper,
needful or necessary, in the construction, reconstruction, improvement or
maintenance ot said highway.
The Grantor, for him/herselt, his/her successors and assigns, hereby waives
any claim tor any and all damages to Grantor'. remaining property
contiguoue to the right-ot-way conveyed by reason ot the location,
construction, landscaping or maintenance of said highway a
