extend drainage .tructure. and excavation and eabankaant slopea beyond the
liaits ot the herein deacribed right-ot-way where required tor the
construction and aaintenance ot aaid City atreet. Reserving unto Grantor
at the above described parcel ot land, hi. successora or assigns, the riqht
to eli.inate such slope. and/or drainage structures or portions thereot,
when in the written opinion ot the city Engineer ot Grantee, the nece.sity
there tor i. reaoved by .~tituting other protection, .upport and/or
drainage tacility, provided .uch .~titution is tirst appr~ed in writing
by said Engineer.
The Grantor hereby turther grant. to Grantee all trees, growth (growing or
that ..y hereatter grow), and road building ..terial. within .aid right-ot-
way, including the right to take water, together >lith the right to use the
saae in such manner and at such locations as said Grante. aay deem proper,
needtul or necessary, in the construction, reconstruction, i.prove.ent or
maintenance of said highway.
The Grantor, tor hia/herselt, hiS/her successors and assigns, hereby waives
any claia tor any and all daaeges to Grantor's remaining property
contiguous to the riqht-ot-vay conveyed by reason ot the location,
construction, landscaping or aaintenance of said hiqhway.
