Tbe Grantor bereby grants to the City of Povay the privileqe and rigbt to
extend drainaqe structures and excavation and _~nt slopes beyond the
liaits ot the herein deecribed right-ot_ay where required tor the
construction and ..intenance ot said City street. Reservinq unto Grantor
ot the above des~ribed parcel of land, bis lIUCC8ssors or assigns, the riqbt
to eliainate such slopes and/or drainaqe structures or portions thereot,
when in the written opinion ot the City Enqineer of Grantee, the necassity
therefor is reaoved by IlUbstitutinq other protection, support and/or
drainage facility, provided such substitution is first approved in writing
by said Enqineer.
The Grantor hereby further grants to Grantee all trees, growth (growing or
tbet ..y bereatter grow), and road buildinq ..terials within said right-ot-
way, includinq the right to take vster, toqether with the riqbt to use the
s... in such ..nner and at such locations as said Grantee aay deem proper,
needful or necessary, in the construction, reconstruction, improvement or

The Grantor, tor his/berself, bis/ber successors and assigns, b~reby waives
any claia tor any and all daaages to Grantor's reaaininq property
contiquous to the rigbt-ot-way conveyed by reason of tbe location,
