extend drainage structures and excavation and _~nt slopes beyond the
lisits of the herein deecribed riqbt-ot-vay where required for the
construction and _intenance of said City street. Reservinq unto Grantor ...
ot tbe above deecribed parcel of land, his successors or assigns, the riqbt j<;..
to eliminate such slopes and/or drainage structurea or portions thereof,
wben in the written opinion ot the City Enqineer ot Grantee, the necessity
therefor is reaoved by substitutinq other protection, support and/or ..
drainaqe facility, provided such substitution is first approved in writinq f!

The Grantor hereby further grants to Grantee all trees, growth (growinq or
that may hereafter grow), and road buildinq aaterials within said riqht-of-
way, includinq the right to take water, toqether with the right to use the
same in such sanner and at such locations as said Grantee may deem proper,
needtul or necessary, in the construction, reconstruction, illprovement or
maintenance of said biqhway.
The Grantor, tor bia/herselt, his/ber successors and assiqns, hereby waives
any clai. for any and all da..ges to Grantor's reaaininq property
contiguous to the right-of-way conveyed by reason ot the location,
construction, landscapinq or maintenance of said highway.
