extend drainage structures and excavation and embankment slopes beyond the
liaits of the berein deseribed right-of-way wbere required tor tbe
construction and saintenance ot said City street. Reservinq unto Grantor
of the above described parcel or land, biB successors or assigna, the right
to elisinats such slopes and/or drainage structures or portions thereot,
wben in the written opinion of the City Engineer of Grantee, the necessity
there tor is reaoved by substitutinq other protection. support and/or
drainaqe tacility, provided such substitution is first approved in writinq
by said Enqineer.
The Grantor bereby further grants to Grantee all trees, growth (qrowinq or
tbat say hereatter grow), and road buildinq materials within said rigbt-of-
way, includinq the rigbt to take water, toqether witb the rigbt to use tbe
same in such manner and at such locations as said Grantee may deem proper,
needtul or necessary, in the construction, reconstruction, improvement or
maintenance ot said bigbway.
The Grantor, tor bim/berselt, bis/ber successors and assigns, bereby waives
any claim for any and all damages to Grantor's remaining property
contiguous to tbe rigbt-ot-way conveyed by reason ot tbe location,
construction, landscaping or maintenance ot said bigbway.
