Approval of Minutes - City Council: April 3, 1990, Regular Meeting April 5, 1990, Adjourned Regular Meeting April 10, 1990, Regular Meeting 14. Ratification of Warrant Register - April 12, 1990. 15. Authorization to purchase bicycle racks for City parks from Transportation Development Act {TDA} funds in the amount of $2,500.00. 16. Approval of final map and directing its recordation for Tentative Tract Map 87-10, Country Road Condos, Ray Huffman Construction, Company, Inc., appli- cant; located west of Midland Road between Apache Road and Scots Way. 17. Approval of final map for Tentative Parcel Map 89-07 {Oak Knoll), and directing its recordation, AK Properties III, Limited Partnership, appli- cant; located on the north side of Oak Knoll Road between Poway Road and Pomerado Road. 18. Approval of application for temporary water and sewer connection, Tim J. Connole applicant; located at 14567 Pebble Canyon Road. {This item was reconsidered later in the meeting.} 19. Adoption of Resolution No. P-90-29 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Minor Development Review 89-188, Assessor's Parcel Number 321-230-22," Tim Connole, applicant: a request to construct a two-story 2,299 square foot single-family dwelling approximately 380 feet east of the intersection of Twin Peaks Place and Pebble Canyon Drive in the Hillside/Ridgeline area. (This item was recon- sidered later in the meeting.) 20. Acceptance of resolution of claim on 1988-89 Street Maintenance Contract by Asphalt Inc. 21. Appropriation of funds in the amount of $750 for membership in Southern California Water Committee, Inc. 22. Adoption of Resolution No. 9D-085 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Applications for Grant Funds Under Proposition 70 (1988 Bond Act} and Proposition 99 for New Tot-Lot Playground Equipment at Poway Community Park;" and appropriation of $8,849 from unappropriated reserve fund balance for matching funds. Motion carried unanimously. 3750 Page 3 - CITY OF POWAY - May 1, 1990 ITEM 5 TENTATIVE PARCEL MAP 89-02 AMENDMENT APPLICANT: JAY & SANDY GELB Mayor Higglnson stated that this item was continued from April 3, 1990 in response to questions raised by the Council regarding requirements for undergrounding of utilities. City Manager Bowersox stated that the subject of undergrounding utilities will be discussed at a Council workshop session to be held May 1D, 1990. Staff recommends continuing this item to May 22, 1990 to consider this request following the workshop. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Kruse to continue this item to May 22, 1990. Motion carried unanimously. ITEM 6 TENTATIVE PARCEL MAP 16321 AMENDMENT OWNERS: FRANK & HELEN THORNBURG APPLICANT: H.L. LAND DEVELOPMENT Councilmember Emery stated he was disqualifying himself from this item as he resides within 1,000 feet of the property. Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request to relocate a private road access to a four lot parcel map previously approved by the County in March, 1980. The property is located at the southest corner of Twin Peaks Place and Pebble Canyon Drive. The final map contained a roadway dedication along the northern boundary of the site. A substantial amount of grading would be required if the present align- ment were utilized. The applicant proposes to relocate the road alignment along the southern property line, which is located near five existing homes along Twin Peaks Road, and to provide a block wall, additional fencing and easements to the adjacent properties. Staff recommends approval with revisions to require installation of a fire hydrant, driveway fire apparatus turnarounds, and a road construction and maintenance agreement. Speaking in favor of staff recommendation: Herald Lantis, 1525 S. Escondido Boulevard, Escondido Speaking in opposition to staff recoi~endation: Anita Shoop, 14556 Twin Peaks Road, property owner to the east, spoke regarding private road access and easements for the area, and requested a continuance to study the issue. In response to Council inquiry, City Manager Bowersox stated that the lots at the east end of Twin Peaks Road were laid out many years ago irrespective of topography and many are considered unbuildable. He stated that the Redevelopment Agency's budget for 1991-92 fiscal year will include funds for a study of access, water, and drainage issues for this area. 3751 Page 4 - CITY OF POWAY - May 1, lggO Motion by Councilmember Goldsmith, seconded by Councilmember Kruse to continue this item to May 8, 1990. Motion carried 4-0, with Councilmember Emery abstaining. ITEM 7 REPORT RE: LANDSCAPE MAINTENANCE DISTRICTS Staff report by City Manager Bowersox. At the April 3, 1990 Council meeting, Mr. Bill Barnick expressed concerns regarding the assessment calculations for Landscape Maintenance Districts. Staff has prepared a response to this request and recommends that Council receive and file the report. Speaking in opposition to staff recommendation: Bill Barnick, 14645 Sunrise Canyon Road Council concurred to receive and file report. ITEM 8 RESERVATION OF SEWER CAPACITY FOR TENTATIVE PARCEL MAP 89-19 APPLICANT: URBAN ECONOMIC ASSOCIATES, INC. Staff report by City Manager Bowersox. On February 27, 1990 the City Council heard an appeal of a staff decision regarding the issuance of a statement of sewer availability for a tentative parcel map proposing a lot split for Lot 5 of Tentative Tract Map 84-10, located at the easternend of Monte Vista Road, east of Pomerado Hospital. At that hearing, Council determined that the applicant's proposal to develop a single family house as a residential care facility warranted issuance of capacity from the Reserve Category in accordance with the Sewer Allocation Plan adopted November 14, 1989, by Ordinance No. 304. Prior to approval of the Tentative Parcel Map and issuance of a Letter of Availability from the Reserve Category, it will be necessary for staff to bring back an amendment of Ordinance No. 304. Staff recommends that the City Council find that the project meets the standards established and issue a statement of sewer availability from the Reserve Category for one EDU. Motion by Counctlmember Kruse, seconded by Councilmember Brannon, to adopt Resolution No. 90-086 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Issuance of a Statement of Sewer Availability from the Reserve Projects Category as Described in Ordinance No. 304 for Lot 5 of TTM 84-10 for a Residential Care Facility {TPM 89-19)." Motion carried una- nimously. ITEM g RESERVATION OF SEWER CAPACITY FOR TENTATIVE TRACT MAP 88-04R ROLLING HILLS ESTATES APPLICANT: McMILLIN EQUITY PARTNERS II Staff report by City Manager Bowersox. This item is in accordance with the Sewer Allocation Plan adopted on November 14, 1989, by Ordinance No. 304. 3752 Page 5 - CITY OF POWAY - May 1, 1990 McMillin Equity Partners II is proposing 120 single family homes and one commer- cial lot on 136 acres in the South Poway Planned Community located on the west side of Pomerado Road at its intersection with Creek Road, and south of South Poway Parkway. On September 6, 1988, the Council approved a 105 lot Tentative Tract Map for the site, along with reserving 105 units of sewer availability. The sewer availability was amended in September 1989 to allow for 34 units of sewer capacity for the commercial lot. The applicants are requesting an addi- tional 15 units for the project, and also that the Council determine that the project qualifies under five of the eight standards established for the issuance of sewer capacity from the Redevelopment Category. The five categories of public benefit have been identified as: 1) Category B, development within the South Poway Planned Con))~unity; 2) Category C, elimination of traffic circulation and flood control deficiencies; 3) Category D, mitigation or elimination of con- ditions of economic deficiencies where tax receipts are inadequate for the costs of public services rendered; 4) Category E, provision of public improvements and facilities which address deficiencies affecting other developed properties within the project area; and 5) Category H, assistance to the Agency in meeting the goals of the adopted Redevelopment Plan. Staff recommends the City Council find that the project meets the standards established, and issue a statement of sewer availability for the 15 additional units. In response to Council inquiry, City Manager Bowersox stated that construction of South Poway Parkway from Pomerado Road to western City limits is a condition of approval for the Tentative Tract Map, and that the Redevelopment Agency will be considering an Owner Participation Agreement to provide assistance in funding the construction. Motion by Councilmember Goldsmith, seconded by Councilmember Kruse, to adopt Resolution No. 90-087 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Issuance of a Statement of Sewer Availability from the Redevelopment Projects Category as Described in Ordinance No. 304 for the Proposed Rolling Hills Estates Project {SP 84-01D, TTM 88-04R)." Motion carried 4-1, with Councilmember Emery voting "no." ITEM 10 SAN DIEGO COUNTY WATER AUTHORITY PROPOSED CAPACITY CHARGE Introduction by City Manager Bowersox. Staff report by Director of Public Services Archibald. As part of the funding plan for the San Diego County Water Authority's Capital Improvement Program for aqueduct improvements and expansion costs, the Water Authority is recommending implementation of a capacity charge to go into effect July 1, 1990. The majority of the improvement program costs are due to anticipated growth within San Diego County. If all of the costs associated with growth were passed on to the developer, the fee could be as high as $2,000 per Equivalent Dwelling Unit {EDU). If the capacity charge is not set at $900 per EDU, water rates would have to be increased over the next 20 years with water customers paying a disproportionate share of expansion. Staff recom- mends that the City Council give direction to Poway's Water Authority Board member for the May 10, 1990 Board meeting. 3753 Page 6 - CITY OF POWAY - May 1, 1990 Following discussion, motion by Councilmember Emery, seconded by Councilmember Goldsmith, to give direction to the City's San Diego County Water Authority representative that the philosophy of the City is growth should pay for itself; and to support a fee as high as feasible which would be likely to be adopted by the entire Board. Motion carried unanimously. ITEM 11 STAGE II WATER ALERT Staff report by City Manager Bowersox. On April 12, 1990, the San Diego County Water Authority called a Stage II Water Alert and is asking each member agency to also declare a Stage II Water Alert and consider implementing a water conser- vation rate structure. The City's Water Conservation Plan calls for Stage I measures to be voluntary, and Stage II measures mandatory. Water use rules under Stage II prohibit the issuance of new construction meters, and washing cars at car washes that do not recycle their water. The plan also makes Stage II violations a misdemeanor. Staff recommends that Council direct staff to post and publish a notice of Stage II Water Alert; and prepare a resolution ratifying the City Manager's declaration, revisions to the Water Conservation Plan, and a conservation rate structure. Bifi "Toby" Fisher, 16831Avenida Florencia, owner of Sofspra self-service car wash, stated his car wash is not equipped to recycle their water and asked about the impact of the Stage II Water Alert on his business. City Manager Bowersox stated that the revisions to the Water Conservation Plan will remove the self-service car wash restrictions. Council discussion included: use of erosion control fabrics in lieu of erosion control landscaping for large cut slopes; odd/even concept as part of Stage II; need to continue issuance of construction meters for projects to insure viabi- lity of South Poway Industrial Park and ongoing Capital Improvement Projects within the City; and the need for a policy addressing the ability to serve addi- tional customers as a regional issue in light of regional growth demands. Motion by Councilmember Emery, seconded by Councilmember Kruse, to approve staff recommendation, and appoint Councilmembers Brannon and Emery to work with staff to develop a proposal to present to the Regional Growth Management Board {Prop C). Motion carried unanimously. ITEM 18 TEMPORARY WATER & SEWER CONNECTION APPLICANT: TIM J. CONNOLE ITEM 19 MINOR DEVELOPMENT REVIEW 89-188 APPLICANT: TIM J. CONNOLE Mayor Higginson stated that a request had been received from the public to reconsider action taken earlier on Items 18 and 19 of the Consent Calendar. Motion by Councilmember Brannon, seconded by Councilmember Kruse to reconsider Items 18 and 19. Motion carried unanimously. 3754 Page 7 - CITY OF POWAY - May 1, 1990 Councilmember Emery stated he was disqualifying himself from these items. Mayor Higginson stated that Items 18 and 19 will be heard together. Staff report by City Manager Bowersox. This is a request to approve a temporary water and sewer connection, and to construct a two-story home on a half-acre parcel with a steep hillside located east of the intersection of Twin Peaks Place and Pebble Canyon Drive. The applicant plans to share an existing private driveway off Twin Peaks Road which serves a two-story home just east of the site. Staff recommends approval. Speaking in opposition to staff recommendation: Anita Shoop, 14566 Twin Peaks Road, asked about access from an existing shared private driveway and requested a continuance. Naren Rathod, 14554 Twin Peaks Road, asked about access and easements. Speaking in favor of staff recommendation: Tim Connole, 12202 Old Stone Road At Council's request, the applicant signed a waiver of 60-day time limit requiring City Council action under Municipal Code Section 17.52.060 and agreed to continue this item to May 8, 199D, to allow staff time to discuss access issues with the neighbors. Motion by Councilmember Kruse, seconded by Councilmember Goldsmith, to rescind Resolution No. P-90-29, and continue Items 18 and 19 to May 8, 1990. Motion carried 4-0, with Councilmember Emery abstaining. CITY COUNCIL-INITIATED ITEMS 26. A. Councilmember Brannon reported on the Career Day held at Poway High School, and the possibility of involving students in area projects for submittal in their Drafting Competition. B. Councilmember Brannon appointed Moze Smalley {LMD 87-1) to the Landscape Maintenance District Advisory Committee. 27. Councilmember Emery discussed a request received from Victoria Lazowski regarding a multi-purpose pathway designation for the General Plan. Victoria Lazowski, 14440 Golden Sunset Lane, presented a multi-purpose pathway concept. She stated that paved sidewalks and walkways are not required in many rural residential areas. This creates a hazardous situation for pedestrians, including children walking to school. She requested Council consider adding this designation to the upcoming General Plan review.
