Accessory Dwelling Unit Update
Some Significant Changes:
•No Discretionary Reviews (e.g., MDRA)
•Objective Compatibility Architectural Regulations
•Multiple ADUs Permitted in Multi-Family Dwellings
•A Detached ADU and an Attached JADU are Permissible on One Lot
•New Setbacks are Four feet for Side and Rear with New Exceptions
•Height Limited to 16 ft; except that ADU Allowed to Match Existing
Primary Dwelling when Complying with Setback for Primary Dwelling
•Replacement Parking for Garages Converted to ADUs No Longer Required
•No owner-occupancy requirement except for JADU
•No Fees for ADUs less than 750 sf

Current Proposed
ADUs prohibited in Multi-Family Dwellings Multiple ADUs are required to be permitted if
converting existing spaces (up to 25%) of
existing dwelling units on-site) and up to two
detached ADUs are permissible
An ADU and JADU is not permissible on One
Single-Family Residential Lot
A detached ADU and an attached JADU is
permissible on One Single-Family Residential Lot
provided the height of the ADU does not exceed
16 feet and the floor area does not exceed 800 sf
and the either the JADU or the primary dwelling
must be owner-occupied and the building
envelope for the primary dwelling can’t exceed
150 sf to accommodate the JADU
