Ratification of Warrant Register - April 26, 1990. 13. Award of contract to perform professional engineering services to fulfill the requirements of the Seismic Safety Law {SB 547}, to EQE Engineering; and approval of appropriation in the amount of $13,600 to cover costs of contract. 15. Approval of amendment to Weed Abatement contract with Eaton Field Maintenance. 15.1 Adoption of Resolution No. 90-092 entitled, "A Resolution of the City Council of the City of Poway, California, Restricting Use of the Poway Center for the Performing Arts During Times at which Alcoholic Beverages are Being Consumed and Rescinding Resolution No. 90-008." 15.2 Receive and file report on the 30-day review period for the Draft Subse- quent EIR for the South Poway Planned Community, CalMat-Poway applicant; and adoption of Resolution No. P-90-32 entitled, "A Resolution of the City of Poway, California, Designating the Planning Director as the Person Authorized to Request Shortened Review Periods for Negative Declarations and Environmental Impact Reports." Motion carried unanimously. ITEM 4 TENTATIVE PARCEL MAP 89-12 APPLICANT: STONE DEVELOPMENT COMPANY Councllmember Emery stated he was disqualifying himself from this item. Mayor Higginson opened the public hearing. Introduction by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This is a request to divide 12.6 acres into four lots, located at the east end of Orchard View Lane in the southwest High Valley area. This site had been pre- viously used to store heavy equipment and large drums of various contaminants. As a condition of approval, the applicant will be required to conduct a site cleanup with certification by the County of San Diego Hazardous Management Department. Staff recommends revisions to the conditions of approval to require annexation into a Landscape Maintenance District; and improvement of the curves at the intersections of Golden Sunset Lane and Orchard View Drive, and Orchard View Drive and Country Hill Road to a minimum width of 20 feet and a curve radius of 28 feet. 3769 Page 3 - CITY OF POWAY - May 15, 1990 Speaking in favor of staff recommendation: Vicki Lazowski, 14440 Golden Sunset Lane, asked about access from the par- cels at this project's southern boundary. Michael Lubitz, representing Stone Development Company, 4655 Rufner Road, Suite 130, San Diego. City Manager Bowersox stated that staff will work with the High Valley Association regarding access, water, and related issues for the area, including the two 40-acre parcels to the south. Motion by Councilmember Goldsmith, seconded by Councilmember Kruse, to close the public hearing, issue a Negative Declaration, and adopt Planning Resolution No. P-90-33 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Parcel Map 89-12, Assessor's Parcel Number 321-031-18," as revised. Motion carried 4-0, with Councilmember Emery abstaining. ITEM 5 PROPERTY ACQUISITION/DAHLIN (OWNER) .$72 ACRES NEAR END OF CLAIRE DRIVE Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. Recommendation is for adoption of a resolution finding and deter- mining the necessity that .672 acres of vacant land near the end of Clarie Drive, along with a temporary construction easement bisecting the property, be acquired under eminent domain proceedings. The acquisition of this property is necessary to provide for the construction and maintenance of an access road, water line and slope easements in conjunction with the Parkway Business Center project in South Poway. There was no one present wishing to speak. Motion by Councilmember Kruse, seconded by Councilmember Goldsmith, to close the public hearing and adopt Resolution No. 90-093 entitled, "A Resolution of the City Council of the City of Poway, California, Finding and Determining the Necessity that Certain Property be Acquired by the City of Poway Under Eminent Domain Proceedings; Directing the City Attorney to Commence a Court Action for Said Purpose (Dahlin: APN 323-090-03)." Motion carried unanimously. ITEM 6 PROPERTY ACQUISITION/PIERSON (OWNER) .517 ACRES NEAR END OF WELTON LANE Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. Recommendation is for adoption of a resolution finding and determining the necessity that .517 acres of vacant land near the end of Welton Lane, along with a temporary construction easement bisecting the property, be acquired under eminent domain proceedings. The acquisition of this property is necessary to provide for the construction and maintenance of an access road, water line and slope easements in conjunction with the Parkway Business Center project in South Poway. 3770 Page 4 - CITY OF POWAY - May 15, 1990 Speaking in opposition to staff recommendation: Barry Hogan, Michael Brandman Associates, 4918 North Harbor Drive, Suite 205, San Diego, representing property owner, requested a continuance in order to reach a consensus through ongoing discussions with the deve- loper and the Piersons. City Attorney Eckis stated that he feels they will reach a consensus, however, the timing on this project requires that the City Council proceed with this action. Motion by Councllmember Goldsmith, seconded by Councilmember Kruse, to close the public hearing, and adopt Resolution No. 90-094 entitled, "A Resolution of the City Council of the City of Poway, California, Finding and Determining the Necessity that Certain Property be Acquired by the City of Poway under Eminent Domain Proceedings; Directing the City Attorney to Commence a Court Action for Said Purpose (Pierson: APN 323-090-52." Motion carried unanimously. ITEM 7 OWNER PARTICIPATON AGREEMENT BETWEEN CITY OF POWAY/REDEVELOPMENT AGENCY AND McMILLIN COMMUNITIES, INC. Mayor Higginson stated this item will be trailed and considered at the same time as Item 8.1. ITEM 8 GENERAL PLAN AMENDMENTS 90-01A-C Councilmember Kruse disqualified himself from Items 8 A-B and left the room at 7:29 p.m. Mayor Higginson opened the public hearing and explained the General Plan Amendment process. Each of the General Plan Amendments will receive a tentative vote from Council after being heard. The public hearing will then be closed, final votes will be taken on each item, and the second reading of any ordinances will be held on May 29, 1990. GENERAL PLAN AMENDMENT/ZONE CHANGE 90-01A/SPECIFIC PLAN 89-01/ TENTATIVE TRACT MAP 89-13 Introduction by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This item is for consideration of a resubmitted application from Environmental Development Ltd. for the redesignation of land use and zoning from RR-A, RR-B, and RR-C to Planned Community with a Specific Plan and Tentative Tract Map, for approximately 708 acres of undeveloped land located on the north side of Espola Road, in the northern portion of the City. On June 13, 1989, the City Council denied General Plan Amendment/Zone Change 89-03A due to a density greater than in the General Plan. The applicant has scaled down the project to 156 single-family lots of one acre minimum, a 27-hole 3771 Page 5 - CITY OF POWAY - May 15. 1990 golf course, clubhouse facility, and a three-acre mini-park. The City Attorney has determined that the proposed amdendment is not subject to Proposition FF as it meets the General Plan rural residential density with one-acre minimum lot sizes. A Final Environmental Impact Report has been prepared and includes a mitigation monitoring and reporting program, along with candidate findings. The summary of Environmental Consequences identifies the environmental impacts that can be eli- minated or reduced to a level below significance. The two important issues are water and biological resources. The applicant has proposed modifications to conditions of approval. Staff recommends approval of revisions to the following areas which were included in applicant's request: Specific Plan resolution Paragraphs 1, 5 and 11 regarding recording conditions of approval, conformance to Section VII, and restricted uses to those allowed under residential zoning; Tentative Tract Map resolution under Site Development, Paragraphs 6, 7, 13 and 16 regarding conceptual align- ment of equestrian/ pedestrian trail, staging area for Old Coach Road improve- ments, development fees in accordance with State law, identification of on-site resourses to be preserved; Landscaping, Paragraphs 1 and 8 regarding annexation into a Landscape Maintenance District, and Homeowner Association's construction and maintenance to be same requirements as Landscape Maintenance Districts; Additional Approvals, Paragraphs I and 7 regarding temporary use permit for a sales trailer, recording conditions of approval and restricted uses to those allowed under residential zoning; Grading, Paragraph 2 regarding use of chain link fencing for protection of open space and low level marking system following completion of bulk grading; Streets and Sidewalks, Paragraphs 2 and 22 regarding additional approval by Director of Public Services for bridge construction, and credit towards traffic mitigation fee for construction of Old Coach and Espola Road signal; Drainage and Flood Control, Paragraph 7 deletion; Water, Paragraph 1 regarding installation of reclaimed water system to serve private residential lots; Sheriff, Paragraph 5 regarding street signs lighted in accordance with City standards; and General Requirements and Approvals, Paragraph 17 regarding effective date for Tentative Map to become effective after 30 days from adoption of the zone change Ordinance. Staff recommends revisions in addition to applicant's request to the following areas: Specific Plan resolution, Paragraph 12 regarding effective date; Tentative Tract Map resolution, Streets and Sidewalks, Paragraph I regarding vacation and restoration of Indian Canyon Lane terminus; Sewer, Paragraph 3 regarding sewer system and project layout designed to minimize the number of public and individual pump stations necessary; Water, Paragraph 5 added regarding golf course water supply to be classified as interruptible agri- culture; and General Reguirements and Approvals, Paragraph 18 added regarding design and construction of public utility systems to serve the ultimate develop- ment of surrounding areas and extension of facilities to project boundaries. Those speaking in favor cited benefits of project over the 1989 proposal, including the preservation of large areas of open space, consistency with the General Plan, and additional public utilities to serve the North Poway area. RECESS Alii) ~LL TO O~i)E~ Mayor Higginson recessed the meeting at 9:01 p.m., and called it back to order at 9:21 p.m., with all Councilmembers present except for Councilmember Kruse. 3773 Page 7 - CITY OF POWAY - May 15, 1990 City Manager Bowersox stated that the black-tailed gnatcatcher study is a mitigation feature of the Final Environmental Impact Report and would be required for certification of the EIR; and that staff recommends the sidewalk, curb and gutter requirements remain in place. Council discussion included desirability of distribution system for reclaimed water to serve North Poway, provisions for trail connections to Blue Sky Ranch and the San Dieguito River Valley Regional Open Space Park, and agreement to only require sidewalks on Old Coach Road and street lights only at intersec- tions. Motion by Councilmember Brannon, seconded by Councilmember Goldsmith, to take tentative action to adopt resolutions certifying the Final Environmental Impact report; approving GPA 90-01A; hold first reading on the Ordinance approving ZC 90-01A, and setting second reading for May 29, 1990; approve SP 89-01; and approve TTM 89-13; as revised by staff recommendation, and as amended by Council regarding sidewalks and street lights. Motion carried 3-1-0 with Councilmember Emery voting "no," and Councilmember Kruse abstaining. GENERAL PLAN AMENDMENT gO-01B Staff report by City Manager Bowersox. This item was initiated by the City Council on May 16, 1989, and involves consideration of an amendment to the General Plan Circulation Element for Old Coach Road between Espola Road and Highland Valley Road and an unnamed road between Old Coach Road and Highland Valley Road. On June 13, 1989, this item was considered as GPA 89-03B. The Council took action to deny the General Plan Amendment and directed staff to bring back for consideration at the same time as the Old Coach project resubmit- tal. The Transportation Task Force has concluded that Old Coach Road is not of regional signifance and recommended its removal from the Circulation Element in a report to the City Council on March 20, 1990. The Circulation Element classi- fies Old Coach Road as a planned Collector Arterial. The Final Environmental Impact Report for the Old Coach Golf Estates Project {Environmental Development, Ltd.} evaluates the potential traffic impacts for an amendment to the Old Coach Road classification. Staff recommends certification of the Final Environmental Impact Report, and deletion of Old Coach Road and Unnamed Road from Circulation Element. Motion carried 4-0, with Councilmember Kruse abstaining. (Councilmember Kruse re-entered the meeting at 10:55 p.m.) GENERAL PLAN AMENDMENT/ZONE CHANGE 90-01C Staff report by City Manager Bowersox. This is a City-initiated proposal to change the zoning from RS-1 to Commercial General for 1.01 acres located behind the former Woolworth Garden Center, south of Poway Road, west of Vista View Drive. The redesignation of this property, combined with the former garden center site, would provide for the expansion of the commercial zoned parcels to the north to attract more diverse, large scale commercial projects. Staff recommends approval. GENERAL PLAN AMENDMENT 90-01B Motion by Councilmember Goldsmith, seconded by Councilmember Brannon, to adopt Resolution No. 90-098 entitled, "A Resolution of the City Council of the City of Poway, California, Certifying Final Environmental Impact Report {Old Coach Golf Estates Project - SCH # 90010015) Adequate for General Plan Amendment 90-01B, City of Poway: Lead Agency/Applicant," and Resolution No. 90-099 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Amendments to the Circulation and Land Use Elements of the General Plan of the Poway Comprehensive Plan, General Plan Amendment 90-01B, City of Poway: Lead Agency/Applicant." GENERAL PLAN AMENDMENT/ZONE CHANGE 90-01C Motion by Councilmember Goldsmith, seconded by Councilmember Brannon, to deny General Plan Amendment 90-01C. Motion carried unanimously. ITEM 7 OWNER PARTICIPATION AGREEMENT BETWEEN CITY OF POWAY/REDEVELOPMENT AGENCY AND MCMILLIN COMMUNITIES~ INC. Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This item is for consideration of an Owner Participation Agreement {OPA} with McMillin Communities, Inc. to provide for the construction of South Poway Parkway to a width of six lanes and improvements to Pomerado Road. These improvements are a condition of approval for McMillin's proposed 121 lot sub- division located on the west side of Pomerado Road and south of South Poway Parkway {TTM 88-04). The Redevelopment Agency has acquired property adjacent to 3776 Page 10 - CITY OF POWAY - May 15, 1990 the project for right-of-way for the westerly extension of South Poway Parkway. McMillin would be credited up to $250,000 in traffic mitigation fees and the Redevelopment Agency would provide $644,000 toward deferring the costs of the improvements. Staff recommends approval of the OPA because the requirement to construct these improvements is beyond that which would normally be required of a residential development of this size. Motion carried 4-1, with Councilmember Emery voting "no." ITEM 8.1 SPECIFIC PLAN AMENDMENT 84-01D/TENTATIVE TRACT MAP 88-04R APPLICANT: McMILLIN EQUITY PARTNERS II Mayor Higginson stated that this public hearing was continued from May 8, 1990, in response to questions raised by the Council regarding additional costs incurred by the Redevelopment Agency for construction of South Poway Parkway if the 15 additional residential units proposed by McMillin were not approved. The Owner Participation Agreement was based upon 120 residential units with one com- mercial lot. Staff has estimated that the deletion of the proposed units would result in an increase of $600,000 by the Redevelopment Agency. Staff recommends approval of the South Poway Specific Plan Amendment and the Tentative Tract Map as amended to require expansion of the traffic study to include the intersection of Pomerado/Creek Roads. Motion carried 4-1, with Councilmember Emery voting "no." 3777 Page 11 - CITY OF POWAY - May 15, 19g0 ITEM g REPORT FROM TRANSPORTATION TASK FORCE REGARDING ALTERNATIVES TO ALLEVIATE POWAY ROAD TRAFFIC CONGESTION Staff report by City Manager Bowersox. The Transportation Task Force reviewed traffic flows and vehicular capacity of Poway Road from the western City limit to Poway Grade which was based on projections prepared by SANDAG and analyzed by the Task Force's consulting engineers. Under current conditions, Poway Road is operating at a Level of Service {LOS) F west of Community Road, LOS E between Community Road and Midland Road, and LOS C east of Midland Road. Based upon the findings, the Transportation Task Force majority report recommendations are as follows: 1) close/redesign unnecessary driveways; 2) relocate/consolidate tran- sit stops from major intersections and include bus turnouts where feasible; pro- hibit turns at median breaks that do not have left turn lanes; work with the Poway Road business community to incorporate reciprocal driveway access agreements; 5) adopt design standards for Poway Road driveways; 6} support a monument address sign program for Poway Road; and 7} implement computerized signal synchronization program on Poway Road. Staff recommends Council approve the recommendations of the Transportation Task Force and direct staff to coor- dinate their implementation. ITEM 10 APPEAL RE: PERMITTED USE IN RESIDENTIAL ZONE APPLICANT: MICHAEL BRANDMAN ASSOCIATES Introduction by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This item is a request for a determination from the City Council that a proposed commercial athletic fitness facility is within the intent and purpose of the Zoning Development Code and is similar to a private recreational facility. Staff has determined that the applicant's proposal for a commercial athletic facility, to be located on the west side of Pomerado Road, north of the extension of SR 56, is not an appropriate use in a residential zone. Staff recommends that the City Council uphold the Planning Director's determination and direct staff to bring forward an ordinance amendment clarifying Zoning Development Code Section 17.08.120.G. At the April 3, 1990 meeting, Council requested a report regarding the implications of Proposition 111 and 108 on the June 1990 ballot. Two major elements contained in the ballot measures are increasing the gas tax and truck weight fees for transportation improvements, and revising the Gann spending limit calculations. Both will have major impacts on cities and the way services are delivered, and would allow state and local governments greater flexibility in making use of already collected tax dollars. Staff recommends adoption of a resolution in support of Propositions 108 and 111. Motion by Councilmember Brannon, seconded by Councilmember Goldsmith, to adopt Resolution No. 9D-102 entitled, "A Resolution of the City Council of the City of Poway, California, in Support of Propositions 108 and 111."
