Approval of Minutes - City Council: May 15, 1990, Regular Meeting 12. Ratification of Warrant Registers - May 31, June 1, 199D. 13. Denial of claims for damages: A) Sandra Hardison; B} Clifford Hubbell; and C) James Dunn. 14. Adoption of Resolution No. 90- 123 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Application for Funds for Road Improvements Under the State/Local Partnership Program, SB 300." 15. Adoption of Resolution No. 90-124 entitled, "A Resolution of the City Council of the City of Poway, California, Initiating General Plan Amendment 90-02," for GPA 90-02A, located on the northeast corner of Pomerado Road and Metate Lane, from Residential Single Family-1 (1 du/net acre) to Residential Apartment (12-20 du/net) developed to Residential Senior Citizen (RSC) stan- dards; and 90-02B, located south of Twin Peaks Road, opposite Roberto Rio Road, from Residential Single Family-4 (3-4 du/net acre) to Neighborhood Commercial (CN); to be heard at a public hearing on June 26, 1990. 18. Award of bid in the amount of $184,182.00 for the construction of various improvements: Community Park and Twin Peaks Multi-Purpose building to S.J. Skerritt Construction, Inc., and approval of transfer of funds. (1647, 1648, 5610, 5611, 5612) 21.1 Award of bid for office furniture for City Hall reorganization to Patron Hall Office Furniture in the amount of $48,899.96 and Bayless Stationers in the amount of $9,405.83. {Continued from June 12, 1990, Item 36.} Motion carried unanimously. ITEM 4 1990-91 FINANCIAL PLAN City Manager Bowersox stated this was the second of three planned public hearings on the proposed 1990-91 budget. He noted that the proposed spending plan was very similar to the 1989-90 budget with the exception of five new employees: Account Clerk in the Customer Services section; Landscape Technician in the Planning Services Department; Building Maintenance Worker, Department Aide and Park Maintenance Worker in the Public Services Department. The cost of three of these positions will be offset by savings since the work is currently being done by consultant. He reviewed other changes in revenues and expenditures, particularly in maintenance of new facilities. Speaking in favor of increased spending for youth sports facilities: Dan Wiberg, 16632 Maverick Court, representing the Poway Youth Sports Association, read several letters from persons unable to attend. Ronald Heard, 1255D Mustang Drive Jim McAlister, 16157 Country Day Road, representing Poway Pop Warner Football Dick Rosenberger, 13268 Olive Meadows Drive Dennis Marx, 14336 Sycamore Avenue Bruce Kravitz, 13326 Aubrey St., representing Poway Pony/Colt League Speaking in favor of fees/taxes for requested services: Larry Valente, 15925 Cumberland Drive Council discussion included the priority of youth in the community; amount of funds included in the 1990-91 budget for parks and recreation; need to have sources of revenue for maintenance of capital facilities built with Redevelopment Agency funds. 3813 Page 4 - CITY OF POWAY - June 19, 1990 City Manager Bowersox clarified that the budget item for land acquisition for a City Hall/Library complex also accommodates needed parking for Old Poway Park and the creation of a Safety Services complex by allowing the existing City Hall to be used by the Sheriff's Department. Motion by Councilmember Goldsmith, seconded by Councilmember Brannon, to con- tinue consideration of the 1990-91 Financial Plan to June 26, 1990 and requested staff to: evaluate any budgeted projects that could have funds transferred to youth sports facilities; evaluate alternatives for acquiring property for City Hall; have Parks & Recreation Committee work with the Poway Youth Sports Association to identify means of funding maintenance of any new fields; and report back in three to six months on possible sites for playing fields. Motion carried unanimously. Alan Sugarman, Chairman of the Parks & Recreation Committee, stated their Committee will be considering the sports needs assessment survey on June 20, 1990 and the City Council is scheduled to have a workshop on this subject on June 28, 1990. ITEM 5 TENTATIVE TRACT MAP 89-03 Mayor Higginson opened the public hearing. City Manager Bowersox stated that staff is recommending this item be continued to June 26, 1990 at the applicant's request. Mr. Randy Wilkins, 14617 Acton Court, representing the Garden Road Association, stated he had met with staff to discuss drainage concerns on this project and wanted the Council to be aware of that prior to the June 26, 1990 hearing. Motion by Councilmember Goldsmith, seconded by Councilmember Kruse, to continue consideration of Tentative Tract Map 89-03 to June 26, 1990. Motion carried unanimously. RECESS AND CALL TO ORDER Mayor Higginson recessed the meeting at 8:50 P.M. and called it back to order at 9:10 p.m. with all Councilmembers present. ITEM 6 RECLAMATION PLAN 89-05 AND CONDITIONAL USE PERMIT 89-05 APPLICANT: CALMAT-POWAY Mayor Higginson opened the public hearing. Item introduced by City Manager Bowersox. This is a request for a Conditional Use Permit to allow the continued and expanded operation of CalMat-Poway for production of construction aggregate, road base and fill material. Staff is proposing the Council consider a scaled down project which would be restricted to the existing site in addition to building a haul road into the South Poway industrial area to eliminate truck traffic on Beeler Canyon and Creek Roads. 3814 Page 5 - CITY OF POWAY - June 19, 1990 Staff report by Assistant Director of Planning Services Streeter. This item includes the certification of a Final Subsequent Environmental Impact Report for the South Poway Planned Community; a Reclamation Plan for the progressive reha- bilitation of the mining site landform so that when reclamation is complete it will contain stable slopes and be readily adaptable for alternate land uses; and a Conditional Use Permit as described by the City Manager. The area currently being mined has been recognized by the State Division of Mines and Geology as an area of regional significance and its operation was cited as a mitigating measure for the South Poway Planned Community since its development is covering over a large mineral resource. CalMat-Poway is operating under a Special Use Permit issued by the County of San Diego that expires in October, 1990. The Reclamation Plan is required by AB747 and the current deadline for adoption is June 30, although there is pending legislation that would extend this deadline to July 31 or October 31. The Environmental Impact Report identifies areas of biology, aesthetics/land form alteration that cannot be migitated. A Statement of Overriding Considerations would be required. He also discussed the loss of California Grasslands and Coastal Sage Scrub that must be mitigated. Speaking in favor of the project: Robert Imler, 19075 Beeler Canyon Road, Special Projects Manager for CalMat Mr. Imler showed a video regarding CalMat's operations and presented 411 cards signed by Poway residents in favor of their proposal. Dwight Beavers, 6623 Calle Eva Miranda, Irwindale, Vice President, CalMat William Schwartz, 401 "B" St., San Diego, Attorney for CalMat, pointed out the areas where they differed with staff's analysis, including building the private road to public standards; need to establish California grasslands off-site; and necessity to expend funds for improvements prior to a decision on developing the entire 166 acres. In response to Council query, City Attorney Eckis stated that CalMat's request for a continuance is appropriate since they did not receive the final staff recommended conditions of approval until today. In his opinion, they are 3815 Page 6 - CITY OF POWAY - June 19, 1990 entitled to a continuance due to the magnitude of the project. Following discussion, Councll concurred the public hearing will be continued to August 7 following all the public input since that is the first meeting when all Councilmembers will be present. Mr. Schwartz agreed to waive any time con- siderations on behalf of CalMat to August 7, 1990. Speaking in opposition to the project: Norman Elder, 12934 Welton Lane, showed a video of CalMat's current opera- tion in Beeler Canyon Mike Fry, 12819 Selma Court, questioned the EIR regarding the spring survey, and the traffic study, and the sales tax figures. Council discussion included: questions regarding impacts on traffic and air quality; where the sales tax is credited; mixed message being sent by requiring expenditure for haul road with no guarantee that expanded project will be appro- ved; size of present project versus what was approved by the County; need for clarification of whether CalMat is currently violating conditions of their CUP and, if so, why there has not been a revocation hearing; whether this project can be eliminated if it was cited as a mitigation measure for the South Poway Specific Plan; and adequacy of the environmental impact report. Motion by Councilmember Brannon, seconded by Councilmember Emery, to continue consideration of this item for all purposes to August 7, 1990. Motion carried unanimously. 3816 Page 7 - CITY OF POWAY - June 19, 1990 ITEM 7 WATER CONSERVATION RESPONSE Staff report by City Manager Bowersox. On May 22, 1990, Mr. Anthony Rapaty expressed concern over water being wasted on landscaping throughout the City. City staff is working with owners and developers of private projects to comply with the Stage II Water Alert. Staff recommends the report be received and ordered filed. Council concurred. ITEM 8 IN-PARK MOBILEHOME SALES Staff report by City Manager Bowersox. On May 22, 1990, Mr. David Rinaldo asked about the legality of the managers of the Poway Royal Mobile Estates selling mobile homes from the park office. Following investigation, staff has concluded that this is an accessory use and is permitted by right in the mobile home park office. Staff recommends the report be received and ordered filed. Council concurred. ITEM 9 APPROPRIATIONS LIMITATION Staff report by City Manager Bowersox. Proposition 4, adopted by the voters in November, 1979, places a limit on the annual growth allowable for government appropriations. Based on the state's formula, the City of Poway's limit is $13,610,485. The portion of the 1990-91 proposed budget subject to the limit is $11,800,425, or $1,810,060 below the limit. Staff recommends adoption of the resolution. Motion by Councilmember Brannon, seconded by Councilmember Goldsmith, to adopt Resolution No. 90-128 entitled, "A Resolution of the City Council of the City of Poway, California Adopting an Appropriation Limit for Fiscal Year Ending June 30, 1991." Motion carried unanimously. CITY COUNCIL-INITIATED ITEMS 24. Councilmember Brannon presented a request from SANDAG's Regional Recycling Strategy Committee to oppose AB4298 because of its adverse impact on local recycling programs. Council concurred. 25. Councilmember Emery asked staff to proceed with abatement of the abandoned earth movers at the east end of Garden Road. 26.
