The September 25, 1990, regular meeting of the City Council of the City of
Poway was called to order at 7:02 p.m. by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

Mike Kelly, 11532 Alkaid Drive, San Diego, representing P.L.A.N. (Prevent
Los Angelization Now}, requested Council oppose Proposition D.
Following discussion, Council concurred not to take action to support the propo-
sitions and stated their individual opposition to the initiatives.

Mayor Higginson declared September 15 - October 15, 1990, "Erosion Control
Month" and presented a proclamation to Bill Jensen, Area VIII Director for the
California Association of Resource Conservation Districts.

Mayor Higginson explained the procedure for Public Oral Commmmmunications.
Bill Barnick, 14645 Sunrise Canyon Road, asked when Pomerado Road south of
the City limits would be opened.
City Manager Bowersox stated that Pomerado Road remains closed during
reconstruction due to the extent of work required for the realignment. He
stated that he will report to Council at the October g, 1990 meeting.

By-Laws and Joint Powers Agreement of the Automated Regional Justice

Adoption of Resolution No. 90-195 entitled, "A Resolution of the City
Council of the City of Poway, California, Approving the First Amendment to
a Cooperation Agreement for a Coai,,unity Development Program," with the
County of San Diego.
Motion carried unanimously.
ITEM 5
ORDINANCE NO. 324 - SECOND READING
ESTABLISHING SPEED LIMIT FOR VALLE VERDE ROAD
Mayor Hlgginson read the title of Ordinance No. 324, "An Ordinance of the City
of Poway, California, Adding Section 10.32.230{D) to the Poway Municipal Code
Establishing a Speed Limit of 35 MPH for Valle Verde Road from Starmont Way to
Old Winery Road." City Manager Bowersox stated that first reading of the
proposed ordinance was held on September 11, 1990.

There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councllmember Kruse, to close the
public hearing, waive further reading and adopt Ordinance No. 324. Motion
carried unanimously on a roll call vote.
Mayor Higginson stated that Items 5.1 and 5.2 will be taken out of order.
ITEM 6
SB 300 GRANT APPLICATIONS
Staff report by City Manager Bowersox. In June, 1990 the City applied for funds
under SB 300, State-Local Transportation Demonstration Program, for three pro-
jects in the Capital Improvement Program: Poway Road, South Poway Parkway, and
Espola Road. The applications have been accepted for participation and the City
should be receiving approximately $3,091,000.
Council concurred to receive and file report.
ITEM 7
REIMBURSEMENT OF FUNDS FOR TWIN PEAKS ROAD
APPLICANT: R&R PARTNERS POWAY
Staff report by City Manager Bowersox. The developer of the Target Shopping
Center, R & R Partners, has requested reimbursement for certain construction
costs totaling $339,401.00, which include, lowering Twin Peaks Road, median
modifications, and traffic signal modifications. Staff recommends reimbursement
of $166,867.57 to R & R Partners from Redevelopment Agency funds.

Motion by Councilmember Emery, seconded by Councilmember Goldsmith, to approve
staff recommendation. Motion carried unanimously.
ITEM 8
RESPONSE TO INQUIRY RE: YORK AVENUE
Councilmember Brannon stated she will disqualify herself from this item as she
resides within 500 feet of the property. Staff report by City Manager Bowersox.
At the September 11, 1990 meeting, the City Council received a petition from
residents of York Avenue requesting York Avenue be maintained as a public
street and that Redevelopment Agency funds be allocated for projects in the Old
Poway area. Staff recommends that York Avenue from Aubrey Street to Norwalk
Avenue be accepted into the publicly maintained street system, and that staff
work with the Redevelopment Advisory Committee and the residents on bringing the
roadway up to public road standards.

Motion by Councilmember Emery, seconded by Councilmember Kruse, to approve staff
recommendation. Motion carried 4-0, with Councilmember Brannon disqualifying
herself.
ITEM 5.2
FINAL REPORT FROM TRANSPORTATION TASK FORCE
Staff report by City Manager Bowersox. On April 4, 1989, the City Council
approved the charter for a Transportation Task Force to advise the Council on
transportation matters within the City with the intention of improving traffic
circulation. Staff recommends that the Council approve the final report and
direct staff to work toward the implementation of the task force's recommen-
dations.
Councilmembers Brannon and Goldsmith, Co-Chairpersons for the Transportation
Task Force, reviewed the issues identified with Poway's current and projected
future traffic problems, and the short- and long-term methods of addressing
those problems, including: 1) upgrading South Poway Parkway to an Expressway;
2} regional computerized traffic signal synchronization; 3) designate Route 125
as a toll road in cooperation with other agencies; 4} support Route 603/604 from
Ramona to 1-15; 5) modification to Rancho Bernardo/Pomerado Road intersection;
6) defer widening Poway Grade until South Poway Expressway is completed and its
effectiveness determined; 7) defer decision on Sycamore Canyon Road extension
until South Poway Expressway is completed; 8) if Sycamore Canyon Road extension
is constructed, eliminate Garden Road connection; 9) measures to reduce traffic
congestion on Poway Road to enhance the business activity; 10} widening
CoFF~lunity Road; 11) analyze ways to increase capacity on Pomerado Road between
Poway Road and South Poway Expressway and increase capacity or decrease volumes
on Twin Peaks Road at the Twin Peaks Center {Target}; and 12) addressing Poway
as a commuter destination.
The following members of the Transportation Task Force addressed the Council:

The Council thanked the task force for their work during the past 18 months and
recognized the members present. Following discussion, motion by Councilmember
Goldsmith, seconded by Councilmember Brannon, to accept the Transportation Task
Force report, direct staff to bring back a timetable for implementation of the
Task Force reco~endations, and to pursue a common name for South Poway
Expressway/Scripps Ranch North Parkway with the City of San Diego. Motion
carried unanimously.
ITEM 5.1
INTENT TO PREPARE DRAFT ENVIRONMENTAL IMPACT REPORT
POWAY ROAD WIDENING PROJECT
Mayor Higginson stated that this public hearing was continued from September 18,
1990. City Manager Bowersox stated that at that meeting, the Council received
testimony regarding access at Blue Crystal Trail/Millards Road, and requests

that Poway Grade not be widened. Staff recommends the City Council receive any
additional public input, and direct staff to add signalization at the intersec-
tion of Blue Crystal Trail/Millards Road, and no project alternative to the
areas of study for the Draft Environmental Impact Report.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Goldsmith, to close the
public hearing, and direct staff to send out a Notice of Preparation for a Draft
Environmental Impact Report including the additional items as identified.
Motion carried unanimously.
ITEM 14
CITY MANAGER ITEMS
City Manager Bowersox displayed the plaque awarded to the City from the
American Public Works Association's San Diego/Imperial County Chapter for
the Center for the Performing Arts as the Public Facilities Large Project of
the Year.
B. Council concurred with City Manager Bowersox's recommendation to continue
the September 27, 1990 workshop items to October 2, 1990.
ITEM 15
CITY ATTORNEY ITEMS
A&C City Attorney Eckis stated that he is removing from calendar his request
for a closed session on items 15 A and C.

City Attorney Eckis stated that he is requesting a closed session under
Government Code §54956.9{a) to discuss pending litigation as follows: San
Marcos Development vs. City of Poway; Laugen vs. City of Poway; Grover vs.
City of Poway.
CITY COUNCIL-INITIATED ITEMS
18. Councilmember Goldsmith stated that the Regional Transportation Program and
mass transit are scheduled for SANDAG's September 28, 1990 meeting.
19. Councilmember Kruse requested staff report back on a request from the Poway
Foundation for the Performing Arts regarding the establishment of an
endowment fund.
20. Mayor Higginson thanked participants in the Poway Days events for all their
efforts.

CLOSED SESSION
Mayor Higginson called for a closed session at 8:50 p.m. as requested by the
City Attorney. Mayor Higginson called the meeting back to order at 9:05 p.m.,
with all Councilmembers present, and stated that no action was taken in closed
session.
