Motion by Councilmember Kruse, seconded by Councilmember Brannon to approve the Consent Calendar as follows: e Ratification of Warrant Register - September 13, 1990. Adoption of Resolution No. 90-196 entitled, "A Resolution of the City Council of the City of Poway, California, Opposing an Increase in the Federal Motor Fuel Tax as a Measure to Reduce the National Deficit." e Adoption of Resolution No. 90-197 entitled, "A Resolution of the City Council of the City of Poway, California, Ordering the Summary Vacation of a Sewer Easement Located Within Section 12, Township 14 South, Range 2 West, San Bernardino Meridian Filed in the Office of the County Recorder of San Diego County as File No. 80-405358 on December 2, 1980, Vacation 90-12," located approximately 4D feet east of Midland Road between Janette Lane and Somerset Road. 10. 11. 12. Approval of final map and directing its recordation for Tentative Parcel Map 89-18, Rancho Arbolitos, Standard Pacific, Inc., applicant; located on the east side of Palisades Drive between Silverset and Pequot, and adoption of Resolution No. 9D-198 entitled, "A Resolution of the City Council of the City of Poway, California, Ordering the Expansion of Poway Landscape Maintenance Assessment District No. 83-01 With Written Consent of All Property Owners." Award of bid in the amount of $21,455 for Community Park pre-school playground equipment to Kompan, Inc. Adoption of Resolution No. P-90-74 entitled, "A Resolution of the City Council of the City of Poway, California, Providing Procedural Direction to City Staff Concerning the Processing of the CalMat Conditional Use Permit Application." {Confirming action taken on September 18, 1990, in regards to Conditional Use Permit 89-05.) 12.1 Release of grading securities for Pomerado Business Park, Phase II, G-473-88, Tentative Tract Map 85-04, CF Pomerado Inc., applicant. 12.2 Receive and file report regarding capital facility accounts pursuant to Government Code §66006{a). 12.3 Authorization to expend $11,000 in Transit Development Act Grant funds for a City-wide bicycle safety program. 12.4 Rejection of all bids and authorization to rebid for operation of the concession at the Poway Performing Arts Center. Motion carried unanimously, with Councilmember Goldsmith abstaining on Item 12. 3926 Page 3 - CITY OF POWAY - October 2, 1990 ITEM 4 CONDITIONAL USE PERMIT gO-O9/VARIANCE 90-09/ AND DEVELOPMENT REVIEW 90-11 APPLICANT: MOBIL OIL Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request to construct a gas station, car wash and snack shop at 14863 Pomerado Road in the Twin Peaks Plaza Shopping Center. The applicant proposes 24-hour operation and is requesting a variance to allow a total of four ground signs for the shopping center where three is the maximum permitted. Staff recon~mends approval. Speaking in favor of staff recommendation: Ken Huepper, 18634 Lancashire Way, San Diego, representing Mobil Oil, requested modification of the conditions of approval to delete the Twin Peaks Center logo from the ground sign. Speaking in opposition to staff recommendation: Annette Warren, 12337 Colony Drive Bonnie Palmer, 12333 Colony Drive Betty Plunkett, 14877 Sunrise Drive Jamina Sztechmiler, 14706 Pomerado Road Ted Sztechmiler, 14706 Pomerado Road Those speaking in opposition expressed concern regarding 24-hour operation, increased noise and trafffic impacts. Following discussion, motion by Councilmember Brannon, seconded by Councilmember Kruse, to close the public hearing, issue a Negative Declaration with mitigation measures, and adopt Planning Resolution No. P-go-75 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Conditional Use Permit 90-09, Variance 90-Og, Development Review 90-11, and Comprehensive Sign Plan 87-02R, Assessor's Parcel Number 314-710-17," as amended to delete logo from ground sign, and requiring staff to conduct a review after 6 months of operation. Motion carried 4-0, with Councilmember Emery absent. ITEM 5 TENTATIVE TRACT MAP 88-06 TIME EXTENSION APPLICANT: RICHARD & ALLAN KUEBLER Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request for a one-year time extension for Tentative Tract Map 88-06 dividing 7.1 acres into 5 lots and one remainder parcel located on the north side of Hidden Valley Drive between Sycamore Valley Drive and Birch Lane. Staff recommends approval. There was no one present wishing to speak. 3927 Page 4 - CITY OF POWAY - October 2, 1990 Motion by Councilmember Brannon, seconded by Councilmember Goldsmith, to close the public hearing and adopt Planning Resolution No. P-90-76 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Tract Map 88-06TE, Assessor's Parcel Number 323-071-06." Motion carried 4-0, with Councilmember Emery absent. ITEM 6 REQUEST FOR ONE-YEAR TIME EXTENSION FOR GENERAL PLAN UPDATE & 1991 PRIVATELY-INITIATED REQUESTS Mayor Hlgginson opened the public hearing. Staff report by City Manager Bowersox. This is a City-initiated request to the State Office of Planning and Research for a one-year time extension for the adoption of the Updated General Plan. This will allow for the completion of the Housing Element, with adoption of the Updated General Plan anticipated by July 1, 1991. Staff recommends approval. There was no one present wishing to speak. Motion by Councllmember Brannon, seconded by Counctlmember Goldsmith, to close the public hearing, and adopt Resolution No. 90-199 entitled, "A Resolution of the City Council of the City of Poway, California, Pursuant to Section 65361 of the California Government Code - Application Request for a One-Year General Plan Update Time Extension, City of Poway: Applicant." Motion carried 4-0, with Councilmember Emery absent. ITEM 6.1 SOLID WASTE MANAGEMENT AND RECYCLING City Manager Bowersox stated that at the June 14, 1990 workshop, Council directed staff to report back on alternative sites for the Poway High Band Boosters recycling program and the household hazardous waste program. Alan Archibald, Public Services Director, reviewed the two sites identified as the best alternatives: 1) the old County dump site off Poway Road, west of Espola Road, and 2) the County Public Works yard at Pomerado and Oak Knoll Roads. Staff has also been working with the AB 939 Technical Advisory Committee to for- mulate a County-wide Integrated Waste Management Plan {IWMP). The state deadline for completing the IWMP is July 1, 1991. Following completion, staff will report on recommendations for curbside recycling, recycling center sites and funding sources. Speaking in favor of staff recommendation: John Baildon, 12709 Corte Rayito, representing Poway High Band Boosters, stated they have received a grant for education efforts and would like to work with the city in education and relocation efforts. Following discussion, motion by Councllmember Kruse, seconded by Councilmember Brannon, to direct staff to work with the County for locating a household recycling program at the Oak Knoll site, while pursuing the old County dump site for recycling large waste products, and to include the music boosters in the planning process. Motion carried 4-0, with Councilmember Emery absent. 3928 Page 5 - CITY OF POWAY - October 2, 1990 ITEM 6.2 STATUS OF WATER CONSUMPTION AND PROVIDING WATER TREATMENT FOR OTHER AGENCIES In Councilmember Emery's absence, Mayor Higginson requested that this item be continued to October 16, 1990. Motion by Councilmember Kruse, seconded by Councllmember Brannon, to continue to October 16, 1990. Motion carried 4-0, with Councilmember Emery absent. ITEM 14 CITY ATTORNEY ITEMS Ae City Attorney Eckis stated he is requesting a closed session under Government Code §54956.9{A) to discuss pending litigation, Laugen vs. City of Poway. B. City Attorney Eckis stated he is requesting a closed session under Government Code §54956.9{c) to discuss whether to initiate litigation. Ce City Attorney Eckis stated he is requesting a closed session under Government Code §54956.8 to give instructions to negotiator regarding terms and conditions for acquisition of Poway Royal Mobile Estates. The nego- tiators will be the City Attorney and City Manager on behalf of the City, and Charles Black, the attorney of record for the present owner of the mobile home park. CITY COUNCIL-INITIATED ITEMS 19. A. Mayor Higginson requested comments from Councilmembers regarding Council employees by October 5, 1990. BJ Mayor Higginson stated that the appointments to the Library Advisory Committee would be made at the October 9, 1990 City Council meeting, and requested Councilmembers get their appointments to him. CLOSED SESSION Mayor Higginson called for a closed session at 8:24 p.m. as requested by the City Attorney.
