The October 9, 1990, regular meeting of the City Councll of the City of
Poway was called to order at 7:03 p.m. by Mayor Higginson at the City Council

E. Neil Larson, 14643 Espola Road, asked about the status of eliminating
Espola Road as a truck route.
Susan Sheldon, 13411 Starridge Street, spoke regarding gated pedestrian
trail between Silverlake Drive and Celestial Road, and asked that it be
opened.

CONSENT CALENDAR
Motion by Councllmember Emery, seconded by Councilmember Kruse to approve the
Consent Calendar as follows:
6. Ratification of Warrant Register - September 20, 1990.

Adoption of Resolution No. 90-200 entitled, "A Resolution of the City
Council of the City of Poway, California, Establishing a No Parking Zone
Along Portions of Sycamore Avenue Adjacent to Old Poway Park Southerly of
Aubrey Street." {Council received testimony on this item following Item 5
in the meeting.}
8. Approval of appropriation of $136,040 for the completion of the design and
construction of the Future Farmers of America facility at Lake Poway.
10. Receive and file report regarding summary of California Legislature's 1990
Session.

Approval of temporary use and rental of vacant City owned property for the
sale of pumpkins, located on Poway Road between Midland Auto and Poway
Dodge {TUP 90-65, applicant; Kent Stromberger).
Motion carried unanimously.
ITEM 4
ACQUISITION OF POWAY ROYAL MOBILE ESTATES
Staff report by Assistant City Manager Fitch. City staff and representatives of
the owner of Poway Royal Mobile Estates have reached a tentative agreement for
the purchase of the mobile home park. The final documents, including an
agreement of purchase and sale, escrow instructions, and related exhibits, will
be presented for City Council approval at the October 16, 199D meeting. Staff
recommends this item be continued to October 16, 1990.

Motion by Councilmember Emery, seconded by Councilmember Brannon, to continue
this item to October 16, 1990. Motion carried unanimously.
ITEM 5
RENT CONTROL ALTERNATIVES
Assistant City Manager Fitch stated that at the September 11, 1990 meeting,
residents of the Poway Royal Mobile Estates requested the City Council consider
a rent rollback or rent control measures. Staff was directed to bring back a
report regarding the options if a negotiated purchase could not be reached. The

negotiations for the purchase of Poway Royal Mobile Estates have progressed,
therefore, rent control measures would not be necessary. Staff recommends this
report be received and filed.

ITEM 7
PARKING CONTROL FOR SYCAMORE AVENUE
Mayor Higglnson stated that request to speak slips from the public were
overlooked before approval of the Consent Calendar and that this item was part
of that approval.
The following speakers addressed the Council:
Denise Hankins, 14146 Sycamore Avenue
William Holgren, 14152 Sycamore Avenue
Residents requested Sycamore Avenue not be paved, but that the dirt surface be
repaired as it was prior to the construction of Old Poway Park improvements, and
requested residents only parking on the west side of Sycamore Avenue.
Assistant City Manager Fitch stated staff will meet with all the residents and
report back to Council at the October 30, 1990 meeting.
CITY MANAGER ITEMS
11. Assistant City Manager Fitch stated that the report regarding the status of
the opening of Pomerado Road will be heard October 16, 1990.

Assistant City Manager Fitch stated that he is requesting a closed session
under Government Code §54956.9{c) to determine whether to initiate litiga-
tion.
ITEM 12
CITY ATTORNEY ITEMS
City Attorney Eckis stated he is requesting a closed session under Government
Code §54956.8 to give instructions to negotiator regarding terms and conditions
for acquisition of Poway Royal Mobile Estates. The negotiators will be the City
Attorney and City Manager on behalf of the City, and Charles Black, the attorney
of record for the present owner of the mobile home park.

13. Councilmember Brannon stated that the trucks on Poway Grade are being
discourteous again.
14. Councilmember Emery requested staff report back on letters received con-
cerning the Carriage Road speed humps.
16. Councilmember Kruse requested staff report back regarding
assistance from the City and Poway Unified School District

17. Mayor Higglnson announced the followlng appointments to the Library Advisory
Committee: Chris Ferguson, Barbara Nobrlega (Higginson); Tom Hynes
(Brannon); Bill Crawford (Emery); Cynthia Jahns (Goldsmith); Larry Cruse
(Kruse); and Susan Sheldon (Friends of the Library).
Mayor Higginson called for a closed session at 7:50 p.m. as requested by the
Assistant City Manager and the City Attorney. Mayor Higginson called the
meeting back to order at 8:15 p.m., with all Councilmembers present, and stated
that no action was taken in closed session on litigation, and that Council
gave instructions to their negotiator.
