The November 8, 1990, meeting of the City Council of the City of Poway,
adjourned from the November 6, 1990, regular meeting, was called to order at
4:47 p.m. by Mayor Higginson at the City Council Chambers, 13325 Civic Center
Drive, Poway, California.

Mayor Higglnson explained the procedure for Public Oral Communications. There
was no one present wishing to speak.

CITY ATTORNEY ITEMS
Mayor Higginson stated they would consider these items out of order.
City Attorney Eckis stated he would request Items 4A and 4B regarding litigation
with San Marcos Development and a property exchange and settlement agreement be
continued to November 13, 1990. Motion by Councilmember Emery, seconded by
Councilmember Goldsmith to continue these items to November 13, 1990. Motion
carried 3-0 with Councilmembers Brannon and Kruse absent.
City Attorney Eckis requested the City Council adjourn into closed session to
determine whether to initiate litigation pursuant to Government Code 54956.9{c).

Mayor Higginson called for a closed session pursuant to the City Attorney's
request at 4:51 p.m.
CALL TO ()RDER
Mayor Higginson called the meeting back to order at 5:17 p.m. and announced that
the City Council had taken action during closed session to instruct the City
Attorney to file legal action regarding the opening of Pomerado Road.
ITEM 3
POWAY ROYAL MOBILE ESTATES
Staff report by City Manager Bowersox. He reviewed the calendar of events to
close of escrow and sale of bonds and stated the action required today is
setting a rent amount to be used in the bond documents. The issues of park
ownership, park management, and use of low and moderate income funds will not be
discussed at this point, but will be addressed following the bond sale. At this
point, all options are open and will remain so until low and moderate funds are
put into this project. Staff is amending the recommendation in their report to
a rent of $425 to be frozen until January 1, 1992. Tenants with rents above
this amount will have their rent lowered to $425. Tenants paying less will
remain at their current rent. New tenants coming into the park will pay $425.
This rent includes the sewer and capital improvement charge. This will give
staff and Council time to address all the other issues.
Speaking for the park residents:
Bill Ghiselin, 13046 Bonita Vista
David Rinaldo, 13035 Corona Way
Speakers requested that rents remain affordable; stated that the current owners
have stopped doing any maintenance in the park; requested that staff look at
limited equity cooperative as one of the means of ownership; and requested more
informal workshops with Council.
Council discussion included the suggestion to form a subcommittee of the Council
to meet with staff and the residents and assurances that the City is very con-
cerned over keeping affordable housing available.
(Mayor Hlgginson left the meeting at 6:20 p.m. during the Council's discussion.)
Motion by Councilmember Brannon, seconded by Councilmember Emery, to retain
rents at current level for those paying less than $425, to establish rents of
$425 for those paying more and those coming into the park until January 1, 1992;
direct staff to initiate a rule requiring all new park residents to have incomes
less than 120 percent of the San Diego County median income for their household
size; direct staff to study issues connected with park ownership, management and
financing and recommend a subsidy program; meet with park residents as
appropriate. Motion carried 3-0 with Mayor Higginson and Councilmember Kruse
absent.
