The December 4, 1990, regular meeting of the City Council of the City of
Poway was called to order at 7:01 p.m. by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

GENERAL MUNICIPAL ELECTION
Mayor Higginson thanked his family, Council and staff for their help and support
during his term as Mayor.
Councilmember Kruse, in his closing remarks as Councilmember, also thanked his
wife and daughter, and stated he was pleased to have served for the past eight
and one-half years and will continue to remain active through community involve-
ment.

Councilmember Brannon, in her closing remarks as Councllmember, stated she will
continue to serve the community through issues and goals she has worked on over
the past four years as a Councilmember, and thanked her family, Council and
staff for their help and encouragement.
City Clerk Wahlsten reported the results of the November 6, 1990 General
Municipal Election held to elect a Mayor and two members of the Council for
four-year terms. She stated that the total number of votes cast was 15,233
out of 23,386 registered voters. The candidate for Mayor receivlng the
highest number of votes was Jan Goldsmith, 8,854. The two candidates for
City Council receiving the highest number of votes were B. Tony Snesko,
7,515; and Don Higginson, 6,713.

Motion by Councilmember Kruse, seconded by Councilmember Brannon, to adopt
Resolution No. 90-217 entitled, "A Resolution of the City Council of the
City of Poway, California, Reciting the Fact of the General Municipal
Election Held in Said City on November 6, 1990, Declaring the Result Thereof
and Such Other Matters Are Provided by Law." Motion carried unanimously.

City Clerk Wahlsten stated that, as a result of the election of a Mayor at
the November 6, 1990 general municipal election, there is a two-year Council
term that is vacant. The Council has thirty days from the commencement of
the vacancy to either fill by appointment for the balance of the term or by
calling for a special election. She declared that a vacancy now exists
on the Council.
Mayor Goldsmith presented Councilmember Higginson a plaque signed by all
Councilmembers in appreciation of his leadership role during his term as
Mayor.
City Clerk Wahlsten presented the Mayor's scrapbook to Councilmember
Higginson for his term as Mayor from December 5, 1989 to December 4, 1990.
City Clerk Wahlsten administered the Oaths of Office and presented
Certificates of Election to Mayor Jan Goldsmith, and Councilmembers Don
Higginson and Tony Snesko.

Motion by Counci]member Higginson, seconded by Councllmember Snesko, to
nominate Councilmember Emery for Deputy Mayor. Motion carried 4-0, with
one seat vacant.
ITEM 4
FILLING COUNCIL VACANCY
Mayor Goldsmith requested public testimony only to address the method of filling
the vacancy, either appointment or special election, not who should fill the
seat.

Following discussion, motion by Councilmember Emery, seconded by Councilmember
Higginson, to fill the vacancy by appointment; direct the City Clerk to accept
applications consisting of a resume with a cover letter from qualified citi-
zens until noon, Monday, December 10, 1990; to schedule a workshop session to
interview the applicants for 4:30 p.m., Monday, December 10, 1990; and to place
this item on the December 11, 1990 agenda for a possible appointment. Motion
carried 4-0, with one seat vacant.

Mayor Goldsmith explained the procedure for Public Oral Communications. There
was no one present wishing to speak.
CONSENT CALENDAR
Motion by Councilmember Emery, seconded by Councilmember Higginson to approve
the Consent Calendar as follows:

10. Ratification of Warrant Register - November 15, lggo
12. Acceptance of public improvements and release of securities, Chabad
Lubavitch, applicant; located on a one-acre triangular site between Old
Espola and Espola Roads.

Approval of temporary use of City owned property; located on Poway Road
between Midland Auto and Poway Dodge for the sale of Christmas trees. {TUP
90-79, Stromberger; applicant.)
12.2 Approval of revisions to membership and duties to the Community Swim Task
Force {referred from November 27, 1990, Item 25.1).
Motion carried 4-0, with one seat vacant.
ITEM 6
ORDINANCE NO. 326 - SECOND READING
PERS CONTRACT AMENDMENT
Mayor Goldsmith read the title of Ordinance No. 326, "An Ordinance of the City
of Poway, California, Authorizing an Amendment to the Contract Between the City
Council and the Board of Administration of the California Public Employees'
Retirement System."

City Manager Bowersox stated that this is second reading for an ordinance which
is necessary to amend the contract with the Board of Administration of the
Public Employees' Retirement System (PERS} for the 1959 Survivor Benefit program
for non-safety employees.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Higginson, to close the
public hearing, waive further reading and adopt Ordinance No. 326. Motion
carried 3-0 on a roll call vote, with Councilmember Snesko abstaining and one
seat vacant.
ITEM 7
AIRPORT TRANSPORTATION SERVICE FEES
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. The Poway Airport Transportation Service is operated on a user-rider
subsidy basis. The City pays a portion of the fare for each rider. An increase
in ridership above the budgeted level results in an increased financial subsidy.
Staff has reviewed the ridership for the last quarter and found that it has
increased 40 percent. Staff recommends adopting increased Airport
Transportation Service fees to cover an expected deficit of $43,365 for the
remaining fiscal year for single passengers from $10 to $15, and a 10 percent
increase on all other fares.

Motion by Councilmember Emery, seconded by Councilmember Higginson, to close the
public hearing and adopt Resolution No. 90-218 entitled, "A Resolution of the
City Council of the City of Poway, California, Approving Increase in Fares for
Poway's Airport Transportation Service and Rescinding Resolution No. 88-042."
Motion carried 4-0, with one seat vacant.
ITEM 7.1
REQUEST FOR REHEARING
TENTATIVE TRACT MAP 89-09/WILLIAMS RANCH
Staff report by City Manager Bowersox. On November 20, 1990, the City Council
approved Tentative Tract Map 89-09 for Williams Ranch, located at the western
end of Del Poniente Road and contiguous with the north facing slopes of Twin
Peaks. On November 30, 1990, a request for rehearing was filed in the City
Clerk's office. Staff recommends continuing the request for rehearing to the
December 18, 1990 meeting to provide sufficient time for preparation of a
report.

this item to December 18, 1990. Motion carried 4-0, with one seat vacant.

CITY ATTORNEY ITEMS
City Attorney Eckis stated that the City of San Diego has filed a response to
Poway's writ of mandate regarding Pomerado Road and requested a closed session
be held at the December 10, 1990 workshop.
CITY COUNCIL-INITIATED ITEMS
18. Mayor Goldsmith appointed Councilmembers Emery and Higginson to the Swim
Center Task Force.
