Bill Barnick, 14645 Sunrise Canyon Road, spoke regarding the inequity of Landscape Maintenance District assessments and requested a refund. 2. Mike Fry, 12819 Selma Court, spoke regarding vernal pools on the former State Lands parcel in Rancho Arbolitos, and questioned the issuance of a Negative Declaration for Tentative Tract Map 89-15 on February 27, 1990. 3. Councilmember Goldsmith introduced Monica Parisi, on-site naturalist for Blue Sky Ranch, from the California Department of Fish and Game. CONSENT CALENDAR Mayor Higginson stated that Item 16 was pulled from the Consent Calendar by the public. Motion by Councilmember Emery, seconded by Councilmember Goldsmith to approve the Consent Calendar as follows: 13. Motion carried unanimously. 3715 Page 3 - CITY OF POWAY - April 3, 1990 ITEM 4 ORDINANCE NO. 313 - SECOND READING ZONING ORDINANCE AMENDMENT 90-01 Mayor Higginson read the title of Ordinance No. 313, "An Ordinance of the City of Poway, California, Adding Section 17.10.080.31 of the Poway Municipal Code to allow Home Improvement Centers, including those which incorporate Lumber Yards, in the Commercial General {CG} Zone by Conditional Use Permit {ZOA 90-01}." City Manager Bowersox stated that this amendment would allow Dixieline Lumber to open a home improvement store with an outdoor lumberyard as a legal, conforming use on the Poway Road site vacated by Western Lumber. There was no one present wishing to speak. Motion by Councllmember Emery, seconded by Councilmember Goldsmith, to close the public hearing, waive further reading and adopt Ordinance No. 313. Motion carried unanimously on a roll call vote. ITEM 4.1 ORDINANCE NO. 312 - SECOND READING SOUND AMPLIFICATION SYSTEMS Mayor Higginson read the title of Ordinance No. 312, "An Ordinance of the City of Poway, California, Adding Section 8.08.140(C).11 to the Poway Municipal Code Prohibiting the Operation of Sound Amplification Systems which Can be Heard from 150 Feet or More from a Vehicle." City Manager Bowersox stated that this is the second reading for Ordinance 312, as revised to prohibit amplified sound from vehicles which could be heard from 150 feet or more. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Kruse, to close the public hearing, waive further reading and adopt Ordinance No. 312. Motion carried unanimously on a roll call vote. ITEM 4.2 DEVELOPMENT REVIEW 89-33/VARIANCE 90-02 APPLICANT: REEDER DEVELOPMENT, INC. Mayor Higginson stated this public hearing was continued from March 27, 1990 City Council meeting. Introduction by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This is a development review for 15 single-family homes within TTM 87-06; located at the western terminus of Cicero Way. Variances are requested to allow the single-family homes to observe 3716 Page 4 - CITY OF POWAY - April 3, 1990 a six-foot rear yard setback adjacent to the existing condominium project where 15 feet is required, to observe a 15 foot building setback from adjacent single- family zones where 50 feet is required, and to reduce the required setback bet- ween buildings from 25 feet to 15 feet. The setback variances will permit flexibility within the development standards for the underlying Residential Condominium zone. Staff recommends approval. Speaking in favor of staff recommendation: Don Ayles, ERB Engineering, 14005 Midland Road, applicant's engineer. Motion by Councilmember Kruse, seconded by Councilmember Goldsmith, to close the public hearing, and adopt Planning Resolution No. P-90-24 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Development Review 89-33 and Variance 90-02, Assessor's Parcel Number 323-201-13, 17." Motion carried 4-1, with Councilmember Emery voting "no." ITEM 4.3 ORDINANCE NO. 314 - FIRST READING USES ALLOWED BY SPECIFIC PLANS/ZOA 90-02 Mayor Higginson read the title of Ordinance No. 314, "An Ordinance of the City of Poway, California, Amending Poway Municipal Code Section 17.47.060.A Concerning Uses Allowed by Specific Plans {ZOA 90-02}." City Manager Bowersox stated that first reading was continued from the March 27, 1990 City Council meeting to revise the Ordinance in response to concerns expressed by residents regarding allowed uses in other specific plan areas within the City. Staff recommends approval of a revision which would limit the change to the Old Poway Specific Plan area. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Kruse, to waive further reading of Ordinance 314, as revised to limit the change to the Old Poway Specific Plan area, issue a Negative Declaration, and continue the public hearing to April 17, 1990 for second reading. Motion carried unanimously. ITEM 5 TENTATIVE TRACT MAP 87-10 TIME EXTENSION APPLICANT: RAY L. HUFFMAN, INC. Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request for a one-year time extension for a 48 unit con- dominium project on 4 acres located at the southwest corner of Scots Way and Midland Road. Staff recommends approval with a revision to require the building plan check within 18D days rather than 60 days. There was no one present wishing to speak. 3717 Page 5 - CITY OF POWAY - April 3, 1990 Motion by Councilmember Goldsmith, seconded by Councilmember Emery, to close the public hearing, and adopt Planning Resolution No. P-90-25 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Tract Map 87-10TE, Assessor's Parcel Number 317-111-06, 314-23D-49 and 52, as revised regarding building plan check change within 180 days. Motion carried unanimously. ITEM 6 TENTATIVE PARCEL MAP 89 02 AMENDMENT APPLICANT: JAY & SANDY GELB Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This is a request for an amendment to a condition of approval requiring undergrounding of utilities for Tentative Parcel Map 89-02, two lots located on the west side of Tierra Bonita Road between Twin Peaks Road and Donart Drive, approved by the City Council on April 11, 1989. The conditions require removal of two utility poles along Tierra Bonita Road, a Circulaton Element collector road, prior to completing the final parcel map. The zoning code has no provisions for a waiver of undergrounding requirements for sub- divisions along Circulation Element roads or highways. Staff recommends denial. Speaking in opposition to staff recommendation: Jay Gelb, 14258 Tierra Bonita Road, requested a waiver of the undergrounding requirement, and stated he would be willing to sign a deed covenant placing in effect a provision that he would not oppose the formation of any future undergrounding district. Following discussion, motion by Councilmember Emery, seconded by Councilmember Brannon, to continue this item to May 1, 1990, and direct staff to prepare a revision to the criteria established for the waiver of undergrounding of uti- lities which would permit a waiver for this type of request. Motion carried unanimously. ITEM 7 CONDITIONAL USE PERMIT 90-03/MINOR DEVELOPMENT REVIEW 90-18 APPLICANT: BILL & NANCY SPERRY Mayor Hlgginson opened the public hearing. Staff report by City Manager Bowersox. This is a request for a single-family home with an attached accessory apartment on 8 acres north of Thompson Creek in the Old Coach area at 18575 Wild Horse Creek. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Brannon, seconded by Councilmember Kruse, to close the public hearing, and adopt Planning Resolution No. P-90-26 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Conditional Use Permit 90-03 and Minor Development Review 90-18, Assessor's Parcel Number 277-020-21." Motion carried unanimously. 3718 Page 6 - CITY OF POWAY - April 3, 1990 ITEM 8 ORDINANCE NO. 315 - FIRST READING PERS CONTRACT AMENDMENT Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This action is necessary to amend the contract with the Board of Administration of the Public Employees' Retirement System {PERS) for an enhanced retirement benefit formula of 2% at 50 full formula for local safety members. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Kruse, to adopt Resolution No. 90-074 entitled, "A Resolution of Intention of the City Council to Approve an Amendment to Contract Between the Board of Administration of the Public Employees' Retirement System and the City of Poway." Motion carried unanimously. Mayor Hlgginson read the title of Ordinance No. 315, "An Ordinance of the City of Poway, California, Authorizing an Amendment to the Contract Between the City Council and the Board of Administration of the California Public Employees' Retirement System." Motion by Councilmember Emery, seconded by Councilmember Kruse, to waive further reading of Ordinance No. 315 and continue the public hearing to April 24, 1990, for second reading. Motion carried unanimously. ITEM 9 REPORT REGARDING INFO LINE Staff report by City Manager Bowersox. On March 6, 1990, Council requested staff report on a request received from San Diego City Councilmember Ron Roberts for funding to support INFO LINE, a social services information and referral service provided by the United Way, City of San Diego, and County of San Diego. Each City in the County has been asked to consider supporting this service. In the past, it has not been the policy of the City to fund social services, which are most appropriately funded by the County. Staff recommends that Council receive and file the report. Council concurred to receive and file the report. ITEM 10 RESERVATION OF SEWER CAPACITY FOR GPA/ZC go-oiA; SP 8g-01; TTM 8g-13 OLD COACH GOLF ESTATES PROJECT APPLICANT: ENVIRONMENTAL DEVELOPMENT, LTD. Councilmember Kruse disqualified himself and left the room during this item. 3719 Page 7 - CITY OF POWAY - April 3, 1990 Introduction by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This item is in accordance with the Sewer Allocation Plan adopted on November 14, 1989, by Ordinance No. 304. Environmental Development, Ltd. is proposing a planned community development consisting of 157 single-family homes, a 3 acre mini-park, and a golf course with clubhouse faci- lities located on the north side of Espola Road, in the northern portion of the City, and requests that the Council determine that the project qualifies under five of the eight standards established for the issuance of sewer capacity from the Redevelopment Category. The five categories of public benefit have been identified as: 1) Category C, elimination of traffic circulation and flood control deficiencies; 2) Category E, provision of public improvements and faci- lities which address deficiencies affecting other developed properties within the project area; 3) Category F, elimination of blighted properties, structures, and conditions, 4} Category G, assistance to the Agency in meeting its financial obligations; and 5) Category H, assistance to the Agency in meeting the goals of the adopted Redevleopment Plan. Staff recommends that the City Council find that the project meets the standards established, and issue a statement of sewer availability from the Redevelopment Category for 181 units, representing 157 residential lots and an estimated 24 units for the clubhouse facility Speaking in favor of staff recommendation: Jim Shippey, 16957 Cloudcroft Drive Alan Sugarman, 13385 Fallen Leaf Road, representing the Green Valley Civic Association Jack Tripp, 16054 Stoney Acres Road Dan Wiberg, 13351 Stone Canyon Road John F. San Diego, representing Tony remaining capacity in the City Attorney Eckis recommended revising the resolution title from Approving the Issuance of Sewer Capacity to Issuing a Statement of Sewer Availability. Following discussion, motion by Councilmember Goldsmith, seconded by Councilmember Brannon, to adopt Resolution No. 90-075 entitled, "A Resolution of the City Council of the City of Poway, California, Approving the Issuance of a Statement of Sewer Availability from the Redevelopment Projects Category as Described in Ordinance No. 304 for the Proposed Old Coach Golf Estates Project {GPA/ZC 90-01A, SP 89-01, TTM 89-13}." Motion carried 3-1-1, with Councilmember Emery voting "no," and Councilmember Kruse abstaining. (Councilmember Kruse re-entered the meeting at this time.) 3720 Page 8 - CITY OF POWAY - April 3, 1990 RECE,~ AgO ~,ALL TO ~DER Mayor Higginson recessed the meeting at 8:51 p.m., and called it back to order at 8:59 p.m., with all Councilmembers present except for Councilmember Brannon. ITEM 11 FORMATION OF COMMUNITY FACILITIES DISTRICT 90-1 TECH BUSINESS CENTER/SOUTH POWAY Staff report by City Manager Bowersox. The developers and owners of the Tech Business Center in South Poway have filed petitions requesting that the Council authorize the formation of a Community Facilities District for the 195.5 acre, 71 lot industrial park located south of South Poway Parkway and east of Nelson Drive. The purpose of the district is to provide for the issuance of up to $22,000,000 in bonds to finance public improvements required under conditions of approval for Tentative Tract Map 8g-DB. Staff recommends approval of a Resoluton of Intention to Form the District and a Resolution of Intention to Incur Bonded Indebtedness. These resolutions require that a public hearing be set for May 8, 1990, to accept public testimony, including testimony from pro- perty owners within the proposed district. Staff recommends approval. Motion by Councllmember Emery, seconded by Councilmember Goldsmith, to adopt Resolution No. 90-076 entitled, "A Resolution of Intention of the City Council of the City of Poway to Establish Community Facilities District No. 90-1 of the City of Poway and to Authorize the Levy of a Special Tax within Community Facilities District No. 90-1 of the City of Poway {Tech Business Center)." Motion carried 4-0, with Councilmember Brannon absent. Motion by Councilmember Emery, seconded by Councilmember Kruse, to adopt Resolution No. 90-077 entitled, "A Resolution of Intention of the City Council of the City of Poway to Incur Bonded Indebtedness in the Amount of $22,000,000 within Proposed Community Facilities District No. 90-1 of the City of Poway {Tech Business Center)." Motion carried 4-0, with Councilmember Brannon absent. (Councilmember Brannon re-entered the meeting at 9:03 p.m.) ITEM 12 ESPOLA ROAD TRUCK ROUTE STUDY City Manager Bowersox stated that the Council continued this item from the March 20, 1990 meeting, and directed staff to prepare a report regarding the impact of Proposition 111 {State Constitutional Amendment 1) which will appear on the June 1990 ballot. If adopted, SCA i would become effective on July 1, 1990, and would limit a City's ability to restrict truck traffic in their jurisdiction. If the Council desired to place restrictions on truck traffic, an environmental study would have to be conducted. The Transportation Task Force has requested that they have an opportunity to review the analysis of SCA i prior to any action being taken. City Attorney Eckis stated that in order to preserve any options the City may have, he would recommend that the Council direct staff to conduct an Initial Study on the elimination of Espola Road as a truck route from north of Twin Peaks Road to the west City limits. 3721 Page 9 - CITY OF POWAY - April 3, 1990 Motion by Councilmember Emery, seconded by Councilmember Goldsmith, to refer the Espola Road truck route study to the Transportation Task Force for their review, and direct staff to prepare an initial study on the elimination of Espola Road as a truck route. Motion carried unanimously. ITEM 12.1 CHANNEL IMPROVEMENTS AT HALEY TRUST PROPERTY Staff report by City Manager Bowersox. At the January 4, 1990 meeting, the City Council directed staff to further analyze creek improvement options for the Poway Creek channel which bisects the Haley site, located on the south side of Poway Road between Community and Midland Roads. Council expressed concern regarding the loss of mature trees within and adjacent to the channel with the proposed improvement plan to meet Federal flood standards, and appointed a two- member City Council subcommittee to review the alternatives prior to bringing this issue back with their recommendations. Following review by staff and the City Council subcommittee, staff recommends that the existing channel be widened to meet 1OD-year flood standards, require that the trees on the north side of the channel remain, and that the south side of the channel be landscaped with mature trees that are indigenous to the area. Speaking in favor of staff recommendation: Joe St. Lucas, 13033 Earlgate Court Motion by Councilmember Emery, seconded by Councilmember Goldsmith, to approve staff recommendation. Motion carried unanimously. ITEM 16 MINOR DEVELOPMENT REVIEW 90-11 APPLICANT: MIKE & MELINDA LASATER Mayor Higginson stated that this item was pulled from the consent calendar by the applicant. Staff report by City Manager Bowersox. This is a request for a detached guest/pool house and a large addition to the rear of an existing single-family house at 16222 Coyote Creek Trail. Staff recommends approval. Speaking Mike in favor of staff recommendation: Lasater, 16222 Coyote Creek Trail, requested revisions to conditions of approval requiring: pro-rata contribution for future area roadway improvements; paving for private driveway; and a 10,000 gallon water tank for fire suppression. He requested that his pool serve as storage for fire suppression. Roger Mohling, 13911 York Avenue, applicant's architect, requested clarifi- cation of undergrounding requirements. At Council's request, the applicant signed a waiver of 60-day time limit requiring City Council action under Municipal Code Section 17.52.060 and agreed to continue this item to April 24, 1990, to allow staff time to consider the applicant's questions. Motion by Councilmember Emery, seconded by Councilmember Kruse, to continue this item to April 24, 1990. Motion carried unanimously. 3722 Page 10 - CITY OF POWAY - April 3, 1990 CITY COUNCIL-INITIATED ITEMS 20. A. Councilmember Brannon stated that the Clean Water Program Governance Advisory Group's recommendation is to form a Special Act District based on the County Sanitation District structure. Council concurred to request staff report back at the April 17, 1990 meeting. Be Councilmember Brannon stated that she had received a request from San Diego City Councilmember Ron Roberts to support AB 2845 {Polanco) regarding control of the sale of fortified wines. Motion by Councilmember Brannon, seconded by Councilmember Emery, to adopt Resolution No. 90-078 entitled, "A Resolution of the City Council of the City of Poway, California, Supporting AB 2845, Regarding Control of Sale of Fortified Wines." Motion carried unanimously. 21. A. Councilmember Emery requested an increased anti-litter campaign be started, including additional trash receptacles at bus stops, upgrade dumping and litter signs, feature an anti-litter article in Poway Today, and coordinate activities with the Chamber of Commerce. Council concurred with Councilmember Emery's request. Council concurred with Councilmember Emery's request for a workshop to discuss standards for the development of mobile home parks. Councilmember Brannon also requested staff report back regarding a City's ability to control mobile home parks within their jurisdiction. Ce Councilmember Emery requested staff report back regarding the implica- tions of Proposition 111 {SCA 1) on the June 1990 ballot prior to the Council being requested to take a position. 22. A. Councllmember Goldsmith reported on the following items from SANDAG's March 23, 1990 meeting: SANDAG Board of Directors may take action on May 25, 1990, regarding their preferred site for airport relocation. AB 4242 (Brown} would create a regional agency for the purpose of preparing a Regional Plan with control over the local growth control decisions. Following discussion, motion by Councilmember Kruse, seconded by Councilmember Goldsmith, to adopt Resolution No. 90-079 entitled, "A Resolution of the City Council of the City of Poway, California, Opposing AB 4242, Regarding Regional Control Over Local Growth Control Decisions," and direct staff to send a letter requesting the League of California Cities to take a more aggressive position opposing regional control. Motion carried unanimously. 3723 Page 11 - CITY OF POWAY - April 3, 1990 ® Councilmember Goldsmith stated that SANDAG's report on the Regional Transportation Demand Management Program will be distri- buted in May. e Councilmember Goldsmith stated that the Board of Supervisors has asked each City to appoint a representative to the AB 939 Integrated Waste Management Plan Task Force by May 1, 1990. 23. Councilmember Kruse stated Espola Road east of Cloudcroft Drive is in need of repair. 24. B. Mayor Higginson stated that he will reschedule the designation of Chairperson and Vice-Chairperson for the Landscape Maintenance District Advisory Committee. Ae Mayor Higginson stated that the appointment of a representative to the Regional Growth Management Advisory Board was continued from the March 27, 1990 meeting. The following speakers addressed Council regarding the appointment of a repre- sentative: Alan Sugarman, 13385 Fallen Leaf Road, representing the Green Valley Civic Association, requested appointment of a Councilmember whose term will not expire this year. Larry Cruse, 13734 Utopia Road, representing the Poway Civic Association, stated that SANDAG recommends cities to appoint the Deputy Mayor officeholder. Following lengthy discussion, motion by Councilmember Kruse, seconded by Councilmember Emery, to appoint Councilmember Goldsmith as the City's representative to the Regional Growth Management Advisory Board. Motion carried 3-1-1, with Councilmember Brannon voting "no," and Mayor Higginson abstaining. Upon motion by Councilmember Emery, seconded by Councilmember Kruse, Mayor Higginson ordered the meeting adjourned to 4:30 p.m., Thursday, April 5, 1990.
