Ord 74ORDINANCE NO. 74 AN ORDINANCE OF THE CITY OF PO~AY, CALIFORNIA ~MENDING TITLE 8 OF THE CITY OF PO~AY Rt~GULATf~Y CRDINANC~q_, (ZONING AND IAND USE RMSULATIONS ) p~.IATING TO OONSTRUCTION STANDARDS FCR STgk~TS, INCORPORATING AND ~W.qCINDING RESOLUTIONS 231, 241 AND 242 THE CITY COUNCIL OF THE CITY OF PO~AY DOES ORDAIN AS FOLTO~S: Section 1: Dedicated andNon-DedicatedSemi-Rural and Urban Standards and Parking Lot Specifications. Ail dedicated and non-dedicated semi-rural and urban strccts and parking lots within the City of Poway, sb~ll be developed to the criteria set forth in Exhibits A and B, provided that this provision may be waived under appropriate circumstances. Section 2: Dedicated Rural Street Standards. Ail dedicated rural streets within the City limit lines, as noted on the adopted General Plan for the City of Poway, sb~ll be developed to the criteria set forth in Exhibit C, provided that this provision may be w~ived under appropriate circumstances. Section 3: Dedicated Rural Street Specifications. All dedicated rural streets within the City limit lines, as noted on the adopted General Plan for the City of Poway, shall be constructed in accordance with specifications set forth in Exhibit D, provided, however, that this provi- sion my be waived under appropriate circumstances. Section 4: Non-Dedicated Rural Street Standards. All non-dedicated rural strccts within the City limit lines, as noted on the adopted General Plan for the City of Poway, shall be developed to the criteria set forth in Exhibit E, provided, however, that this provision may be ~ived under appropriate circumstances. Section 5: Non-DedicatedRural Street Specification Ail non-dedicatedrural streets within the City limit lines, as noted on the adopted General Plan for the City of Poway, shall be constructed in accordance with specifications set forth in Exhibit F, provided, however, that this provi- sion may be waived under appropriate circumstances. Ordinance No. 74 Pa~e No. 2 Section 6: Non-Dedicated Streets: Maintenance A road construction and maintenance agreement, in a form satisfactory to the City Attorney, shall be executed by the developer and/or owner of any parcel serviced by a non-dedicated road as a condition of approval of any land divi- sion. If said construction and maintenance agreement exists for a non-dedicated street serving any parcel, the execution of said agre~nent will be a condition of issuance of any building permit or other permit or grant of improvement de- velopment approval for such parcel. Section 7: Resolutions 231, 241, and 242 are hereinafter repealed. Section 8: The provisions of this ordinance, insofar as they are substan- tially the same as existing provisions relating to the same subject matter, shall be construed as restatements and continuations thereof and not as new enactments. Section 9: Insofar as those street and roadway improvement standards con- tained within Title 8 of the City of Poway Regulatory Ordinances, including, but not limited to Sections 81.402, 81.402(b)(1)(i) and (2), and 81.703, are incon- sistent with those standards of improvement contained within this ordinance, the standards herein shall prevail and to the extent Title 8 is inconsistent with this ordinance, Title 8 is null end void. Section 10: This ordiD~mnce shall tmke effect thirty (30) days after adoption and shall within fifteen (15) days of adoption be published with the names of the Councils voting for and against the same in the Poway News Chieftain, a newspaper of general circulation, printed and circulated within the City of Poway. A semi-rural street shall serve residential areas with lot sizes from a 1/2 acre to 1 acre or densities of 1 unit to 2 units per acre. Ail streets shall be designed and constructed in accordance with the requirements of the City of Poway and the San Diego County Regional Standard Plans, unless otherwise approved by the City Engineer. Design speed shall be 25 miles per hour and the maximum street grade shall be sixteen percent, unless otherwise approved by the City Engineer. Street alignment and profile shall comply with the criteria for safe stopping sight distance in conformance with the California State Highway Design Manual unless special situations allow for modifications and such modifications are approved by the City Engineer. Non-dedicated streets should not be aligned between two dedicated streets so that the non-dedicated street would act as a "shortcut" between the streets. Structural sections shall be determined by the State of California Gravel Equivalent Hveem Stabilometer Method, using the R-value of the native soil and traffic indices established by the City. The minimum section shall be 3" A.C. over either 4" class II A.B. or 5" class III base. If the R-value of the existing native soil is 50 or greater, a minimum section of 4" A.C. over compacted sub-base may be substituted. Non-dedicated streets shall provide a paved travel way incorporating a pedestrian circulation system approve~ by the City Engineer. Entry gates into non-dedicated tracts shall be set back from the near curb line of any public street to provide a minimum storage of 75 feet for entering vehicles to stack without interfering with through traffic. Streets shall intersect at right angles wherever possible and shall not be greater than 15° skew to a right angle. Four-legged intersections should be avoided except at (future) signalized or controlled locations or where median islands are on the through street. The minimum distance between intersections shall be 150 feet. Street widths, geometric criteria, and structural section shall conform to Exhibit B. Local roads serve as primary access roadways to residential units and do not exceed the daily traffic shown on Exhibit B. Local collector roads service local road traffic by providing routes to the circulation system roads. Daily 14. Streets with grades over 10 percent may be required to be constructed of Portland cement concrete to the satisfaction of the City Engineer' (minimum thickness shall be 6") when necessitated by specific field conditions. The dedication reauirements of Resolution No. 184 shall apply to these provisions. A dedicated rural street shall serve residential areas with lot sizes greater than oQ~ acre or densities less than 1 unit per acre. 2. A nondedicated rural street shall serve residential areas with lOt sizes greater than one acre or densities less than 1 unit per acre and are con- fined within road easements not dedicated as a public road right-of-way. Ail streets shall be designed and constructed in accordance with the requirements of the City of Poway ~nd the San Diego County Regional Standard Plans, unless otherwise approved by the City Engineer. Design speed shall be 25 miles per hour and the maximum street grade shall be 20%, unless otherwise approved by the City Engineer because physical conditions make it impractical or unsafe to achieve these standards. Street alignment and profile shall comply with the criteria for safe stopping sight distance in conformance with the California State Highway Design Manual. Private streets should not be aligned between two public streets so that the private street would act as a "shortcut" between the streets. Structural sections for private streets shall be determined by the State of California Gravel Equivalent Hveem Stabilometer Method, using the R-value of the native soil and traffic indices established by the City. The minimum A.C. section shall be 2". Base material will not be required if the native soil has an R-value of 40 or greater. If the R-value of the native soil is less than 40, the minimum base section shall be 4" class III base. Any nondedicated street constructed under these standards shall remain nondedicated and maintained by the private property owners in a safe condition. Should the street be offered for dedication to the City at some future time, the right-of-way ~idths and improvements at the time of the offer shall be upgraded and improved to City Standards. Ail nondedicated streets shall be maintained in a safe condition by a private road maintenenace agreement in which all easement holders of the road are a party thereto and which maintenance agreement is approved by the City. if 0 0 ~ Z 0 o
