Communications. There ITEM 3 CONDITIONAL USE PERMIT 89-05 CALMAT-POWAY Item introduced by City Manager Bowersox. Staff report by Assistant City Manager Fitch and Assistant Director of Planning Services Streeter. On October 2, 1990, the City Council rescinded their approval of Conditional Use Permit 89-05 and directed staff to meet with CalMat to further analyze their proposal. Several citizens were invited to take part in these meetings and the city hired Kosmont & Associates, represented by Jim Rabe, for independent financial analysis; and Geotechnical Research and Development Company, represented by mining engineer Don Deem and mining geologist Mike Flynn, to analyze data regarding the size of project needed to be financially feasible. This workshop is a prelude to the March 5, 1991 public hearing. CalMat is currently operating under an extension of the County-approved Conditional Use Permit to March 26, 1991. 4064 Page 2 - CITY OF POWAY ADJOURNED REGULAR MEETING - February 7, 1991 The following persons spoke representing CalMat: William Schwartz, attorney, 401 "B" Street, San Diego Kent Sturgeon, project engineer, 6859 Federal Blvd., Lemon Grove Jock Scott, vice president of engineering, 3200 San Fernando Road, Angeles Dwight Beavers, vice president for Industrial Asphalt, wholly owned subsidiary of CalMat, 3200 San Fernando Road, Los Angeles Charles Strong, registered traffic engineer, 6241 Del Cerro Blvd., San Diego Ed Belt, vice president of San Diego region, P.O. Box 3098, San Diego Severo Chavez, project manager, P.O. Box 3098, San Diego John Mills, chief accounting officer, P.O. Box 3098, San Diego Los The speakers described the project being proposed, including an asphalt plant, and stated they did not perceive the meeting process as being negotiations for a smaller project, but rather full information on why the project needed to be as proposed. The following community representatives spoke: Jerry Hargarten, 13622 Orchard Gate Road Betty Rexford, 11570 Creek Road Randy Wilkins, 14617 Acton Court Mike Fry, 12819 Selma Court Steve Dalich, 11055 Beeler Canyon Road The speakers expressed concern that the City Council's direction was not followed in that there were no alternative projects proposed or analyzed and discussed their perceived negative impacts on the community from the requested project, including noise, odors, and truck traffic, particularly the impacts on the business park. Council expressed disappointment that the full financial data on various alter- natives was not available and concurred that the public hearing cannot be held until that data is available and has been analyzed. It was also agreed that the spring biological survey should be done prior to a public hearing to determine whether there are endangered species on site. Following discussion, motion by Councilmember Emery, seconded by Councilmember McIntyre to set the following schedule for this application: March 19, 1991, public hearing to extend existing conditional use permit; May 28, 1991, draft report for CUP 89-05 available; June 6, 1991, City Council workshop to discuss the report; June 14, 1991, final report available; June 25, 1991, public hearing on Conditional Use Permit 89-05. Motion carried unanimously. CLOSED SESSION Mayor Goldsmith adjourned the meeting into closed session to discuss pending litigation pursuant to Government Code Section 54956.9{a} at 10:30 p.m. 4065 Page 3 - CITY OF POWAY ADJOURNED REGULAR MEETING - February 7, 1991 P..ALL TO ORDER AND AI~IYJRNNENT Mayor Goldsmith called the meeting back to order at 10:55 p.m. with all Councilmembers present and announced no action had been taken in closed session. City Attorney Eckis announced that a lawsuit in the name of the Sierra Club was filed this morning against the city, requesting a temporary restraining order against the developer brushing the site in preparation for grading of the Old Coach Estates project. The TRO was denied on the grounds that the brushing was within the limits approved by the City Council and it will begin in the next few days. AI~OURNNENT Upon motion by Councilmember Hlgginson, seconded by Councilmember Snesko, Mayor Goldsmith ordered the meeting adjourned to 4:30 p.m., Thursday, February 14, 1991.
