A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
ORDERING THE EXPANSION OF POWAY
LANDSCAPE MAINTENANCE DISTRICT
AND CITY OF POWAY CITY LIGHTING DISTRICT, ZONES A AND C
WITH THE ANNEXATION OF APNs 317-480-10-00 and 317-480-13-00
WITH WRITTEN CONSENT OF PROPERTY OWNER, LESSEE, AND SUBLESSEE
WHEREAS, the City Council of the City of Poway desires to expand Poway
Landscape Maintenance District 86-3B as shown in Exhibit "A" of the Consent to
Annexation, attached hereto, for the purposes of maintaining, servicing, and operating said
District pursuant to the Landscape and Lighting Act of 1972, and its codicils; and
WHEREAS, the record owner of all the real property legally described as a
portion of the southwest quarter of the southeast quarter of Section 13, Township 14
South, Range 2 West, San Bernardino Meridian, according to the official plat thereof,
and Parcel 1 of Parcel Map No. 15715, filed in the office of the County Recorder of
San Diego County, June 21, 1989 as File No. 89-328217 of official records, all in the
City of Poway, County of San Diego, State of California, within said expansion area has
given written consent to the annexation into Poway Landscape Maintenance District 86-3B
• and Lighting District Zones A and C as shown in Exhibit "B" pursuant to California Streets
and Highway Code, Section 22608 1, and
WHEREAS, the public interest and convenience require the maintenance, service,
and operation of public landscape facilities within said territory; and
WHEREAS, the City Clerk of the City of Poway is hereby directed to record this
document with the County Recorder of the County of San Diego.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Poway
does hereby resolve as follows:
1 The foregoing recitals are true and correct, and the City Council so finds and
determines.
2. All of that certain territory shown in Exhibit "A"of the Consent to Annexation,
attached hereto, is hereby added by annexation into Poway Landscape
Maintenance District 86-3B and Lighting District Zones A and C
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to cause a
certified copy of this Resolution to be recorded in the Office of the Recorder of San Diego
County

AND CITY OF POWAY CITY LIGHTING DISTRICT, ZONES A AND C
WHEREAS, the undersigned constitute(s) 100 percent ownership [or has legal signature authority
representing 100 percent ownership] of the property shown in Exhibit A, attached hereto, and generally
described as a portion of County Assessor Parcel No. 317-480-10-00 and 317-480-13-00, legally
described as a portion of the southwest quarter of the southeast quarter of Section 13, Township
14 South, Range 2 West, San Bernardino Meridian, according to the official plat thereof, and
Parcel 1 of Parcel Map No. 15715, filed in the office of the County Recorder of San Diego County,
June 21, 1989 as File No. 89-328217 of official records, all in the City of Poway, County of San
Diego, State of California, and any/all subsequent parcels created by any subdivision of said parcel;
and
WHEREAS, the aforementioned property is proposed to be developed and will receive special
benefit from City [District]-maintained street lighting and landscaping; and
WHEREAS, the undersigned owner(s) and do hereby consent to annexation into Poway
Landscape Maintenance District 86-3B and the City of Poway City Lighting District, Zones A and C,
pursuant to the California Streets and Highways Code Section 22608.1, and
WHEREAS, the undersigned owners(s) acknowledge and concur with the balloting of present
property owners within the District that an increase may occur once during any fiscal year not to exceed
the allowed indexing based on the San Diego Consumer Price Index for the previous year; and
WHEREAS, the undersigned owner(s) consent to assessments levied under the assessment
formulas as written within the yearly LMD 86-3B Engineer's Reports, and hereby acknowledges receipt of
the landscaping and lighting benefits to said property
PURSUANT to Section 22608.2 of the Streets and Highways Code of the State of California,
these properties will be included within the required Engineer's Report. The signing of this consent to
annexation precludes any and all notice and hearing requirements for the first year's Report.
