PRESENTATIONS A® Assemblywoman Tricia Hunter was present to make two presentations to former Councilmember Linda Brannon on behalf of the California State Assembly. The first was for her service as a Councilmember and the second naming her as "Woman of the Year" for the 76th Assembly District. Be Mayor Goldsmith presented a "Spirit of Enterprise" commendation to repre- sentatives of R.E. Hazard, Inc. for their outstanding work on resurfacing Poway Grade. Co Betsy Simmons, Poway High School Senior Class President, presented "Grad Night hats" to the Councilmembers and Mayor Goldsmith presented her with a check for $3,000 to help fund the Grad Night activities. He also suggested the forma- tion of a Water Task Force to help with some long-range planning. Howard Stacklin, 13149 Tobiasson Road, asked for information about SB 2774 which mandates low and moderate income housing. CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember McIntyre, to adopt the Consent Calendar as follows: 11. Approval of Minutes - City Council: March 5, 1991, Regular Meeting March 9, 1991, Adjourned Regular Meeting 13. Ratification of warrant register for March 7, 1991. 14. Approval of City's investment report for February, 1991. 15. Adoption of Resolution No. 91-030 entitled, "A Resolution of the City Council of the City of Poway, State of California, Ordering the Summary Vacation of a Water Easement Located Within Lot 63 of County of San Diego Tract 3864, Map Thereof 9766 filed in the Office of the County Recorder of San Diego County on August 20, 1980 {Vacation 91-03)." 16. Acceptance of public improvements for Tentative Parcel Map 89-07, Animal Keeper, on the north side of Oak Knoll Road between Poway Road and Pomerado Road, and release of certain securities. 17. Acceptance of public improvements for Deergrass Sewer {801-02-199), Richard Zamora, applicant, and release of certain securities. 18. Receive and file biannual report on citizens complaints regarding the Sheriff's Department policy on removing abandoned vehicles, indicating no complaints have been received. 19. Acceptance of traffic striping/pavement marker improvements from Orange County Striping and authorization for the City Clerk to record a Notice of Completion. 20. Clarification of Resolution No. P-91-08, Rancho Towing, applicant, for vehicle storage facility at the end of Quate Court, to allow encroachment into the unimproved portion of Quate Court until such time as the road ease- ment is needed. 4113 Page 3 - CITY OF POWAY - March 26, 1991 21. 22. 22.1 Award of bid for 1991-92 weed abatement program to Eaton Field Maintenance. Approval of the following actions regarding pending legislation: support SB 169 regarding repeal of County charges for booking fees and property tax administration; oppose AB 315 which would increase the percentage of rede- velopment agency revenues for low and moderate income housing; support AB 2092 that provides for a six month extension to deadlines for adoption of certain elements of a General Plan including source reduction, recycling and household hazardous waste. Acceptance of the site improvements for the modular office unit at City Hall from T.T.M.S., Inc. and authorization for the City Clerk to file a Notice of Completion. Motion carried unanimously. ITEM 5 ORDINANCE NO. 335 - SECOND READING WATER-CONSERVING TOILETS Mayor Goldsmith read the title of Ordinance No. 335, "An Ordinance of the City of Poway, California, Amending Chapter 15.12 of the Poway Municipal Code to Require Water-Conserving Toilets in New Construction." This is second reading of this Ordinance. There was no one present wishing to speak. Motion by Councilmember Higginson, seconded by Councilmember Emery, to waive further reading, close the public hearing and adopt Ordinance No. 335. Motion carried unanimously. ITEM 5.1 ESPOLA ROAD WIDENING ENVIRONMENTAL ASSESSMENT Councilmember McIntyre disqualified herself from this item and left the meeting at 7:22 p.m. Item introduced by City Manager Bowersox. This is an assessment of the environ- mental impacts connected with a widening of Espola Road from Twin Peaks Road north 1400 feet, including a major drainage project. Staff report by Director of Planning Services Wright-Quastler. Through the initial study process, the project was found to have potential effects on biology and noise levels, however they are not determined to be significant and issuance of a Negative Declaration is recommended. Speaking in opposition to staff recommendation: Joyce Nolte, 14661Espola Road Joe Schwalbach, 14611Espola Road Nell Larson, 14643 Espola Road 4114 Page 4 - CITY OF POWAY - March 26, 1991 Speakers expressed concern over possible decrease in property values; loss of trees and aesthetic values; need for wall if road is widened; and minimal improvement of the traffic situation with only 1400 feet of road being widened at this time. Council questioned whether this project is critical at this time. Following discussion, motion by Councilmember Snesko, seconded by Councilmember Emery to not issue a Negative Declaration, put any available funds towards the South Poway Expressway, and request the Transportation Advisory Committee to establish a priority for this project. Motion carried 4-0 with Councilmember McIntyre disqualified. (Councilmember Mclntyre re-entered the meeting.} ITEM 6 TENTATIVE PARCEL MAP 91-01 APPLICANT: DOUGLAS KEYES Mayor Goldsmith opened the public hearing. City Manager Bowersox stated that the applicant has requested a continuance of this item to April 16, 1991. Staff concurs with this request. Joseph Harrington, 12626 Tustin, asked what the configuration of the lots will be and how the zoning will be affected. Motion by Councilmember Emery, seconded by Councilmember Higginson, to continue consideration of this item to April 16, 1991. Motion carried unanimously. ITEM 7 WATER ALLOCATION ORDINANCE Mayor Goldsmith opened the public hearing and stated that due to the heavy rains this month, the San Diego County Water Authority will be meeting on Thursday to discuss changing the mandatory consumption reductions from 50 percent to possible 35 percent and it will be premature for the City Council to take action at this meeting regarding the allocation plan or pricing structure. Council concurred and discussed again the need for our stages of emergency to be consistent with MWD'S and requested that Linda Brannon, our County Water Authority representative, carry the message that in any allocation plan people need to come first. Motion by Mayor Goldsmith, seconded by Councilmember Snesko, to continue this item to April 9, 1991 and instructed staff to put together a community water fair for April and continue with the DART {Drought Assistance Response Team) program. (Councilmembers Emery and Higginson re-entered the meeting at 9:11 p.m.} Speaking regarding the water situation: Mike McFarland, 14455 Ipava Drive Jerry Hargarten, 13622 Orchard Gate George Broughton, 12910 Neddick Avenue ITEM 9 CONDITIONAL USE PERMIT g0-05 REVOCATION Staff report by City Manager Bowersox. Conditional Use Permit 90-05 was granted to Richard Dart for a restaurant at 12957 Poway Road. Mr. Dart has submitted a written request to withdraw his project and staff recommends revocation of the deed covenants recorded against the property. Motion by Counctlmember Hlgglnson, seconded by Councilmember Emery to direct staff to revoke the covenants associated with Conditional Use Permit 90-05 and issue a rough grading plan for the property. Motion carried unanimously. ITEM 10 RIGHT TURN RESTRICTIONS/ESPOLA TO DURHULLEN Item introduced by City Manager Bowersox. Staff report by Director of Engineering Services Weston. Residents on Durhullen have requested restricting right turns from Espola from 7 to 9 a.m. because of the traffic that uses their street as a short cut to Tierra Bonita and Twin Peaks Schools. The Traffic Safety Committee found that the impacts do not warrant restrictions and recom- mends that none be imposed. Following brief discussion, Council concurred to receive and file this report. ITEM 10.1 METATE LANE TRAFFIC CONDITIONS Staff report by City Manager Bowersox. At the February 26, 1991 City Council meeting, Metate Lane residents requested traffic conditions be reviewed because of a serious accident that had taken place. The Traffic Safety Committee found that Metate Lane is functioning as a residential collector rather than a secon- dary arterial as it is designated in the Circulation Element and recommends a 26 mph speed limit be established on Metate and that the secondary arterial designation be removed with the General Plan update which will give it a 25 mph prima facie speed limit. 4116 Page 6 - CITY OF POWAY - March 26, 1991 Speaking in opposition to staff recommendation: William Dunker, 12666 Metate Lane, requested speed humps on Metate. Leland Myers, 12708 Metate Lane, requested additional stop signs. Following brief discussion, motion by Councilmember Higginson, seconded by Councilmember McIntyre, to direct staff to draft an ordinance establishing a 25 mph speed limit on Metate Lane; remove Metate Lane as a secondary collector from the Circulation Element; and direct the Sheriff's Department to provide addi- tional speed enforcement on Metate Lane. Motion carried unanimously. ITEM 24 CITY ATTORNEY ITEMS City Attorney Eckis requested a closed session on three items. The first two pursuant to Government Code Section 54956.9{a), pending litigation, City of Poway vs. Pomerado Investments, Inc., and City of Poway vs. City of San Diego. Motion by Councilmember Emery, seconded by Councilmember Higginson to hold a closed session under Government Code Section 5956.9{c) and decide whether to initiate litigation against the County of San Diego as requested by City Attorney Eckis. Motion carried unanimously. 14AY~R ANO CITY C(~qCIL-INITIATED ITEI~ 29. Mayor Goldsmith stated that State Senator Craven has requested that each city in San Diego County keep an accounting for the months of April, May and June of the estimated cost of having undocumented workers in the community. Results will be presented to Congress in September. Motion by Councllmember Higginson, seconded by Councilmember McIntyre to direct staff to cooperate in this effort. Motion carried unanimously.
