PISLIC OI~L ~)M#UNICATION$ Mayor Goldsmith explained the procedure for Public Oral Communications. Barbara Babbitt, 14315 Community Road, stated she and her neighbors had received a letter from the city stating the new frontage road created by the Community Road widening would be a private road. Their understanding was that they would retain their Community Road address and that road maintenance would be the City's responsibility. Staff was requested to report back in three weeks. 4130 Page 2 - CITY OF POWAY - April 9, 1991 CONSENT CALENDAR Motion by Councilmember Higginson, seconded by Councilmember Emery, to adopt the Consent Calendar as follows: 8. Approval of Minutes - City Council: March 19, 1991, Regular Meeting 10. Ratification of Warrant Register for March 21, 1991. 11. Denial of claim for damages from Cheryle Garcia. 12. Reduction of securities for on-site landscaping and irrigation for Pacific Groves, TTM 84-08, from $230,000 to $23,000, Standard Pacific, applicant, located east of Espola Road across from Poway High School. 13. Acceptance of landscape improvements in Landscape Maintenance District 85-02A, from TTM 87-12. SilverRidge Development, located north of Matchpoint Drive, east of Poway Road. 14. Approved the following positions on pending legislation: continue support for SB 169 (Boatwright) regarding booking fees; continue opposition to AB 315 {Friedman} which would increase the amount of tax increment revenue allocated for low and moderate income housing; support SB 82 (Kopp} which would reform the provisions of Proposition 13 so that reassessment of busi- ness property would occur more like those of residences; support SCA 11 {Morgan) which would provide an exception from the property tax limitation in certain instances; oppose AB 883 (Boland) which would hold a public entity liable for the failure to perform a mandatory act while issuing a permit. Motion carried 4-0 with Councllmember Snesko absent. ITEM 4 ORDINANCE REGARDING WATER SHORTAGE EMERGENCY ITEM 5 WATER AVAILABILITY STATUS REPORT City Manager Bowersox and Director of Public Services Archibald reported on Metropolitan Water District (MWD) action today going from stage 6 to stage 5 alert and ordering mandatory reductions in consumption of 20% municipal & industrial and 50% agricultural. Based on past actions, the San Diego County Water Authority will probably meld those reductions into a 30% across the board reduction. They will meet on April 11. Mr. Archibald reported that for the first 7 days of this month, Poway is using 50% of its allocation. 4131 Page 3 - CITY OF POWAY - April 9, 1991 Council reiterated their "people come first" position and preference for the 20% and 50% reductions rather than 30%. Motion by Councllmember Emery, seconded by Councilmember Higginson to continue these items to the workshop on April 11, 1991. Motion carried 4-0 with Councilmember Snesko absent. City Manager Bowersox stated that the city will begin to irrigate the active park areas this week. ITEM $ PALOMAR COMMUNITY COLLEGE DISTRICT City Manager Bowersox recommended this item be removed from the calendar since this site is also being considered for affordable housing. Motion by Councilmember Hlgglnson, seconded by Councilmember Emery to remove the item of joint appraisal with Palomar Community College District for potential satellite campus from the calendar. Motion carried 4-0 with Councilmember Snesko absent. ITEM 7 ALIGNMENT OF SOUTH POWAY EXPRESSWAY Item introduced by City Manager Bowersox. Staff report by Director of Engineering Services Weston. The conceptual design of the South Poway Express- way was adopted as part of the South Poway Planned Community documents. The precise alignment of the road has been adopted as part of the individual tenta- tive maps that have been approved. As a condition of their tentative map, the developers of Parkway Business Centre are required to construct the road from their easterly boundary to Sycamore Canyon Road which requires establishment of the precise alignment. Staff recommends approval. Motion by Councilmember Emery, seconded by Councilmember Higginson to approve the precise alignment of South Poway Parkway from the easterly boundary of Parkway Business Center to Sycamore Canyon Road as presented. Motion carried 4-0 with Councilmember Snesko absent. ITEM 7.1 LOAN TO ADAPT Staff report by City Manager Bowersox. The City has been a member of the Alcohol & Drug Abuse Task Force (ADAPT) since its inception. ADAPT has requested a loan of $20,000 from the city to assist its cash flow difficulties as it transitions from a voluntary organization to one that provides services through grants. Staff recommends approval. 4132 Page 4 - CITY OF POWAY - April g, 1991 Council expressed concern that, as stated in the letter from ADAPT's Executive Director, not all member agencies have paid their dues and suggested we need some assurance their payments will be forthcoming. Motion by Councilmember Emery, seconded by Councilmember Higginson, to loan ADAPT $10,000 for a one-year period with an additional $10,000 to be loaned once all the member agencies have paid their dues. Motion carried 4-0 with Councilmember Snesko absent. ITEM 15 CITY MANAGER ITEMS City Manager Bowersox announced that a press conference will be held on Tuesday, April 16, 1991 at 9:30 a.m. at City Hall with Sheriff Roache. Poway will be receiving the first fleet of black and white Sheriff's cars, replacing the green and white cars, at that time. ITEM 16 CITY ATTORNEY ITEMS City Attorney Eckls requested a closed session pursuant to Government Code Section 54956.8 to give instructions to the City Manager who will negotiate with Mrs. Ogle or her designee regarding acquisition of property located at the northeast corner of Midland and Aubrey Streets. PAYOR AND CZTY COUNCZL-ZHiTZATEO iTEN$ 17. Counctlmember Emery's item regarding the campaign ordinance will be heard on April 16, 1991 as Items 8 and g. 18. Councilmember Higginson stated that Poway will have three Little League leagues in 1992, and requested staff begin looking at potential sites for dirt fields to accommodate the additional teams. 19. A) {City Manager Bowersox left the room as he lives on Triumph Drive and has a potential conflict of interest.) Councilmember McIntyre stated she and Director of Engineering Services Weston had met with residents on Triumph Drive recently regarding additional traffic control measures. This item has been before Council several times in the past few years and circumstances have changed with the pending construction of Silverset Park. The request is for a 3-way stop sign at Fieldview and Triumph and road bumps. Road bumps appear to be effective as evi- denced by their trial period on Carriage Road. Speaking in favor of Councilmember McIntyre's recommendation: Mike Clark, 13089 Triumph Drive Diane Garner, 12734 Triumph Drive 4133 Page 5 - CITY OF POWAY - April 9, 1991 Following discussion, motion by Councilmember McIntyre, seconded by Councilmember Higginson to approve a 3-way stop at Fieldview and Triumph and instruct the Traffic Safety Committee to meet with residents to discuss placement of road bumps. Motion carried 4-0 with Councilmember Snesko absent. B) Councilmember McIntyre stated she has been asked to work with the Chamber of Commerce regarding the May 26 street fair and suggested the city sponsor a booth. Council discussed having water conservation material and information regarding the impact of shopping in Poway in terms of what services a citizen's sales tax will buy. CLOSED SESSION Mayor Goldsmith adjourned the meeting into closed session at 8:10 p.m. CALL TO t~RDER AND AI~IOURI~NT Mayor Goldsmith called the meeting back to order at 8:59 p.m., and stated that Council had instructed their negotiator. Upon motion by Councilmember Higginson, seconded by Councilmember Emery, Mayor Goldsmith ordered the meeting adjourned to 4:30 p.m., Thursday, April 11, 1991.
