The April 16, 1991, regular meeting of the City Council of the City of
Poway, was called to order at 7:03 p.m., by Mayor Goldsmith at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

Deputy Mayor Emery led the Pledge of Allegiance.
PRESENTATION
Susan Baldwin from San Diego Association of Governments (SANDAG) made a presen-
tation to the City Council regarding the Regional Growth Management Strategy
being developed as a result of the passage of Proposition C in November, 1988.
A draft will be presented to the SANDAG Board, which also serves as the Regional
Planning and Growth Management Review Board, on April 24, with a recommendation
to approve for distribution.
PROCLAIMTIOH
Mayor Goldsmith presented a proclamation for "Earth Day", April 22, and "Earth
Week", April 15-22, to Lori Saldana. She invited the City Council and public to
the Earth Fair in Balboa Park on April 21.

Mayor Goldsmith explained the procedure for Public Oral Communications.
1. Leland Myers, 12708 Metate Lane, asked about the recent approval for
stop signs and road bumps on Triumph Drive and stated Metate Lane
still has traffic problems with insufficient enforcement.
Staff will prepare an update on Metate Lane for May 7, 1991.
CONSENT CALENDAR
Motion by Councllmember Emery, seconded by Councilmember Snesko, to adopt the
Consent Calendar as follows:

16. Ratification of Warrant Register of March 28, 1991.
17. Denial of claim for damages from Paul Figueroa.
18. Adoption of Resolution No. 91-032 entitled, "A Resolution of the City
Council of the City of Poway, California, Establishing a Charge for Agenda
Mailing and Tape Copying by the City Clerk's Office."
19. Adoption of Resolution No. 91-033 entitled, "A Resolution of the City
Council of the City of Poway, State of California, Ordering the Summary
Vacation of Drainage and Slope Easements Beyond the Limits of the Street
Right-of-Way for Pomerado Road and Twin Peaks Road per Document Nos. 78-145263
and 80-363497, Official Records," for Twin Peaks Plaz~, TPM 86-03 tVacation

20. Acceptance of public improvements including street, drainage and water
facilities from Camel Mountain Ranch for Camino del Norte.
21. Adoption of Resolution No. 91-034 entitled, "A Resolution of the City
Council of the City of Poway, California Ordering the Summary Vacation of an
Irrevocable Offer of Dedication of a Public Highway Easement Recorded
September 29, 1980 in the Office of the County Recorder of San Diego County"
for Camelot Terrace, TTM 87-03 {Vacation 91-05).
22. Adoption of Resolution No. 91-035 entitled, "A Resolution of the City
Council of the City of Poway, California, Approving an Amendment to the San
Diego County Hazardous Waste Management Plan" for the "fair share" policies.

23. Approval of two temporary water connections to serve Assessor Parcel Numbers
323-060-54 and 56, located approximately 750 feet south of Garden Road on
Clair Drive; Fred Kuhlman, applicant.
24. Adoption of Resolution No. 91-036 entitled, "A Resolution of the City
Council of the City of Poway, California, Authorizing Joint Bidding of
Traffic Signal and Street Lighting Maintenance Services for the cities of
Poway, E1Cajon, La Mesa, Lemon Grove and Santee."
25. Award of bid for Unit i Surface Improvements, Parkway Business Center, CFD
88-1 to Palomar Grading & Paving in the amount of $1,188,918.
26. Appropriation of $290,000 to reimburse cost of state land acquisition
(39-8930), $1,002,320 to Silverset Park {39-5618), $300,000 to pay back the
General Fund {1-8134) for the Carriage Road Medians {39-5253), and $101,000
to Starridge Walkway {39-5273) from sale of state lands funds {39-8930).
27. Approval of agreement with Poway Park Meadows Homeowners Association {TTM
87-01) for landscape maintenance on the west side of Rose Court in the
Poinsettia Family Mobile Home Park.
28. Authorization for San Diego Association of Governments to perform a transit
survey.
Motion carried unanimously.
ITEM 5
TENTATIVE PARCEL MAP 91-01
APPLICANT: DOUGLAS KEYES
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. He stated Mr. Keyes has requested this item be removed from calendar
until further notice and staff recommends this request be approved.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Higginson to remove
Tentative Parcel Map 91-01 from calendar. Motion carried unanimously.
ITEM 6
ORDINANCE NO. 336
ALLOCATION OF WATER SUPPLIES
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. He stated that due to conservation efforts and the rains in March,
the San Diego County Water Authority {CWA) is requiring a reduction in consump-
tion of 20% rather than 50% and a water emergency does not have to be declared.

Staff will amend Ordinance No. 336 to meet Council's direction on complying with
the 20% cutback and staff recommends continuing this item to April 30, 1991
following discussion.
Council discussed various items with Llnda Brannon, Poway's CWA representative,
and Director of Public Services Archibald.
Jim Harrlgan, 12817 Orpha Court, asked about a service charge on his bill
for not using water.
City Manager Bowersox explained the capacity and commodity charge on the bill.
Larry Cruse, 13734 Utopia Road, asked about using 1989 for the base year
since many people were already conserving water then.
City Manager Bowersox stated that billing will not be based on prior
consumption.
Motion by Councllmember Emery, seconded by Councilmember Higginson to continue
consideration of Ordinance No. 336 to April 30, 1991. Motion carried
unanimously.
ITEM 10
ORDINANCE REGARDING WATER CONSERVATION PLAN
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. This ordinance is not ready to consider. It will be a seven stage
conservation plan conforming to Metropolitan Water District's seven stages and
will replace our current four stage plan. Staff recommends removing from calen-
dar until it is ready to be heard.
Motion by Councilmember Higginson, seconded by Councllmember Emery to remove
this item from calendar. Motion carried unanimously.
ITEM 7
TENTATIVE PARCEL MAP 87-04 TIME EXTENSION
APPLICANT: JEFF CARROL
Mayor Goldsmith opened the public hearing. Staff report by City Manager
Bowersox. This is a request for a second one-year time extension for a map
located at the northeast corner of Chancellor Way and Adah Lane. Staff
recommends approval.

Motion by Councilmember Higginson, seconded by Councilmember Emery to close the
public hearing and adopt Planning Resolution No. P-91-23, entitled, "A
Resolution of the City Council of the City of Poway, California, Approving
Tentative Parcel Map 87-04TE{2}, Assessor's Parcel Number 323-262-09 and 10."
Motion carried unanimously.
ITEM 8
ORDINANCE NO. 337 - FIRST READING
CAMPAIGN CONTRIBUTION
Mayor Goldsmith opened the public hearing and read the title of Ordinance No.
337, "An Ordinance of the City of Poway, California, amending Chapter 2.28 of
the Poway Municipal Code Regulating Campaign Contributions and Expenditures."
Staff report by City Attorney Eckis. This ordinance amends the campaign
contribution ordinance to provide for civil enforcement as an alternative to
criminal enforcement, and clarifes prohibitions and disclosures required when
contributions or expenditures are made on behalf of another person.
There was no one present wishing to be heard.
Following discussion, motion by Councilmember Higginson, seconded by Council-
member Snesko to waive further reading and continue the public hearing to April
30, 1991 for second reading. Motion carried unanimously.
ITEM 9
ORDINANCE NO. 338 - FIRST READING
PETITION CIRCULATORS
Mayor Goldsmith opened the public hearing and read the title of Ordinance No.
338, "An Ordinance of the City of Poway, California, Adding Chapter 2.30 of the
Poway Municipal Code Relating to Municipal Election Petition Circulation."
Staff report by City Attorney Eckis. As a result of requests by citizens, staff
has prepared this ordinance requiring registration of paid petition circulators
on local matters and filing of facts sheets to be distributed to those solicited
for signatures. Assembly Bill 3148 was recently enacted which makes it a misde-
meanor to intentionally misrepresent or make any false statement concerning an
initiative, referendum or recall petition.

further reading and set second reading for April 30, 1991. Motion carried
unanimously.
RECE~,~ AND CALL TO ORDER
Mayor Goldsmith called for a recess at g:05 p.m. and called the meeting back to
order at 9:15 p.m. with all Councllmembers present.
ITEM 12
WATER RECLAMATION PROJECT
Item introduced by City Manager Bowersox. Staff report by Director of Engineer-
ing Services Weston. The City has been actively pursuing the construction of a
8 million gallon per day water reclamation plant since 1988. In addition, as a
response to the 1991 drought, the City has investigated interim reclamation
facilities to supplement the limited water supply. Staff recommends that a
"package" plant be constructed north of Abraxas High School to provide reclaimed
water for construction purposes; that the existing Pomerado County Water
District plant be reactivated if water supplies are cut to 50%; and authorize
staff to negotiate an agreement with the City of San Diego to incorporate
Poway's water reclamation facility into the Clean Water Program. Staff presented
a list of elements to be included in the agreement.
Harold Bailey and John Moutes with the Clean Water Program were present and
discussed water reclamation with the Council.
Larry Cruse, 13734 Utopia Road, asked about odors from the package plant.
Bruce Kravitz, 13326 Aubrey Street, asked about relinquishing Poway's plant
in light of legal challenges to Metro's program.
Following discussion, motion by Councilmember Emery, seconded by Councilmember
Higginson, to approve construction of a package plant and set a price for
construction water; to proceed with the permit process with the City of San
Diego to reactivate the wastewater treatment plant; and to negotiate an
agreement with the City of San Diego to include Poway's plant in the Clean Water
Program including conditions proposed by staff and that divestiture of the pro-
perty would not take place until the entity to succeed Metro is in place.
Motion carried unanimously.
ITEM 13
SPORTS COMPLEX SITES
Item introduced by City Manager Bowersox. Staff report by Director of Community
Services Thomas. The Parks & Recreation Committee is recommending that the
Kuebler property at the southwest corner of Garden and Sycamore Canyon Roads be
the primary site for a sports complex with South Poway location as a secondary

site and that a meeting be held with the Garden Road area residents. In
addition, the County of San Diego has notified the city that the old dump site
has approximately three acres that could be used for ballfields, BMX or skate-
board facility.
Alan Sugarman, 13385 Fallen Leaf Road, Chairman of the Parks & Recreation
Committee, stated that the Committee had reduced the potential sites
from 12 to 2 for presentation to the City Council.
Council discussed the layout of the Garden Road site to reduce the impact on the
neighbors; the cost scenarios and requested an additional one showing a land
swap of Kuebler and South Poway; and desirability of meeting with the Garden
Road residents prior to designating a site.

the Garden Road Homeowners
Following discussion, motion by Councilmember Emery, seconded by Councilmember
McIntyre, to refer the item back to staff and not designate a primary site at
this time; direct staff to look at other configurations of facilities for both
sites; further analyze the financing of both sites, including operating costs;
analyze traffic impacts; analyze "pay for play" operation; determine how many
children live in the Garden Road area; come back with interim report in four
weeks and, if Garden Road site is still viable, schedule a meeting with the
Garden Road residents in six weeks. Motion carried unanimously.

City Manager Bowersox stated that Garry MacPherson, Fire Battalion Chief and
head of the Drought Assistance Response Team, and his wife Gall had a 6 lb.
12 oz. daughter, Brittlynn Rose, on April 12, 1991.
City Manager Bowersox stated that the city has received an award of merit
for Valle Verde Park from the California Parks & Recreation Society.
