CC 2005 07-19 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING JULY 19, 2005 The July 19, 2005, Regular Meeting of the City Council of the City of Poway, was called to order at 7:04 p.m. by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS Presentation of Certificates of Commendation to the Board of Directors for the Poway Senior Center. Mayor Cafagna presented certificates to Lynn Bayne and Pat Bresee. The Mayor also recognized Lee Haviland, Lys Barawid, Dr. Dhruv Dhupa and Andy Patapow as receiving certificates, but unable to attend the Council meeting. CITY COUNCILMEMBER ANNOUNCEMENTS Deputy Mayor Emery gave a review of the Wild Ginger Restaurant. 8443 Page 3 - CITY OF POWAY - July 19, 2005 PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedures for Public Oral Communications. The following people spoke: Tracy Stover, 14945 Conchos Drive, Poway, spoke in support of Poway High School Agriculture Program and invited the City Council to support their endeavors. Page 2 - CITY OF POWAY - July 19, 2005 Brooke Seibert, 14445 Ortez Place, Poway, spoke about the future of the Poway High School's Agricultural Program and asked Council for their support. City Council consensus was to place this issue on a future agenda. Connie Messina, 12643 Oak Knoll Road, Poway, representing the South Poway Residents Association, urged the City Council to work with the Redevelopment Agency and Park and Recreation Advisory Committee to create a neighborhood park on the nine-acre property next to the Kumeyaay-Ipai Interpretive Center between Poway Road and Oak Knoll Road. CONSENT CALENDAR Items 6 through 11.1. Motion by Council member Higginson, seconded by Deputy Mayor Emery, to approve the Consent Calendar. 6. Award of Bid for the Fire Station #3 Slope Landscape Project - CIP #5544, Bid No. 05- 021, to Blue Pacific Engineering & Construction in the amount of $125,079 and appropriate an additional $35,000 from the RDA Capital Improvement Project Fund to the Slope Landscape Project budget. (0700-10) Motion carried 3-0 with Councilmembers Boyack and Rexford absent. 8444 Page 3 - CITY OF POWAY - July 19, 2005 CONTINUED PUBLIC HEARINGS ITEM 1 (0750-95/#624) ORDINANCE NO. 624 - SECOND READING ADDS POWAY MUNICIPAL CODE SEC. 12.26 USE OF STREETS FOR VEHICLE DELIVERY Mayor Cafagna opened the public hearing and City Manager Bowersox presented the staff report. On June 28, 2005, the City Council introduced and had the first reading of Ordinance No. 624. All Councilmembers were present at the first reading with the exception of Councilmember Higginson. No public testimony was given at that time. There was no one present wishing to speak on this matter. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to close the public hearing, waive further reading (unanimous vote), and adopt Ordinance No. 624 entitled, "An Ordinance of the City of Poway, California, Adding Chapter 12.26 to the Poway Municipal Code to Restrict Automobile Dealerships from the Use of Streets for Vehicle Delivery." Motion carried 3-0 with Councilmembers Boyack and Rexford absent. PUBLIC HEARING ITEM 2 (0200-50) TENTATIVE PARCEL MAP (TPM) 05-02 13641 SOMERSET ROAD APN: 314-242-04 APPLICANT: ERB ENGINEERING INC OWNFRS' nONAI n P. r,AII KlnNFR Mayor Cafagna opened the public hearing. City Manager Bowersox presented the staff report. Approval of this project would subdivide a 0.51-acre residential property, located at 13641 Somerset Road, within the Residential Single-Family 7 zone (RS-7) into two parcels. It is proposed that the existing residence on the property be maintained. The site is a double frontage lot bounded by Somerset Road and Janette Lane. Access to the new lot will be from Janette Lane. There was no one present wishing to speak on this matter. Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to close the public hearing and adopt Resolution No. P-05-50, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Parcel Map (TPM) 05-02, Assessor's Parcel Number 314-242-04" approving with conditions. Motion carried 3-0 with Councilmembers Boyack and Rexford absent. 8445 Page 4 - CITY OF POWAY - July 19, 2005 ITEM 3 (0210-30) CONDITIONAL USE PERMIT (05-03) 12576 KIRKHAM COURT APN: 317-225-05 APPLICANT: SUSAN BARNES, SOCAL ELITE ALLSTARS Mayor Cafagna opened the public hearing. City Manager Bowersox presented the staff report. The applicant is requesting approval to establish a cheerleading studio for class instruction within a 5,381-square-foot tenant space in the Light Industrial (L1) zone, in the South Poway Specific Plan area. The proposed location is an existing industrial building located at 12576 Kirkham Court, Building H, Suite 2. The center will offer cheerleading classes after school and on Saturdays. No exterior improvements are proposed. There was no one present wishing to speak on this item. Motion by Councilmember Higginson, seconded by Deputy Mayor Emery, to close the public hearing and adopt Resolution No. P-05-51 entitled, "A Resolution of the City Council of the City of Poway, California, Approving Conditional Use Permit 05-03 Assessor's Parcel Number 317-225-05", approving with conditions. Motion carried 3-0 with Councilmembers Boyack and Rexford absent. STAFF REPORTS ITEM 4 POWAY SENIOR CENTER STATUS UPDATE (0630-07) City Manager Bowersox and Director of Community Services Clark presented the staff report. On March 24, 2004 the Executive Director of Poway Senior Center (PSC) submitted a proposal to the City requesting the City's financial support in funding Center operations. Since that time, the City Council has authorized Poway Valley Senior Center Corporation (PVSCC) to withdraw up to $155,000 from the Center's Endowment Fund, of which $119,300 was withdrawn. On June 22,2004, the City Council authorized a contract with a consultant to conduct a third-party assessment of Center operations to determine what level of financial support if any, the City should provide. After having read the consultant's report, the City Council authorized a contract on January 25, 2005, to have the same consultant work directly with the PVSCC to bring about significant operational and financial changes geared toward financial independency. Each of the City Council's actions was fully supported by the PVSCC Board of Directors. A summary of the consultant's activities and PSC's financial outlook for FY2005/06 was presented to the Council. There was no one present wishing to speak on this item. The City Council received the report and directed it be filed. 8446 Page 5 - CITY OF POWAY July 19, 2005 ITEM 5 (1000-10) BEAUTIFICATION OF UNTILlTY BOXES THROUGH LOCAL ARTISTS Motion by Deputy Mayor Emery, seconded by Councilmember Higginson, to continue this item to a future agenda, August 2,2005, when Councilmember Rexford, who had suggested this project, is present. Motion carried 3-0 with Councilmembers Boyack and Rexford absent. MAYOR AND CITY COUNCIL -INITIATED ITEMS 15. Councilmember Rexford's agenda item requested and received concurrence in the appointment of C. Earl Chinn as a member to the Performing Arts Advisory Committee. (0120-50) 17 A. Deputy Mayor Emery gave his restaurant review at the beginning of the meeting under City Council member Announcements. 17B. Deputy Mayor Emery noted the proliferation of temporary, hand-made signs installed on posts and light poles advertising garage/yard sales. He asked staff to provide education and information to the community regarding taking signs down after the event and preventing damage to posts/poles. Deputy Mayor Emery reported that he traveled on the high-speed rail with other MTS representatives along the Carrizo Gorge Line from Plaster City to Campo. 18. Mayor Cafagna reported that he and Deputy Mayor Emery attended the opening ofthe east line of the San Diego Trolley with a connection at San Diego State University's underground station.
