Res 05-083 RESOLUTION NO. 05-083 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DETERMINING THAT THE COMMUNITY ROAD LAW OFFICE SITE WORK IS OF BENEFIT TO THE PAGUAY REDEVELOPMENT PROJECT WHEREAS, the City Council is authorized to carry out the redevelopment of the Poway Redevelopment Project Area; and WHEREAS, the City Council, in partnership with the local business and residential community, has identified a need for the Community Road Law Office Site Work to facilitate the development of affordable housing by reconfiguration of the law office building on the project site; and WHEREAS, the Community Road Law Office Site Work is proposed to be located within the Paguay Redevelopment Project Area and the improvements are necessary for the execution of the Project under the provisions of California Community Redevelopment Law (Health and Safety Code, Section 33000 et seq.) and pursuant to the Redevelopment Plan for the Project which was adopted on December 13, 1983, by Ordinance No. 117 of the City Council and amended on June 15, 1993, by Ordinance No. 415 of the City Council; and WHEREAS, Section 33445 of the California Health and Safety Code requires the City Council to determine that the project is of benefit to the Paguay Redevelopment Project and that no other reasonable means of financing are available to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, California, as follows: Section 1. The City Council hereby determines that the Community Road Law Office Site Work, consisting of complete grading, including erosion control, installation of public utilities including sewer, water, storm drain, electrical, telephone and gas, and paving on the law office site located on Community Road, just south of Hilleary Park, and landscaping of site areas will be of benefit to the Paguay Redevelopment Project and the surrounding community in that the improvements will provide appropriate access to a neighboring affordable housing site and to an additional eight units on the affordable housing site; the existing law office building will be relocated and replaced onto another location on the site. This site work will allow the completion of the replacement law office building. Further, the project will meet goals listed in the Redevelopment Plan, as amended on June 15, 1993, and in the Redevelopment and Housing Implementation Plan, which includes the provision, improvement or preservation of low- and moderate-income housing as it is required to satisfy the needs and desires of the various age and income groups of the community, maximizing the opportunity for individual choice, and meeting the requirements of state law. Resolution No. 05-083 Page 2 Section 2. The City Council further determines that no other reasonable means of financing the improvements are available to the community. Section 3.
