PROCLAI~TII31~ Mayor Goldsmith presented a proclamation to City Clerk Wahlsten declaring May 5-11, 1991, as "Municipal Clerk's Week." Mayor Goldsmith presented a proclamation to DART Program Manager MacPherson declaring May, 1991, as "Water Awareness Month." City Manager Bowersox noted that Poway has used 41% less water in April, 1991 than in April, 1989, the base year. The week's conservation totals are 32% less than the same period in 1989. There was no one present wish]'ng to speak. 4167 Page 2 - CITY OF POWAY - May 7, 1991 CONSENT CALENDAR Motion by Councllmember Emery, seconded by Councilmember Higginson, to adopt the Consent Calendar as follows: Approval of Minutes - City Council: April 11, 1991, Adjourned Regular Meeting April 16, 1991, Regular Meeting 9. Ratification of Warrant Register for April 18, 1991. 10. Acceptance of certain public improvements, Pomerado Business Park, Phase II, Tentative Tract Map 85-04; CF Pomerado, Inc. 11. Appropriation of $25,000 from the Library Capital Improvement fund for the Library Advisory Committee to hire a consultant to assist in preparation of a plan of service, building objectives, selection criteria for architects and review of architectural design. 12. Approval of final map for Tentative Parcel Map No. 91-03 located at the northwest corner of Camino del Norte and Pomerado Road, Phillip Laugen/San Marcos Development/Bank of San Diego et al, owners; and adoption of Resolution No. 91-044 entitled, "A Resolution of the City Council of the City of Poway, California, Ordering the Expansion of Poway Landscape Maintenance Assessment District No. 83-01 with Written Consent of all Property Owners {TPM 91-03)." 13. Approval of the following positions on pending legislation: support AB 26 which would repeal SB 2557 which established booking fees; oppose AB 3 which would establish regional development infrastructure agencies; oppose SB 959 which would establish a charge for urban water retailers receiving more than 100 acre feet of water to subsidize rural water systems; oppose SB 552 which would preempt local agencies' ability to adopt ordinances banning brine- discharging water softeners; support SB 235, AB 1423, AB 1340, AB 1609, AB 75D, SB 1143, AB 2076, and AB 2213 all of which would stimulate the recycling markets; support SB 1230 which would provide for general obliga- tion bonds for library construction to be on the June, 1992 state-wide ballot. 13.1 Appropriate additional $75,130 for the city's contribution to the joint purchase of Goodan Ranch. Motion carried unanimously. 4168 Page 3 - CITY OF POWAY - May 7, 1991 ITEM 4 ORDINANCE NO. 339 - SECOND READING SPEED LIMIT - METATE LANE Mayor Goldsmith read the title of Ordinance No. 339, "An Ordinance of the City of Poway, California, Adding Section 10.32.020(D) to the Poway Municipal Code Decreasing Speed Limits on Metate Lane Between Pomerado Road and 150 Feet East of Rick Street." There was no one present wishing to speak. Motion by Councllmember Emery, seconded by Councilmember Higginson to waive further reading, close the public hearing and adopt Ordinance No. 339. Motion carried unanimously on a roll call vote. ITEM 5 ORDINANCE NO. 338 - SECOND READING ELECTION PETITION CIRCULATION Mayor Goldsmith read the title of Ordinance No. 338, "An Ordinance of the City of Poway, California, Adding Chapter 2.30 of the Poway Municipal Code Relating to Municipal Election Petition Circulation." There was no one present wishing to speak. Motion by Councllmember Hlgglnson, seconded by Councilmember Snesko to waive further reading, close the public hearing and adopt Ordinance No. 338. Motion carried unanimously on a roll call vote. ITEM 6 METATE LANE TRAFFIC ENFORCEMENT Staff report by City Manager Bowersox. There continues to be concern from residents on Metate Lane regarding excessive traffic speed on their street. The Sheriff's Department has been doing increased traffic enforcement and presented a report of 34 citations issued from March 28 to May 2. Council concurred to receive and file this report. ITEM 6.1 GENERAL PLAN UPDATE SCHEDULE Staff report by City Manager Bowersox. The original schedule for the General Plan review and adoption was for a May 2 workshop and June 25 adoption. Due to certain circumstances, staff is reconmending a revised schedule, including a workshop on May 23 and public hearings on July 16, 30 and August 13. The state- established deadline for adoption is July 1, 1991, however, it has become necessary to go beyond that deadline. 4169 Page 4 - CITY OF POWAY - May 7, 1991 Mayor Goldsmith suggested staff prepare a letter to the State Department of Housing and Community Development explaining the circumstances of the missed deadline and Council concurred with the revised schedule. ITEM 15 CITY ATTORNEY ITEMS City Attorney Eckls stated he did not need a closed session under Section 549§6.9{b)(1) as stated on the agenda since the threatened litigation has become pending litigation. However, a closed session is requested under Section 54956.9{a) to discuss the cross complaint filed in the case of Village & Country Properties vs. the Cities of San Diego and Poway. Councllmember Hlgginson commented on a memo he had received from staff regarding the status of negotiations with Cox Cable and reminded staff that the City Council has not yet approved televising the meetings. 19. Councilmember Snesko's requested item will be discussed following the closed session. 20. A) Mayor Goldsmith stated he is requesting a closed session under Government Code Section 54957 to discuss the performance of a public employee. Council concurred. B) Mayor Goldsmith requested this item be continued to May 14, lg91. CLOSED SESSION Mayor Goldsmith adjourned the meeting into closed session at 7:28 p.m. ~.~LL T~ ORDER AgD AD~OURI~'gT Mayor Goldsmith called the meeting back to order to 11:05 p.m. with all Councilmembers present and announced that no action had been taken in closed session and requested Item 19 be placed on the May 14, 1991 agenda. Upon motion by Councilmember Higginson, seconded by Councilmember Snesko, Mayor Goldsmith ordered the meeting adjourned to 4:30 p.m., Thursday, May 9, 1991.
